3 September 2026 · party filing before the 17 September decision

OppositionCuatrecasas opposes Matkator's reconsideration application concerning the refusal to suspend enforcement.
Immediate relief soughtContinuation of enforcement without further delay and a decision granting the pending adjudication request concerning registered property 8584.
Assignment of bidThe filing maintains the requested ability to assign the successful bid/remate to a third party.
DP 748 positionCuatrecasas argues that the provisionally dismissed criminal proceeding does not satisfy the suspension conditions and does not affect the Cambiario title or enforcement order.
Party-submission boundary. These are Cuatrecasas's stated positions and requests, not judicial findings. The filing does not prove that adjudication or assignment has occurred, identify an assignee or beneficiary, or establish deception, criminal intent or liability.

17–18 September 2026 · judicial outcome and service provenance

17 September orderThe signed court order dismisses Matkator's reconsideration application against the refusal to suspend enforcement and states that no appeal lies from that order.
Scope boundaryThe order decides the suspension reconsideration only. It does not decide DP 748, identify an adjudicatee/assignee, or prove completed adjudication, registration, possession or cession.
Native service integrityThe served order SHA-256 is 020b5313c93565cbb536d5eb40feca0e0e7755c20a5e0bada3b91d863a0c6652. The cover and served-order hashes match the native notification summary. Raw wrapper/cover copies remain private under the confidentiality/data-protection boundary.
SearchabilityAll three native PDFs are text-searchable; no OCR was required. Public verification uses source-safe court text, not the confidential notification wrapper.
Subsidiary-relief issue under counsel review. The filed 26 June reconsideration application separately sought, if total suspension were refused, suspension of irreversible adjudication, registration, possession and disposal acts. The located 17 September order contains no differentiated ruling on that subsidiary prayer. A working package has been delivered to counsel to assess Article 215.2 LEC; no complement filing is asserted without primary presentation proof.
Deadline control. No final Article 215.2 expiry is calculated or published here. Counsel must verify the complete notification record and applicable procedural computation.

Corrected Aweswell / Matkator distinction

Controlled-corpus finding. Invoices, proformas and extrajudicial fee discussions with Aweswell/Gil are documented. No Cuatrecasas judicial fee-recovery action against Aweswell has been identified in the controlled Spain/UK corpus reviewed to 18 September 2026. The judicial route identified here was against Matkator through Cambiario 1048/2019 and this ETJ.

This does not establish that Matkator was not liable. The original promissory notes, engagement and billing allocation, signatory authority, initiating Cambiario claim and certified service/title record remain decisive.

DP 748 status after 16 September

The DP 748 reform was decided on 16 July and transmitted on 1 September. On 9 September the complainant filed an impulse of the already-lodged subsidiary appeal, Article 766.4 allegations ad cautelam and the 3 September ETJ opposition as a supervening document. On 16 September the LAJ ordered the subsidiary appeal to proceed and gave the Ministerio Fiscal five days for submissions.

Careful treatment. Origin-court appeal processing is now verified. Remittal to the Audiencia Provincial, a separate appellate roll, panel and outcome remain unverified. The 17 September ETJ order is a later civil development and does not decide the criminal appeal.

Source-identified judicial office-holders

Canonical act-specific identities include Carmen Rosa Marrero Fumero (judge), María del Pilar Parrilla Martín, Juan Manuel Pérez Ramos, Cristina María Hernández Díaz and Francisco Martín Pozo (LAJ capacities at source-verified dates). The 28 July 2026 act names Cristina María Hernández Díaz in its body/header while Francisco Martín Pozo is the electronic LAJ signatory; the discrepancy is preserved and not explained by inference.

Criminal boundary. ETJ 163/2020 is a civil enforcement proceeding. Interlinking it with DP 748/2026 does not convert civil acts, adverse rulings or professional participation into evidence of criminal intent.
