Client position, verified status and recovery purpose

Programme in motion. The documentary reconciliation, preservation and public-record correction programme is active. We are maintaining the joined mandate, billing, instrument, title/service, enforcement and beneficiary record, and pursuing protection, accountability and recovery through the appropriate distinct channels. Each action is recorded at its evidenced stage: instruction, preparation, transmission, filing, decision or implementation. An active programme is not a representation that every requested step has been filed, ordered, served or completed. Private advice remains private; historical quotations and court decisions retain their original wording and date.

Gil Marer’s factual confirmation, not a judicial finding: he states categorically that AWESWELL LIMITED alone engaged Cuatrecasas, Matkator never engaged the firm in Spain or the United Kingdom, and Matkator owed no underlying professional-fee debt of its own. He describes the notes as an internal-accounting accommodation with a limited/residual purpose; expected payment came from financing/the transaction and hotel income. No unrestricted guarantee or assumption of another entity’s fees is conceded. The agreed restrictions and legal effect of the instruments need their own evidence.

Separate documentary anchor: the located July-2019 schedule contains 22 invoices: 20 addressed to AWESWELL, two to LPB and none to Matkator. The absence of a retainer alone does not decide enforceability of the notes. Cause, authority, delivery conditions and allocation remain to be examined without describing a Matkator engagement as an admitted fact.

Verified procedural state: on 16 September DP 748/2026 ordered joinder of submissions/document and a five-day transfer to the Ministerio Fiscal. This does not establish remittal to the Audiencia Provincial, an appellate roll, reopening or outcome. On 17 September the reposición against refusal to suspend ETJ 163/2020 was dismissed; that is not an adjudication or cession order. A later complement request, other application or notice needs its own receipt before it is described as filed/sent.

Joined factual inquiry; separate responsibilities: protective mandate → work/billing → purpose and use of notes → title formation and service → enforcement → any transfer and beneficiary. The allegation of mandate inversion is preserved. No agreement with Acosta Matos or perimeter-connected assignee is established here. Invoice, WIP, estimate, proforma, note and claimed principal must not be added again where they incorporate the same work; a firm-stated amount is not the client’s admission of debt.

Objectives: protect assets and evidence; obtain the docket and item-by-item reconciliation; identify any transfer/beneficiary; and record decisions and implementation. The website does not replace filing, service or judicial decision. Dated historical blocks retain their context; this panel corrects earlier references to court processing not yet located.

PUBLIC UPDATE · 18 SEPTEMBER 2026 · STRATEGY DISCLOSURE AUTHORISED

ETJ 163/2020 moved forward. DP 748/2026 moved forward too — in the opposite direction.

On 16 September the criminal court put the subsidiary appeal in DP 748/2026 into active processing and gave the Public Prosecutor five days for submissions. On 17 September the civil enforcement judge refused Matkator's reconsideration application seeking suspension of ETJ 163/2020. The civil order was received on 18 September. This page publishes the result, the limits of what it decides, and the next protective steps that the client side has expressly authorised for public disclosure.

Boundary: no court has found Cuatrecasas, any judge, Acosta Matos-connected person or any prospective assignee guilty of an offence in these proceedings. The criminal allegations remain allegations. Equally, the 17 September civil order is not an acquittal, does not decide DP 748 and does not identify or immunise any future remate recipient.

COUNSEL HANDOFF STATUS · 18 SEPTEMBER 2026

The working response package has been delivered to counsel for review — it is not yet a filing record.

Public-safe status: a four-part urgent working package was delivered to current counsel on 18 September. It contains draft routes for an Article 215.2 complement request, contribution of the 17 September ETJ order to DP 748, an ETJ certification/traceability request, a separate Cuatrecasas preservation notice, and a 24-hour action note. The private binder, editable drafts, counsel advice and email content are not published.

Status rule: working draft → counsel review → signed filing/notice → presentation/service receipt → resulting court act are different evidential states. None of the proposed filings/notices is described here as filed or sent without primary proof.

Deadline control: the working note flags the five-day Article 215.2 LEC period. No final expiry date is calculated or published on this page; counsel must verify the complete notification record and legal computation.

VISUAL CONTROL · REAL HOTEL PHOTOGRAPH · BLOCK 5

One execution object. A potentially wider hotel-rights effect.

Sun Park explanatory visual using the real hotel photograph and highlighting Block 5 in connection with finca 8,584 and ETJ 163/2020. It also preserves the client-side continuity theory concerning other hotel fincas in the former Montelanza and Molina seller-minority perimeter, the 2008 Montelanza to Multimatrix transaction and a later alleged convergence with the Acosta Matos perimeter. The exact finca-to-physical-unit crosswalk remains under review.
One execution, wider hotel-rights questions. Finca 8,584 remains the immediate ETJ execution object and the client-side physical-placement position associates the affected Matkator units with Block 5. The visual also preserves the client-side continuity theory concerning other Sun Park hotel fincas in the former Montelanza / Molina seller-minority perimeter, the alleged incomplete or frustrated performance of the 2008 Montelanza → Multimatrix transaction and a later alleged convergence with the Acosta Matos perimeter. This is an explanatory allegation map, not a judicial finding. The repository contains conflicting historical/working finca↔apartment layers, so no apartment number or final Registry-to-physical crosswalk is certified; no completed cession, assignee identity or criminal liability is presented as proved. 17 Sep 2026

The 17 September order: precise effect

It decides

Article 569 suspension

The court rejects suspension and reasons that the Article 569 threshold is not met because the enforcement derives from a juicio cambiario.

It does not decide

DP 748 or criminal liability

It does not determine whether any offence occurred, does not decide the pending criminal appeal and does not declare the Cambiario/ETJ chain criminally lawful.

Still open

Adjudication and cession

No source presently published here identifies an adjudicatee, assignee, nominee or ultimate beneficiary, or proves completion of registration or possession.

Omitted subsidiary relief under review: the 26 June reconsideration application separately asked, if total suspension were refused, for suspension only of irreversible acts such as adjudication, registration, possession and disposal. The 17 September order contains no differentiated ruling on that subsidiary prayer. A working package has been delivered to counsel for urgent review of Article 215.2 LEC; no filing is asserted without primary proof.

DP 748/2026Place the 17 September civil order into the now-active subsidiary appeal as a supervening document; preserve the title-formation/service, later ETJ conduct, finca 8584 and remate/cession issues for finite investigation.16 September processing verified; Audiencia roll still unverified.

Public notice to any prospective remate recipient

No present source identifies an actual assignee. The client side nevertheless gives public notice of its legal position concerning any person considering receiving the remate or an economically equivalent position.

The proposition being preserved: a later judicially formalised transfer does not by itself rewrite the character of antecedent conduct if a competent criminal court later finds that conduct criminal. The third party's own legal position must be assessed separately by reference to title, consideration, knowledge, good or bad faith, Registry protection and restitution rules.
  • No third party is accused merely because it considers or receives an assignment.
  • The client side intends to identify and preserve the identity, instructions, consideration/payment, representation, beneficial-ownership and Registry/possession trail of any actual cession.
  • The client side will oppose any argument that the later appearance of a third party, by itself, retrospectively purges or validates antecedent conduct.
  • This web publication is not formal service and does not replace a burofax, court filing, Registry measure or other legally required notice.

Judicial accountability: what is being preserved

The client side disputes the 17 September reasoning. It is not publishing a present finding that the judge committed prevaricación merely by deciding adversely. It is instead creating a date-locked knowledge-and-decision record: what the judge had before her, the subsidiary relief requested, the 16 September criminal development, the 17 September ruling, any Article 215 response, and any later adjudication, cession, registration or possession act.

Accountability rule: if later facts meet the statutory thresholds for criminal, disciplinary or State-liability review, those questions belong to the competent institutions. The present purpose is preservation of knowledge, chronology, causation and personal authorship of later judicial acts — not a pre-judgment of guilt.
