FORMER COUNSEL · DEFENCE IMPACT · MONEY TRAIL · FISCALÍA / ICALPA

The lawyers who acted for us—and how the Insolvency Administrator affected the continuity and independence of our defence.

This is the dedicated A1–A8 register for Gil Marer, LPB, Aweswell and the related perimeter. It records the work performed, the Administrator act or dependency, the practical effect, the professional’s own response, and the strongest contrary evidence. Remaining professionals stay coded B1, B2, B3… until their mandate and publication basis are verified.

New Garrigues / La Laguna case file: Judgment 41/2014 in PO 344/2013 has been located and transcribed; it dismissed the €63,441.67 claim against Gil and Patricia in full. The page separates the €9,450 HAVAVIDA→Garrigues payment from Juan Tomás's €2,500 defence fee and marks the original claim and defence as outstanding. Open the complete case file →

Documented

Signed orders, the Administrator’s reports, fee documents, filings and contemporaneous communications are stated as records.

Gil/Patricia position

Motive, abuse, instrumentalisation, criminal purpose and causal effect are expressly attributed unless already adjudicated.

Open verification

Bank tracing, missing invoices, current Land Registry charges and disputed professional responsibility remain identified rather than silently assumed.

Article 215.2: the 19 February 2020 providencia granted the prior procedural licence required by Article 215.2 of the Criminal Code so that the Administrator could bring a criminal complaint against Gil, procurator Francisco Javier Pérez Almeida and lawyer Joaquín Ruiz de Infante over statements in the filed classification opposition. It did not decide truth, guilt or liability, and does not prove that a complaint was filed or upheld. The licence nevertheless created documented personal, insurance and withdrawal pressure around the central defence pleading.

UNITARY REDIGEST · 21 SEPTEMBER 2026 · CRITICAL EMAILS RE-READ

Gil’s thesis: the IA “poisoned” defence continuity — mechanism by mechanism.

“Poisoned” is Gil Marer’s forensic characterisation, not a judicial finding. The unitary reading does not say one act forced every lawyer out. It says something narrower and testable: at different times, different mechanisms affected mandate, independence, payment, personal exposure or access to an incoming team. Each mechanism keeps its own source, contrary evidence and open gap.

Non-transfer rule: direct interference with one mandate does not make every later professional relationship unlawful; payment does not prove bribery; a procedural permission does not establish an offence by the IA; a lawyer’s withdrawal does not prove the IA caused it. Any criminal thesis must be built act by act, knowledge by knowledge and effect by effect.

1 · Cristo — Bar threat + termination

In DP 1041/2017 Cristo had acted for LPB to obtain the assignment deed, price, payment date and costs. On 25-Jan-2018 the IA said he would report the matter to the Bar, terminated that LPB mandate, sought venia, required abstention, warned of judicial action and instructed the procurator not to file without his consent.

Secure effect: direct displacement of a defined mandate. Open: whether an actual Bar complaint followed and who caused the later withdrawal. Cristo continued wider project work and is treated here as valued former counsel and a potentially affected professional.

2 · Parrilla — money + intermediation + transition

On 28-May-2020 Parrilla wrote that he contemplated reporting €80,000 to the insolvency, receiving €25,000 immediately from the IA and leaving a further estate claim. In parallel he relayed the IA’s wish to speak with incoming counsel. Parrilla’s 31-May replacement was a client decision framed as mutual loss of confidence.

On 1-Jun Jiménez reported that the IA wanted “peace”, possible withdrawal of an action, said Parrilla and the procurator would be paid from insolvency funds and praised Parrilla’s work. A later IA report records €26,750 paid.

3 · “Bribe” / illicit inducement — Gil’s position

Gil contends that the combination of payment + payment assurance + “peace” + access to incoming counsel operated effectively as an illicit inducement or open “bribe” and drove a final wedge into an already deteriorating lawyer-client relationship. He also says the money came from liquidity generated by the later non-convalidated €400,000 sale.

Boundary: no decision finds bribery or corruption, and the precise €400,000-sale → €26,750 matching bank debit has not yet been independently recovered. Invoice, authority, IGIC, ledger and bank statements remain P0.

4 · Joaquín / Alas — personal criminal exposure

The IA sought the Article 215.2 Criminal Code licence over the central classification-defence pleading. The 19-Feb-2020 providencia opened the procedural gate for a potential complaint against Gil, the procurator and Joaquín. Urgent meetings, professional/insurance concern and ratification pressure followed.

Cristo then wrote that the initiative appeared intended to “FRIGHTEN” lawyers from denouncing again. That is his contemporaneous professional view. Joaquín withdrew seven months later citing lawyer-client breakdown and his court filing included apologies to the IA: contrary evidence that remains visible.

5 · Jiménez / SLJ — access to incoming counsel

The new engagement contemplated IA removal and IA/CAM claims. The written record contains a 28-May warning against off-record intermediation; Parrilla nevertheless relayed the contact request and Jiménez took the IA call on 1-Jun. On 5-Jun he also reported a CAM-lawyer request channelled through the IA to arrange contact.

Open: the record does not prove that CAM call occurred or that the IA contact caused Jiménez’s resignation. He challenged several IA positions and his resignation cited strategy, client direction and unpaid fees.

6 · Not every mandate fits the same model

Cuatrecasas performed favourable work and formally withdrew for unpaid fees; Luis Miguel López cited time/fees/non-payment; Garrigues predates the IA conduct examined here. Those differences block an automatic universal-push-out theory.

The common question that remains investigable: institutional continuity of the IA against successive owner-side teams dependent on authority, information, money, personal exposure and transition.

28 Nov 2018 → 24 Oct 201931 operational properties sold for €400,000; IA reported receipt, LPB Santander account and self-payment; convalidation was later refused. An estate-liquidity sequence generated by the transaction and later absence of convalidation. It does not alone close a predicate offence, later unwind or destination of every euro.
28 May 2020Parrilla contemplates an immediate €25,000 IA payment and later estate claim; Jiménez disputes the structure and calls for written reconciliation.IA economic intervention in the counsel-fee relationship was expressly on the table before transition. It does not prove the proposal was final, authorised or unlawful.
28–31 May 2020Parrilla channels the IA contact request; client prepares substitution for loss of confidence.Intermediation and breakdown of confidence are contemporaneous. It does not prove the IA alone caused substitution.
1 Jun 2020Jiménez reports “peace”, possible withdrawal, payment assurance for Parrilla/procurator and praise of Parrilla.Supports investigation of combined access, economic incentive and proposed de-escalation.It does not prove bribery, concert or criminal purpose.
11 Jun / later reportControlled written balance compared with later €26,750 payment recorded by IA.A material discrepancy requiring invoice, authority, tax and ledger reconciliation. It does not prove recipient criminal knowledge or the exact bank route from the €400,000.

Redigest result: Gil asks Fiscalía and the professional bodies to examine whether these different mechanisms, read together but attributed individually, constituted an unlawful strategy to weaken the defence. The documentary record warrants investigation of that hypothesis. It does not replace bank tracing, proof of intent or a competent determination.

Criminal-first hindsight analysis of the €400,000 sale

Gil Marer’s stated conclusion, with the benefit of hindsight, is categorical: he alleges that the sale was a crime and that its consideration became illicit proceeds of that alleged crime. That is the complainant’s prosecution thesis for Fiscalía to investigate—not a criminal judgment presently in the record.

The requested legal route is to investigate whether disposing of estate assets in this way, at this price and through this process caused estate prejudice and amounted to disloyal administration under Article 252; if a predicate offence and the money trail are proved, the disposition, recovery and any knowing downstream use must then be examined under the confiscation rules in Article 127 and Article 301. Gil alleges actual knowledge, or alternatively conscious avoidance, by Parrilla—not from receipt alone, but from the cumulative professional and transaction chronology set out below. The primary responsibility allegation remains directed at the Administrator who controlled the disposition and estate account, reported paying himself and authorised the later counsel payment.

Date Record Analytical consequence
28 Nov 2018 The Administrator conveyed 31 properties—reception, premises and pools/solarium—to Acosta Matos (CAM) for €400,000. The assets were operational choke points, not economically neutral leftovers. Gil’s position is that the hotel, as one operating business, loses its entire economic value without control of them.
20 Dec 2018 The Administrator told the court that the buyer’s cheque became effective, that an LPB Santander account had been opened for it and that he paid his own remuneration from the resulting liquidity. The receipt→estate account→Administrator self-payment route is established by his own report, subject to bank confirmation.
24 Oct 2019 The court held that the deed had been executed without judicial authorisation and refused convalidation. Non-convalidation is not itself a criminal finding or a complete conveyancing reversal, but it defeats any account that treats the original execution as judicially authorised.
May 2021 / 2022 The tender/authority and final transaction again used a separate €400,000 locales, pools and solarium branch. The affirmative reuse shows that the 2018 operational-control structure and price anchor persisted: the practical advantage was not first created by the 2022 adjudication.
Jul 2020 A later Administrator report records €26,750 paid to Juan Tomás Parrilla as LPB counsel fees. It must be reconciled against the client-funded fee history, invoice, authority, account debit and post-nonconvalidation estate ledger.

Who obtained the practical benefit alleged: Gil/Patricia say the Administrator, CAM and its downstream perimeter benefited from the loss or weakening of owner-side legal representation after the operational assets had been transferred. The Administrator’s benefit is not limited to receipt of fees: the allegation is that weakened defence reduced resistance to his asset and litigation decisions. This is an attributed causal allegation, not an adjudicated conspiracy.

The “golden trigger”: Gil uses this forensic and economic description for the 2018 transfer because no located controlled record completes refund, reconveyance, Registry cancellation, tax reversal and estate-ledger reconciliation after non-convalidation, while the later liquidation affirmatively reused the same €400,000 branch. It is not a legal term or judicial finding. Open the full valuation and persistence analysis →

ACTÚA was not a safe substitute for operational reality

The €489,361.96 plan figure for the 31-property branch came from the ACTÚA framework requested by CAM. The recovered ACTÚA materials say occupation was unknown, acknowledge that the valuer did not enter 100% of the complex, attribute the “at least 61” unrefurbished-unit figure to information supplied by others and apply a uniform 57.14% physical depreciation to the functional unit. Only three of its 13 photographs are clear apartment interiors and none is visibly tied to a finca, block or access provider. GESVALT’s contrary work treated the 262 properties as a single hotel operation and assessed approximately 44 apartments as poor while the remainder were usable.

Gil’s allegation is that ACTÚA was materially false or non-representative on multiple levels and that the Administrator either knew, or consciously disregarded obvious reasons to know, that it could not safely support this disposal. Gil characterises the latter possibility as wilful and criminal recklessness. The present record proves the methodological warnings and the existence of contrary professional material; knowledge, deliberate disregard, the applicable offence elements and criminal purpose are matters for investigation.

The reception/main entrance and access, premises, pools and solarium are functionally central to the hotel. GESVALT’s unitary approach supports examination of hotel-wide loss when those components were separated. It does not mean that the legal standalone value of the 31 fincas automatically equals GESVALT’s €26.4 million whole-hotel valuation. Open the ACTÚA–GESVALT comparison and source PDFs → · Open the ACTÚA photograph/access test →

Cajasiete verification lane: Gil states that, immediately after acquiring the premises for €400,000, CAM raised approximately €1 million from Cajasiete against them. The current production has not recovered the mortgage deed or a current certified Registry entry proving lender, amount, date and charged fincas. The statement is therefore published as Gil’s direct allegation and a priority document request—not yet as a closed public fact.

The alleged over-the-line intervention in the lawyer–client relationship

Record Amount / position Why it matters
Original 2012 proforma €40,000 + IGIC for the insolvency petition and handling. Baseline agreed fee requiring invoice-by-invoice reconciliation.
Parrilla’s 11 June 2020 account He acknowledged €32,250 already received from Gil/Patricia-perimeter companies and unilaterally proposed a final fee of €50,000, leaving €17,750 + IGIC. It confirms substantial client-side payment and identifies his own proposed outstanding balance.
Client instruction Gil/Patricia rejected the proposed rebase and arrangement and instructed that negotiations end in favour of the intended procedural challenge. The later estate payment cannot be explained as an accepted client variation without further authority.
Administrator payment €25,000 + 7% IGIC = €26,750. Even against Parrilla’s unaccepted €50,000 proposal, the base payment exceeds his stated €17,750 base balance by €9,000. The exact recoverable excess depends on the missing invoice, tax treatment, costs allocation and ledger.

The allegation is not centred on arithmetic. Even if a professional fee remained due, Gil/Patricia say the Administrator crossed the line by entering the lawyer–client fee relationship while controlling disputed estate liquidity, linking a payment assurance and a purported “peace” to the Parrilla→Jiménez transition, and benefiting—together with CAM’s downstream perimeter—from reduced resistance to his decisions. Aweswell’s client-side funding, Parrilla’s written account and the later estate payment remain important because they identify the relationship, route and timing that Fiscalía and ICALPA should test.

The Administrator’s reports disclose the €400,000 account/liquidity sequence, his self-payment and the later Parrilla payment. Gil directly confirms that the sale money was the only source then available and therefore alleges that the €26,750 was a downstream application of illicit proceeds of the alleged sale offence. A matching bank debit has not yet been recovered, so the exact €400,000→€26,750 trace remains a combination of the Administrator’s disclosed sequence and Gil’s testimony rather than an independently completed bank trace. That distinction does not erase the payment mismatch; it defines the document Fiscalía should obtain.

Knowledge allegation: Gil alleges that Parrilla actually knew, or consciously avoided knowing, that he was receiving money derived from the alleged unlawful sale and that the payment formed part of the Administrator’s strategic intervention. He is not pleaded as a chance recipient: the basis is cumulative—specialist insolvency mandate; formal warnings and instruction conflicts in 2016–2017; the 2018 sale challenge; the 2019 non-convalidation; his fee record; and the 2020 “peace”/payment-assurance handover—not receipt alone. Specialisation does not establish mens rea by itself, but “he merely received it” does not answer the pleaded direct exposure. No criminal judgment presently establishes knowledge, participation or an Article 301 offence; invoice, authority, account debit, disclosure and restitution remain compulsory production.

DateClient instruction / interestLocated response and practical effect
12–13 Jul 2016Review, adapt, sign and send an urgent burofax to the Administrator alleging excess passive debt and fraud through the Community organ, demanding correction and criminal action.Parrilla refused to evaluate the draft because it was not his, said he alone would direct the LPB concurso or other counsel should do so, and did not send it through counsel. Patricia replied that the draft was support, not an attempt to replace his direction.
5–6 Jun 2017Ask Parrilla/the Administrator to send a formal burofax over new Community debts and seek postponement of the creditors' meeting.Parrilla said Gil should send the burofax himself, not the Administrator, and predicted the court would not stay the meeting. He also informed the Administrator, and the later chain records authority for Gil to attend for LPB; that contrary action is preserved.
28 May 2018Coordinate urgently with the forensic adviser on a quantified Community/mortgage response needed for the funded exit.Parrilla refused the call/teamwork, told the adviser to stay out and placed his resignation at the client’s disposal. Later clarification and filing work are retained as contrary context.
8 Jun 2018Send a written demand to the Administrator for the Community meeting notice, agenda, attendance and minutes after Parrilla had first telephoned him and relayed CAM’s explanation.Parrilla declined the formal route on standing, offered only an informal request and then said the material would not be obtained from the Administrator and should be sought through another owner.
25–29 Oct 2018Respond to concerns about CAM’s offer, ACTÚA contradictions, lack of maintenance, Administrator self-fees, security and reputational conduct.Parrilla said he saw nothing relevant, accepted several Administrator/CAM positions and considered that the identified points required no answer.
12–16 Dec 2019Advance a detailed Community-fraud evidence/audit route.Parrilla said there was then nothing to answer, that the concurso judge would not stop or audit the Community, and that fraud belonged in the criminal route.
28 Feb 2020Challenge or respond to the Article 215.2 licence.Parrilla said the procedure was correct and “I am not going to appeal anything”, treating it as a procedural step.
May–Jun 2020Do not intermediate, speak to or carry information to the Administrator or Acosta Matos during the counsel transition; pursue claims first.Parrilla conveyed the Administrator’s request to incoming lawyer Daniel Jiménez. Jiménez’s 1 June call report then combined “peace”, possible complaint withdrawal, payment assurance for Parrilla/procurator, praise of Parrilla and Administrator/CAM positions.

Instructions with no recovered response, not refusals: the preserved exports contain requests dated 25 May, 27 June and 22 August 2017 without an included Parrilla reply. They are recorded as response gaps, not proof that he refused or did no work.

Contrary record: the scan also preserves communications to the Administrator in 2015, authorisation requests in 2016, enforcement/exit and convenio work in 2016–2017, and the June 2017 notice/attendance-authorisation step. That prevents treating every disagreement as inaction and confines the finding to the specific refusals in the table.

Gil relies on this sequence as evidence of repeated divergence between client instructions and the route more convenient to the Administrator/CAM position. Professional justification, standing advice and later contrary work remain part of the record; motive and coordinated intent remain allegations for investigation.

A1–A8: former lawyers and firms

Ref. Lawyer / firm Work and documented effect of the Administrator Complete context
A1 Juan Tomás Parrilla Suárez
Juan Tomás Parrilla practice / jtparrilla.com
LPB insolvency counsel for several years. Parrilla relayed the Administrator’s request to speak to incoming counsel despite the client’s recorded anti-intermediation instruction. The 1 June 2020 call report joined “peace”, possible withdrawal of action, assurance of payment to Parrilla/procurator, praise of Parrilla and IA/CAM positions; the later €26,750 payment presents the mismatch above. The client initiated substitution after loss of trust. Gil alleges actual knowledge or conscious avoidance of the alleged criminal origin and strategic use of the payment on the cumulative record above. It is a supported complainant allegation, not an adjudicated fact.
A2a–A2c Armando Betancor Álamo
José María Betancor Álamo
Davinia Sánchez de la Cruz
Alas Legal Advisors, S.L. (then); later professional continuity for part of the team at Kepler–Karst
José María/Alas drafted and transmitted the final filed Gil opposition with client edits; Armando and Davinia appear in the working chain. The Article 215.2 initiative over that filing produced urgent reputation/insurance concern, a proposed ratification and withdrawal pressure. The team withdrew on 21 September 2020. Gil/Patricia say the initiative was abusive and materially contributed. The notices also cited irreparable lawyer-client breakdown, including direct conflict over the ratification, trust and fees.
A3 Joaquín Ruiz de Infante Abella
Bufete Ruiz de Infante
Signing/directing lawyer for the filed classification opposition, working with Alas. The 19 February 2020 licence placed him, Gil and procurator Francisco Javier Pérez Almeida at potential personal criminal exposure. He withdrew on 21 September 2020. The order opened a complaint gate; it did not decide an offence or prove that a complaint was filed or succeeded. The defence effect is documented; exclusive withdrawal causation is not.
A4 Daniel Jiménez García
SLJ Abogados
The bilingual engagement accepted 22 May 2020 contemplated direct Aweswell instructions, Administrator removal and AC/CAM claims. Despite the client’s stated pre-engagement no-contact condition and contemporaneous claims-first/no-information instructions, Jiménez took the 1 June Administrator call. He became hostile in the client’s account and resigned 23 June before any verified signed procedural filing. Jiménez disclosed and resisted some IA positions; his notice cited strategy, client control and unpaid fees. Later SLJ filed a 179-page inventory identifying the 4,458-document client file plus selected material in its fee proceeding—not all underlying files. Necessity, secrecy and actual adverse-party access remain open.
A5 Luis Miguel López
López Castelo Abogados
LPB counsel after Parrilla; nullity, classification, appeals and amparo. He gave withdrawal notices in 2021 and 2025 while the Administrator controlled LPB payments. Time, fees and non-payment are documented. Each request/refusal still requires audit before attributing a specific withdrawal to the Administrator.
A6 Cuatrecasas
Rosa Gual Tomás; Iñigo de Luisa Maíz; Adriana González García; Pedro Campaña Ávila
Billed Aweswell for a broad 2018–19 finance/insolvency programme, lender comfort, security, exit, IA-facing work and Aweswell standing. It obtained favourable 2019 rulings. Gil/Patricia allege that IA conduct affected the firm’s ability or willingness to deploy the protective shield they understood had been retained. Entity/authority limits and favourable work remain visible. The May 2020 withdrawal cited more than two years of unpaid fees. That reason is material, but does not by itself resolve the earlier protection and IA-effect inquiry; no negligence finding is asserted.
A7 Garrigues
Miguel Méndez; José María Martínez de Artola; Zulay Carmen Rodríguez
2012 Bankia enforcement, interim relief, Community issues and urgent insolvency-petition work. The work predates the relevant Administrator conduct. No Administrator-caused exit is presently alleged.
A8 Cristo Ayose Suárez Pimentel
Tenerife-based independent lawyer / Pimentel Servicios Legales
Worked from May 2016 to June 2022. On 25 January 2018 the Administrator terminated a defined LPB mandate, demanded venia/abstention, imposed an authorisation gate and warned of Bar recourse. That representation was interrupted. This direct effect is not extrapolated to every mandate; Cristo continued other work and later described the Joaquín initiative as apparently intended to frighten.

Other professionals: B1, B2, B3… remain anonymised pending verified mandate, dates and a specific client decision to name. Formal institutional call. Gil Marer calls upon the Spanish Prosecution Service (Fiscalía) and the Las Palmas Bar Association (ICALPA) to preserve and obtain the bank, estate, invoice, court-access, engagement and withdrawal records; investigate the alleged criminal sale and proceeds route; and assess whether the Administrator’s actions, payment decisions and threats materially impaired the right of defence. This call is an allegation and request for investigation, not a declaration of guilt.

CANONICAL INSTITUTIONAL FRAMEWORK · 22 SEPTEMBER 2026

Institutional pressure, interference with independent relationships, strategic isolation and professional/commercial attrition.

This is the institutional formulation replacing character labels such as “thug”, “bully” or “mob-like”. It is Gil Marer’s attributed investigative hypothesis, not a judicial finding. The testable question is whether different mechanisms recur when lawyers, advisers, operators, funders or other independent third parties challenge, scrutinise or may limit decisions or positions of the Insolvency Administrator.

Causation rule: lawyer departure ≠ IA causation; payment ≠ bribery; contact ≠ improper influence; procedural permission ≠ wrongdoing; later judicial finding of a structural effect ≠ retroactive proof of intent. Every inferential step requires its own source.

Four rings that must not be collapsed

1 · Legal representation

Lawyers and firms acting for Gil, LPB, AWESWELL LIMITED or related entities. Cristo, Parrilla, Joaquín/Alas, Jiménez/SLJ and other mandates remain individually analysed.

2 · Procedural and professional support

Procurators, experts, accountants, valuers, investigators and other professionals. A professional relationship does not transfer knowledge, intent or responsibility.

3 · Commercial and operating partners

Operators, transaction advisers, collaborators and third parties capable of sustaining an alternative operating, sale, restructuring or preservation route.

4 · Capital and investment

Lenders, investors and capital intermediaries. A refusal, withdrawal or finance condition requires its own documented cause and is not automatically attributed to the IA.

Beyond lawyers. The ONA/Clubotel record permits the framework to be tested across the commercial ecosystem: contemporaneous warnings record the expected harm of separating operating elements to the funded-exit and third-party competition, followed by a later judicial structural finding concerning unitary sale. That can corroborate a structural effect; it does not decide criminal intent, concert or certainty that the alternative transaction would have closed. Open ONA chain → · Open JTP payment / prosecutorial bridge →

Mandatory contrary evidence. Cuatrecasas has a materially different history including favourable work and unpaid fees; Luis Miguel López cited time/fees/non-payment; Garrigues predates the principal period examined; Joaquín withdrew, cited lawyer-client breakdown and apologised to the IA; Jiménez had independent strategy, client-direction and unpaid-fee reasons. Those facts are not removed: they are controls against an artificial universal-push-out theory.

The analysis no longer ends at A1–A8: it covers the complete professional register.

The controlled genealogy starts with Garrigues, the first verified firm in the current 2012+ perimeter, and continues through parallel and successive insolvency, litigation, finance, classification, criminal, forensic-review and current mandates. The binding universe is the complete professionals register; absence from the A1–A8 table does not remove a professional from analysis.

Each professional, client, matter and period receives a separate interaction envelope. The Truth Machine compares instructions, work actually done, filings, fees, access/information, IA or relevant adverse-party contacts, formal transition reason, contrary evidence and the strongest lawful explanation. The number of lawyer changes is not itself evidence of causation.
