# AC professional isolation and attrition — canonical evidential record

**Canonical ID:** PD-AC-PIA-20260922-01
**Adopted:** 22 September 2026
**Scope:** Concurso 36/2012 · Administrador Concursal · former lawyers · procedural representatives · professional advisers · commercial/operating partners · financing/investment counterparties
**Public status:** analytical framework and attributed allegation; not an adjudicated finding of wrongdoing.

## Canonical formulation

Gil Marer alleges a sustained course of conduct involving **institutional pressure, interference with independent professional relationships, economic and informational leverage, strategic isolation, and professional/commercial attrition** around persons and organisations advising, representing, financing, operating with, or otherwise supporting Gil Marer, Luchy Playa Blanca, S.L.U. (LPB), AWESWELL LIMITED and the wider Sun Park perimeter.

The allegation is not based on personality, tone or ordinary professional disagreement. The testable question is whether different mechanisms repeatedly appeared at points where independent professionals or commercial counterparties were challenging, scrutinising or potentially limiting decisions or positions of the Administrador Concursal (AC).

This formulation replaces non-institutional shorthand such as “thug”, “bully” or “mob-like” in repository and public drafting. Source quotations or an expressly attributed speaker may retain such wording only when evidentially necessary.

## Canonical mechanism taxonomy

1. **Direct mandate displacement** — termination, venia, abstention demands, filing restrictions or other acts affecting an existing professional mandate.
2. **Professional or regulatory escalation** — Bar, disciplinary, judicial, criminal, insurance or reputational exposure connected with the professional’s work.
3. **Economic leverage** — control, recognition, timing or proposed payment of professional fees or other estate-funded economics capable of affecting incentives.
4. **Intermediation and access** — obtaining access to incoming advisers through outgoing advisers or other intermediaries, particularly where the new mandate concerns scrutiny of the AC or connected actors.
5. **Information and control asymmetry** — differential access to documents, estate information, operational access, funds or decision channels.
6. **Relationship disruption** — acts or circumstances capable of weakening trust, continuity, independence or willingness to continue acting.
7. **Alternative-pathway impairment** — acts or omissions alleged objectively to impair an independent legal, commercial, operating, financing, restructuring or exit route.
8. **Cumulative isolation / attrition** — the possible aggregate effect of otherwise distinct mechanisms over time.

No event is promoted from one mechanism to another without its own source and causal analysis.

## Four analytical rings

- **Ring 1 — Legal representation:** lawyers and law firms acting for Gil, LPB, AWESWELL LIMITED or related entities.
- **Ring 2 — Procedural and professional support:** procuradores, experts, accountants, valuers, investigators and other advisers.
- **Ring 3 — Commercial and operating partners:** operators, prospective operators, transaction advisers and collaborators.
- **Ring 4 — Capital and investment counterparties:** lenders, investors, financing intermediaries and restructuring/exit counterparties.

Presence in a ring does not imply victim status, adverse status, complicity or common purpose. Each actor remains individually attributable.

## Contemporaneous anchor events

### Cristo Suárez Pimentel — 25 January 2018
The controlled record documents an AC communication stating an intention to report the matter to the Bar, terminating Cristo’s LPB professional relationship, seeking venia, requiring abstention, warning of judicial action and instructing the procurador not to file further work without the AC’s express consent.

**What this establishes:** direct displacement of a defined mandate and use of institutional/professional escalation.
**What remains open:** the legal scope and justification of the AC’s authority in liquidation, whether a Bar complaint was actually made, and later causal consequences.
**Non-transfer rule:** Cristo continued work elsewhere in the wider Sun Park perimeter; termination of one LPB mandate is not total project withdrawal.

### Juan Tomás Parrilla Suárez — May–June 2020
Contemporaneous material records discussions concerning recognition of substantial legal fees as estate claims, proposed immediate payment, and a transition in which Parrilla relayed the AC’s wish to speak with incoming counsel. Later accounting/report material records a payment requiring invoice, tax, authority and ledger reconciliation.

**What this establishes:** AC economic involvement and intermediation were contemporaneous with a deteriorating lawyer-client relationship and change of counsel.
**What it does not establish:** bribery, corrupt inducement, criminal knowledge by a recipient, or sole causation of the transition.

### Joaquín Ruiz de Infante / Alas team — February–September 2020
The Article 215.2 CP sequence placed Gil, the procurador and the signing lawyer within the potential ambit of a criminal complaint arising from the central calificación defence pleading. Contemporary material records urgent professional/insurance concern and pressure surrounding ratification. Cristo contemporaneously characterised the effect as an attempt to “DAR MIEDO”; that remains his attributed assessment.

**Contrary evidence:** Joaquín later withdrew, cited breakdown of the lawyer-client relationship, and apologised to the AC for imputations of dishonesty. Those facts remain visible and are not diluted.

### Daniel Jiménez / SLJ — incoming-counsel access
The new mandate contemplated scrutiny of the AC and possible AC/CAM action. The record documents a request for contact relayed through outgoing counsel and subsequent contact with the incoming lawyer, plus a later CAM-lawyer contact request channelled through the AC.

**What remains open:** whether any later CAM call occurred, what was communicated, and whether any contact caused the later resignation. Jiménez contradicted several AC positions and his resignation also cited strategy, client direction and unpaid fees.

### ONA / Clubotel and the funded-exit ecosystem — 2018–2019
The wider record supports testing the same mechanism outside lawyer turnover. Contemporary material records warnings that separating operational elements would damage both debt-payment/exit and future competitive sale routes. The later 24 October 2019 order is treated as independent structural corroboration that the sale should have been unitary and that excluding operating installations impaired realistic third-party improvements.

**Boundary:** later judicial structural corroboration does not itself prove the AC’s earlier intent, concert, criminal purpose or counterfactual certainty that a funded exit would have closed.

## Mandatory contrary / limiting evidence

Any use of this framework must preserve, at minimum:

- Cuatrecasas performed material favourable work and has a distinct documented withdrawal history including unpaid fees.
- Luis Miguel López has a distinct documented explanation involving time, fees and/or non-payment.
- Garrigues predates the principal AC conduct examined by this module.
- Joaquín’s 21 September 2020 withdrawal and apologies to the AC remain adverse/contrary evidence.
- Jiménez’s later withdrawal has independent stated explanations and is not attributed automatically to AC contact.
- Payment does not prove bribery; contact does not prove improper influence; withdrawal does not prove causation; a procedural licence does not prove wrongdoing by the AC.
- Different events can share a mechanism without sharing motive, legality, knowledge, purpose or criminal significance.

## Required event fields

Every future proposition relying on this module must identify:

**actor · historical capacity · date/period · source/proposition reference · act/omission · mechanism · practical effect · Gil/Patricia allegation (if any) · claimed purpose (if any) · contrary evidence · lawful/innocent alternative · causation status · knowledge/intent status · unresolved proof · competent forum/relevance.**

Chronology, association, professional relationship, family relationship, payment, benefit or later outcome do not transfer responsibility.

## Canonical institutional language

Preferred formulation:

> A recurring pattern of institutional pressure, interference with independent professional relationships, strategic isolation and professional/commercial attrition, to be tested actor by actor and event by event.

For prosecutorial/regulatory analysis, ask whether the record demonstrates repeated use of authority, professional exposure, economic or informational leverage, access through advisers, relationship disruption or impairment of alternative professional/commercial routes. Do not replace that test with character labels.

## Continuity rule

Future work must extend this record additively. Do not create a competing “bullying”, “mob-like”, “lawyer casualties” or universal-push-out theory. Those may remain search terms or attributed shorthand, but the canonical analytical framework is **professional isolation and attrition / aislamiento estratégico y desgaste profesional y comercial**, governed by the actor-specific and contrary-evidence rules above.

## Full 2012+ legal-professional genealogy and Truth Machine integration
The controlling legal-professional universe is every record in `assets/data/legal-professionals-register-v1.json`, beginning with **Garrigues as the first verified firm in the current 2012+ genealogy** and continuing through verified parallel, successor, specialist, historic-review and current roles. The open 2011 predecessor question remains a source gap.

Every lawyer, law firm and procurador interaction—inside or outside Concurso 36/2012—must pass `governance/LEGAL_PROFESSIONAL_INTERACTION_TRUTH_MACHINE_22SEP2026.md` and `assets/data/legal-professional-interaction-truth-machine-v1.json`.

The analytical key is **professional × client × matter × period**. The number of lawyer changes is prohibited as a causation shortcut. Garrigues remains in the genealogy despite the absence of a presently identified AC causal link; current counsel remain for continuity without being drawn retrospectively into a former-counsel attrition thesis.

## Parent AC claim family

This framework is the professional-interference branch **`AC-CLM-011`** of the broader actor-specific control `PD-AC-CLAIMS-R33-20260922-01`. When the same evidence also bears on remuneration, procedural access, ONA/Clubotel, final estate reconciliation or R33, link the relevant additional `AC-CLM-*` family rather than expanding `AC-CLM-011` beyond its professional-interference scope.
