# AC / defence-continuity unitary redigest — 21 September 2026

**Control ID:** PD-AC-COUNSEL-20260921-01
**Status:** source-controlled prosecutorial / professional-continuity redigest
**Scope:** Cristo Ayose Suárez Pimentel; Juan Tomás Parrilla Suárez; Joaquín Ruiz de Infante Abella / Alas team; Daniel Jiménez García / SLJ; wider A1–A8 counsel continuity.
**Public surfaces:** `/es/continuidad-defensa-letrados/`, `/en/counsel-defence-continuity/`, and the bilingual actor register.
**Machine sidecar:** `assets/data/ac-counsel-interference-unitary-v1.json`.

## Controlling proposition

Gil Marer uses the phrase **“the Administrador Concursal poisoned it all”** as a shorthand for his criminal/prosecutorial thesis that repeated acts by the Insolvency Administrator progressively damaged the independence, continuity and effectiveness of owner-side legal representation.

That is an **attributed investigative thesis, not an adjudicated finding**. The record does not support rewriting every lawyer transition as one common cause. Instead, the evidence shows different mechanisms, strengths and contrary explanations which must remain separate.

## Source position

This redigest does not replace the prior complete-corpus controls. The 24-Aug-2026 Juan Tomás Parrilla mastery audit records a finite direct-mail set of 1,094 unique messages, 1,092 body-readable, plus 429 unique Drive documents, with 98.6% connected-text operational mastery across the controlled universe. The present 21-Sep-2026 pass re-read the critical transition communications and reconciled them against the public GitLab Pages comparator and current GitHub controls.

## Actor-by-actor mechanism map

### 1. Cristo Ayose Suárez Pimentel — direct mandate displacement / Bar threat

**Documented:** Cristo acted for LPB and on 12-Dec-2017 initiated DP 1041/2017 seeking the full CAM privileged-credit assignment deed, price, payment date and costs. The application was admitted and production was listed. On 25-Jan-2018 the Administrator told Cristo he would report the matter to the Bar “for the corresponding purposes”, terminated the specific LPB professional relationship, requested venia, ordered him to stop acting for LPB, warned of judicial action and instructed the procurator not to lodge filings without the Administrator’s express consent.

**Later source:** on 4-Feb-2023 Cristo himself forwarded that email as the one concerning the Bar complaint and the other threats.

**Boundary:** no voluntary resignation is located for that defined mandate. Cristo continued substantial work in the wider Sun Park perimeter afterwards. An actual Tenerife Bar complaint or disciplinary file remains unverified; the 21-Aug and 25-Aug-2026 ICATF communications asked for certification and traceability.

**Client position:** Cristo is a valued former lawyer and potentially affected professional, not an adverse subject. The current objective is restorative: recover the institutional trace, preserve his work and allow correction of any record that unjustifiably affected him.

### 2. Juan Tomás Parrilla Suárez — fee/payment/intermediation during a client-initiated transition

**Documented asset track:** Protocol 2150 records a 28-Nov-2018 transfer of 31 operational fincas to CAM for €400,000. The Administrator’s 20-Dec-2018 report says the cheque became effective, an LPB Santander account was opened and the Administrator paid its own remuneration from that liquidity. The 24-Oct-2019 court order later refused convalidation because the deed had been executed without judicial authorisation. The complete refund / reconveyance / Registry / tax / ledger unwind remains open.

**Documented 28-May-2020 fee proposal / conditional client-side exchange:** Parrilla proposed communicating €80,000 + IGIC to the concurso, with an immediate €25,000 payment and further estate recognition. The client-side reply asked whether this was the same concurso-cost recovery already being discussed, requested the AC–counsel communications and raised the risk of immediate resignation. Under the controlling 24-Sep correction it is not treated as consent, waiver, ratification, fee allocation or validation.

**Documented final rejection — 12-Jun-2020:** Parrilla's 11-Jun final proposal stated €50,000 + IGIC, €32,250 previously received and a claimed €17,750 + IGIC balance. Jiménez forwarded it stating that he had said it could not be accepted. Patricia replied that the client side agreed, regarded it as unacceptable, ended the discussions and directed the team toward the insolvency incident. That is direct documentary rejection.

**Unitary / domino bridge — anti-fragmentation control:** the fee episode is downstream, not the origin. The 29–30-May-2018 correspondence records ONA bringing Stoneweg into Cuatrecasas to advance the transaction, discuss DD/term-sheet work and coordinate the concurso-facing document; the 7-Jun-2018 correspondence records the asserted CAM/Community taking of possession and immediate complaints/evidence preservation; the 12-Jun-2020 correspondence records rejection of the final Parrilla proposal. Gil's thesis is that these belong to one causal history of resistance to the alleged impairment of the ONA-led funded exit and its defence. That is an attributed unitary inference. The 12-Jun email proves rejection of the fee proposal; it does not by itself prove sabotage, common intent, criminality or every upstream causal link. Future work must resist both fragmentation and causal overreach.

**Documented transition:** on 31-May-2020 the replacement communication was framed as a client decision after a mutual loss of confidence. This remains important contrary evidence: the Administrator did not formally dismiss Parrilla.

**Documented intermediation / “peace” sequence:** on 28-May incoming counsel recorded that Parrilla had conveyed the Administrator’s wish to speak to him and a possible withdrawal of the announced complaint. On 1-Jun Jiménez reported his call with the Administrator: a wish for “peace”, possible withdrawal of the complaint, assurance that Parrilla and the procurator would be paid from concurso funds, and praise for Parrilla’s work. The same call transmitted substantive IA/CAM positions.

**Later fee evidence:** the controlled 11-Jun written account records €32,250 received, a rejected proposal for a €50,000 final fee and a stated €17,750 + IGIC balance. A later Administrator report records €25,000 + 7% IGIC (€26,750) paid to Parrilla.

**Client criminal allegation:** Gil characterises the combination as an **illicit inducement / effectively an “open bribe” and a final wedge in an already deteriorated lawyer-client relationship**, and alleges that the money came from the proceeds of the non-convalidated €400,000 transaction because that was then the only available liquidity. This is a prosecutorial allegation for investigation, not a finding of bribery, corruption, criminal proceeds, collusion or Parrilla’s criminal knowledge.

**Critical proof boundary:** the Administrator’s reports disclose the receipt/account/self-payment sequence and the later Parrilla payment, but the exact matching bank debit €400,000-sale → €26,750 has not been independently recovered. Invoice, authority, IGIC/cost allocation, full estate ledger and bank statements remain P0 evidence.

### 3. Joaquín Ruiz de Infante Abella / Alas working team — personal criminal-exposure route around the defence pleading

**Documented:** Joaquín signed the central classification opposition prepared in coordination with the Alas team. The Administrator’s 5-Feb-2020 motion sought the Article 215.2 Criminal Code licence concerning statements in that defence. The 19-Feb providencia granted the procedural permission so that a complaint could be brought against Gil, procurator Francisco Javier Pérez Almeida and Joaquín.

**Immediate effect:** urgent lawyer-team communications followed. On 27-Feb Cristo’s contemporaneous professional reaction was that the initiative appeared intended to frighten the lawyers from continuing to denounce. That is Cristo’s opinion, not a court finding.

**Later transition:** Joaquín gave irrevocable notice of withdrawal on 21-Sep-2020 citing an irreparable lawyer-client breakdown. The court filing also contained apologies to the Administrator and withdrawal of subjective dishonesty characterisations. This is material adverse/counterevidence and remains visible.

**Boundary:** the Article 215.2 providencia was a procedural gate, not a finding that calumny, insult or falsity occurred, and does not by itself prove that the contemplated complaint was filed, admitted or succeeded. The seven-month gap and the separate lawyer-client conflict prevent an exclusive-causation conclusion. Gil/Patricia nevertheless allege that the Administrator’s initiative materially poisoned the defence environment by converting the content of the defence pleading into personal criminal exposure for the client, procurator and signing lawyer.

### 4. Daniel Jiménez García / SLJ — access to incoming counsel

**Documented:** SLJ’s engagement was accepted 22-May-2020 for direct Aweswell instructions, possible Administrator removal and assessment of AC/CAM claims. The written record documents a 28-May warning against off-record JT/AC intermediation. Parrilla conveyed the Administrator’s contact request; Jiménez took the 1-Jun call described above. On 5-Jun Jiménez reported that CAM’s lawyer had asked the Administrator to arrange contact; a call was proposed, but the located record does not prove that the CAM call occurred.

**Contrary evidence:** Jiménez challenged several Administrator positions, disclosed communications to the client and expressly said he was not conditionable. His 23-Jun resignation cited strategy, client direction and unpaid fees, not the Administrator.

**Client inference:** the sequence supports investigation of attempted influence over incoming counsel during the transition. It does not prove unlawful intent, collusion or that the contact caused resignation.

### 5. Cuatrecasas, Luis Miguel López and Garrigues — differentiated controls

- **Cuatrecasas:** Administrator positions materially intersected standing, sale/Registry, information and funded-exit work. The firm also produced favourable work and later withdrew citing more than two years of unpaid fees. No single-cause AC exit finding.
- **Luis Miguel López:** succeeded Parrilla and later cited time/fees/non-payment in withdrawal communications. Because LPB payments were Administrator-controlled in liquidation, each fee request/response remains auditable; no specific causative refusal is presently established.
- **Garrigues:** relevant early work predates the Administrator conduct examined here. No current source establishes AC-caused departure.

## Unitary pattern — and its limit

The evidence supports a **recurrent-pressure / continuity-interference hypothesis**, not a universal “every lawyer was forced out” conclusion:

1. direct mandate termination and Bar threat (Cristo);
2. client-lawyer fee/payment and intermediation during a loss-of-trust transition (Parrilla);
3. potential personal criminal exposure linked to the central defence pleading (Joaquín / procurator / Alas environment);
4. contact and “peace” access to incoming counsel before protective actions were complete (Jiménez);
5. Administrator-controlled dependencies affecting standing, information, money and implementation across later mandates.

The mechanisms can be connected for prosecutorial examination because they occur in the same Concurso and around the same estate/control conflict. **Responsibility, intent and causation do not transfer from one episode or professional to another.**

## GitLab comparator reconciliation

The public GitLab Pages actor register was re-scanned on 21-Sep-2026. Its A1–A4 propositions concerning Parrilla, Joaquín/Alas and Jiménez are materially present on GitHub already. This redigest therefore does not blindly copy the GitLab page. It imports the useful one-by-one presentation and reconciles it with the stronger GitHub source controls, the 21-Sep mailbox re-read and the Cristo restorative correction.

GitHub remains the active canonical intelligence/publication layer while the GitLab repository is unavailable; public GitLab Pages is a comparator only.

## P0 evidence still required

1. Full LPB Santander statements from receipt of the €400,000 cheque through the Parrilla payment.
2. Purchaser debit / LPB credit / Administrator remuneration debits / €26,750 Parrilla debit.
3. Parrilla invoice(s), IGIC, costs allocation, payment authority and complete estate ledger.
4. Complete implementation trail after the 24-Oct-2019 refusal of convalidation: refund, reconveyance, Registry and tax treatment.
5. Complete Article 215.2 / complaint docket concerning Joaquín, Gil and the procurator.
6. ICATF certification of whether the 25-Jan-2018 threat concerning Cristo became an actual complaint/file.
7. Proceeding-by-proceeding venia, power and withdrawal records for every A1–A8 professional.

## Publication lock

Do not publish as established fact that:
- Parrilla was bribed;
- the €26,750 is bank-proved to derive from the €400,000 sale;
- Parrilla knew he was receiving criminal proceeds;
- the Article 215.2 route was itself unlawful;
- the Administrator caused every counsel withdrawal;
- Joaquín’s apology proves every underlying factual allegation false.

The public-safe formulation is that **Gil alleges a criminal pattern of interference with defence continuity and characterises the Parrilla payment/“peace” sequence as an illicit inducement or bribe-like intervention; the documentary record materially supports investigation of that thesis while leaving the decisive bank, authority, intent and causation gates open.**
