A current matter
ORD 1859/2023-9 remains pending. Aweswell states that economic and patrimonial harm continues. That is the affected party's position, not a judicial finding.
Updated 30 September 2026 · first-click documentary explanation
The recovered record places Uría in four distinct, dated lanes connected to the wider LPB / Sun Park matter: 2015 creditor-enforcement communications, a 2017 Promontoria Holding 122 B.V. court filing, the 2019–2021 RICPE advisory/project-processing lane, and CaixaBank's 2024 Valencia defence. A separate current-contact control now records who is being put on notice in September 2026 without converting a firm contact into a court appearance.
Explanation first
The purpose is to give a professional reader a complete first-click explanation while remaining open to correction by primary record.
ORD 1859/2023-9 remains pending. Aweswell states that economic and patrimonial harm continues. That is the affected party's position, not a judicial finding.
Aweswell Limited is the UK holding company at the head of the relevant investment perimeter in Spain. Separately from his direct economic interest, Gil Marer states that since at least 2021 he has acted and continues to act as a reporting person / whistleblower in communications with competent authorities and bodies in Spain, at EU level, in Germany and in the United Kingdom. The applicability of each protection regime depends on its own requirements.
2015 → 2017 → 2019–2021 → 2024. Each lane retains its own client, mandate, team and evidential status.
The forums change, but LPB / Sun Park, Concurso 36/2012, the credit, title/encumbrances and the asset's later evolution recur as documentary reference points.
Recurrence is not the same as conflict. It makes client identity, scope, conflict checks, confidentiality, information barriers and document provenance material questions.
Matter-opening/closing records, engagement and scope, conflict checks, teams, screens, waivers if any, and document custody can confirm, narrow or correct the reconstruction.
The four lanes
Each lane carries its own evidential status. Proximity is not silently converted into representation or culpability.
April–July 2015 correspondence reports HAYA material being passed toward Uría Madrid, a communication involving Javier González Guimaraes-Da Silva, and a later reported contact between the Administrador Concursal and Javier Rubio Sanz.
Counter-evidence: on 30 April 2015 Cuatrecasas reported that Uría said it did not yet have instructions to act for HAYA.
A primary PH122 filing inside Concurso 36/2012 records Uría lawyers including Javier Rubio Sanz, Juan Miguel Hernández Herrera and Ángel Alonso Hernández.
This establishes a separate Uría footprint for Promontoria in the LPB insolvency record. It does not make HAYA, Cerberus and PH122 the same legal client.
RICPE's published history identifies advice from Juan Francisco Falcón of Uría in seeking authorisation. The preserved 2020 webinar dossier attributes general project legal processing to Uría Madrid, while separately attributing legal/tax due diligence to PwC.
The 20 July 2021 RICPE certificate materially qualifies the stage of the Sun Park transaction and due diligence.
CaixaBank's defence identifies Raimon Tagliavini Sansa and David García Martín as counsel and expressly relies on the LPB insolvency / Administración Concursal record for standing and res-judicata arguments.
This is CaixaBank's pleaded position, not a judicial finding and not proof of confidential-information misuse.
14 September 2026 · current Uría / CaixaBank notice
This control is designed to prevent a false equivalence. Raimon Tagliavini Sansa is connected to ORD 1859/2023-9 by a primary litigation document. Núria Reyes Puente is connected to this September 2026 communication as the current Uría firm contact. She is not presented as having appeared, signed or been personated in the Valencia proceeding without a primary procedural source.
Relationship: CaixaBank defence counsel in the 29 January 2024 defence in ORD 1859/2023-9.
Current professional contact: raimon.tagliavini@uria.com.
Source-specific counsel status does not establish authorship of every later filing, individual knowledge, conflict, misuse, wrongdoing or liability.
Uría's public directory identifies her as an associate in Barcelona, Procesal, Arbitraje y Penal, Barcelona Bar no. 47313, with nuria.reyes@uria.com.
Relationship here: current Uría contact designated for this notice concerning ORD 1859/2023-9 and the connected LPB / Sun Park compliance-conflict issues.
No pleading authorship, personación, court appearance, retainer scope or individual knowledge is attributed without a primary procedural source.
Unitary chronology
A contemporaneous email reports HAYA documentation for onward transmission toward Uría Madrid. On 30 April, Cuatrecasas reported after speaking with Uría that Uría said it did not yet have instructions to act for HAYA. That counter-evidence prevents publication of a proved HAYA retainer at that date.
A preserved communication reports that the Administrador Concursal had spoken with Javier Rubio Sanz of Uría. It proves the contemporaneous report, not Uría representation of the administrator, the client on Rubio's side or the content of the exchange.
Primary court material records Uría lawyers on the PH122 filing, including Javier Rubio Sanz, Juan Miguel Hernández Herrera and Ángel Alonso Hernández.
RICPE's corporate history identifies Juan Francisco Falcón of Uría in the authorisation process. The preserved 11 November 2020 webinar dossier, page 16, separates Uría Madrid's general project legal processing from PwC's described legal/tax due diligence. Sun Park appears within the presentation perimeter.
The certificate describes CAM's 54 units, other insolvency-estate/third-party properties, acquisition still pending and no signed letter of intent or completed second-stage due diligence. It is RICPE's representation, not an independent title judgment.
The defence in ORD 1859/2023-9 identifies Raimon Tagliavini Sansa and David García Martín and invokes Concurso 36/2012, the Administración Concursal report/textos definitivos, standing and recognised-credit / res-judicata arguments.
A recovered Control 21 version seeks Uría/PwC/adviser materials concerning title, encumbrances, suitability, risks and the real scope of Sun Park in 2020–2021. The 14 September notice separately puts the current Uría contacts on notice of preservation, conflict, confidentiality and compliance issues; receipt of a notice is not a finding of wrongdoing.

Conflict and confidentiality review
These are documentary questions for Uría and relevant custodians, not findings that the answers are adverse.

What LPB / Sun Park / Concurso 36/2012 / title / encumbrance information did each team receive, from whom and when?
What matter-opening and conflict searches were run for PH122, RICPE and CaixaBank, and what earlier names/entities/matters were returned?
Were screens or confidentiality barriers created between teams? If so, when, between which personnel and for which records?
Were any affected clients asked for or did they give informed consent or a waiver concerning any overlapping mandate?
What parts of the LPB insolvency record were supplied to the CaixaBank team, by whom, and from what source?
Which Uría matter files, time entries, emails, notes and title/charges analyses remain preserved for these lanes?
Right of reply remains open. Any response from Uría that corrects, qualifies or supplies primary records should be preserved and published with equivalent source labelling.
