Control chronology · evidence, inference and missing proof

The 2022 deed was not the beginning. Control has its own chronology.

The record must separate formal title, legal possession, material possession and effective control of the hotel. Project Sun Rock's thesis is that a pre-existing machinery of debt, voting, keys, possession and authority existed by 2011 or earlier; that the Acosta Matos perimeter appears in physical access and project preparation from 2017–2018; and that 7 June 2018 marked a qualitative shift to practical control of access to the complex, years before formal title to the LPB properties.

Rule: material control is not title; a later deed does not retrospectively authorise earlier acts; continuity of mechanism is not automatic succession of liability.

The sequence requiring reconciliation

From predecessor machinery to an integrated hotel project.

  1. 2008–2011

    Fragmentation and rupture

The unit sales left a physically unitary hotel over fragmented titles. By 2011 the record documents disputes over Community governance, debt, voting, maintenance, keys, possession and litigation. This does not make every predecessor act unlawful; it fixes the architecture later actors had to know and verify.

  2. 2011–2017

    The machinery consolidates

Attributed debt, voting exclusion, administration, documentary custody, litigation and possession claims create an authority pathway capable of circulating to outsiders. For CAM, the question is its own knowledge, adoption, use, escalation and benefit.

  3. OCT 2017–MAR 2018

CAM's entry was not only financial

The corpus contains attributed evidence of access or attempted access from October 2017 and later JDAM visits with investors and advisers, measurements, ownership assertions, security planning, refurbishment and future possession. Each episode requires originals, metadata, witnesses and the certified judicial record.

  4. 8 MAY 2018

A hotel/Meeting Point connection was already under investigation

A first-phase private investigation, now published only as an anonymised derivative, had already isolated as an investigative lead a hotel professional with Meeting Point/Labranda background. A separate later communication records pre-takeover JDAM visits with investors/advisers including that person. The identities of the executive and investigator are withheld publicly and available to competent authorities.

  5. 7 JUN 2018

    Practical access control changes hands

Direct evidence records the coded entrance being broken, chains or padlocks, uniformed security controlling entry and exclusion of the onsite responsible person. This supports an inference of effective access control over the hotel as an operating whole. Gil Marer alleges that it amounted to full material possession. No order granting CAM legal possession of the whole hotel has been located.

  6. 2018–2021

    Control, works and blocked access

The question does not end on 7 June: control must be measured by what it enabled afterwards. In 2021 the court recorded allegations of works/demolition and access blocked by security, while CAM maintained that it owned 54 apartments and LPB and third-party properties coexisted.

  7. 2019–2020

Lava Verde → Club Sei / Meeting Point

CAM presented Lava Verde as a 279-room project; Meeting Point Hotels/FTI announced Club Sei Lanzarote; a supplier linked Sun Park with Lava Verde and confirmed a physical pilot. Promotion is documented. The contract, exact Meeting Point entity, inventory, authority, bookings and flows remain missing.

  8. 2022

    Formal title comes later

The LPB adjudication and deed arrived in January–February 2022. They must remain separate from Matkator, third-party property and any earlier material authority.

  9. 2024–2025

    357/2024: three-debtor custody and disclosure

After compliance and preservation notices to the FTI/Meeting Point perimeter, signed Auto 97/2025 records a joint 23 July 2024 filing by Meeting Point Hotelmanagement (Canaries), Meeting Point Spain and Meeting Point Investment, deemed communicated on 31 July; the same three requested Auren on 23 January 2025 and the signed 18 February order appointed it. The finite question is what Sun Park/Lava Verde/Club Sei records existed, who preserved them and what each debtor and Auren received. The signed 24 October original and allocation trail remain open.

The institutional question

What document authorised each step?

01

Access

Who ordered, paid for and implemented locks, chains, codes and security from 2017?

02

Perimeter

Which properties and spaces did each actor materially control and under what title?

03

Project

What access enabled measurement, pilots and an integrated hotel presentation before LPB title?

04

Meeting Point

Which entity contracted for or received the project, inventory or distribution?

05

357/2024

Where are the contracts, communications, inventories, bookings, claims and preservation records?

06

Restoration

Is there evidence that control was returned before adjudication? If not, who exercised it and for how long?

Not alleged as established fact: that CAM legally owned the whole hotel in 2018; that every predecessor acted unlawfully; that the anonymised hotel professional participated in the October or June events; that any one of the three Spanish debtors was necessarily the contracting entity; that 357/2024 concealed records; or that the earlier register attribution proves coordination or impropriety.
