Commercial traceability · Sun Park → Lava Verde → Club Sei
Control and marketing before title—and the alleged causal path to adjudication.
Construcciones Acosta Matos publicly presented Hotel Lava Verde at C/ Janubio 3 as a 279-room project; Meeting Point Hotels/FTI announced Club Sei Lanzarote; consumer-facing offers and physical pilots followed before the January–February 2022 LPB adjudication and deed threshold. Gil Marer and Project Sun Rock allege that this was not mere chronology: the disputed June 2018 exclusion allegedly disabled operation, income and the funded-exit route, enabled project access and pre-title marketing, and created operational, informational, valuation and competitive asymmetries that materially caused, conditioned and enabled the later adjudication.
One location, several commercial identities
The allegation is causal, not merely chronological.
The public and documentary chain must be read alongside the material-control and funded-exit records: alleged exclusion and loss of operation/income → practical project access, pilots and pre-title marketing → asymmetric information, valuation and competition → later adjudication and downstream benefit. Each arrow is a testable proposition, not an automatic finding.
- 7 JUN 2018
Disputed material control
The takeover dossier documents a broken coded entrance, chains or padlocks, security and exclusion. Project Sun Rock maintains that from that date the Community/security/CAM-aligned perimeter had practical control of access to the complex. That position is not the same as title to every unit.
- 31 JAN 2019
Hotel Lava Verde
Acosta Matos places the project at C/ Janubio 3, describes rehabilitation of a four-star tourist complex, identifies Construcciones Acosta Matos S.A. as owner, states 279 rooms and names José D. Acosta Matos as architect. Its “Operated by” field is left blank.
- 1–2 FEB 2019
Club Sei Lanzarote enters the FTI / Meeting Point announcement
Trade press reported that FTI-owned Meeting Point Hotels would convert three existing hotels into the new Club Sei brand, including Club Sei Lanzarote. The reporting did not then disclose which Lanzarote property was involved.
- 2019–FEB 2020
A pilot had already been executed
A direct supplier response preserved in the evidence record identifies Sun Park with the establishment the supplier knew as Lava Verde and confirms manufacture and installation of a pilot room months earlier. The record does not by itself identify the contracting party, exact unit, payer or legal basis for access.
- 21 JAN 2020
Public commercial offering
An archived Loveholidays capture shows “Club Sei Lanzarote”, Playa Blanca, offered to consumers with a holiday price. The capture proves online commercial presence; it does not prove the hotel opened, a booking completed or revenue was received.
- MAR–JUN 2020
Four pilots and project-wide planning
A contemporaneous commercial meeting note reports a visit to the complex at CAM’s invitation, four supplier pilots and a request to price a selected model for large-scale replication. The same note opens a possible Meeting Point witness/source route. It remains a contemporaneous account of an oral conversation and requires direct testimony and records.
- 27 OCT 2020
Club Sei rollout postponed
Touristik Aktuell reported that FTI postponed implementation of the Club Sei concept because of the pandemic and set no new date. This is important contrary evidence: announcements and listings must not be converted into a claim that the Lanzarote hotel actually opened or traded under the brand.
- 24 FEB 2021
The court record still described fragmented ownership
In Concurso 36/2012, CAM stated that it owned 54 apartments and that the complex also contained LPB and third-party units. Aweswell alleged works and security-blocked access. That procedural picture requires an explanation of what “owner” meant in a 279-room hotel-project presentation.
- JAN–FEB 2022
Later formal threshold and alleged causal result
The adjudication and deed affecting the LPB perimeter came after the exclusion, funded-exit failure, Lava Verde, pilot and Club Sei milestones. Gil Marer alleges those earlier conditions materially produced and enabled the outcome. Their exact causal and finca scope remains open and must stay separate from Matkator and other third-party property.
- 2024–2025
Preservation and 357/2024
The controlled archive contains compliance and preservation communications directed into the FTI/Meeting Point perimeter before and during the restructuring period. Later proceeding 357/2024 matters because it may be a custody or disclosure location for contracts, inventory, reservations, claims and contingencies — not because the proceeding itself proves concealment or judicial impropriety.
Four different anchors
Project, brand, offering and physical execution are not the same evidence.
Acosta Matos: Lava Verde
C/ Janubio 3 · Construcciones Acosta Matos S.A. identified as owner · 279 rooms · José D. Acosta Matos as architect. No operator is entered in the relevant field.
Meeting Point / FTI: Club Sei
The 2019 announcement identifies Club Sei Lanzarote as part of the new Meeting Point Hotels/FTI brand and a future sales route within the FTI/Youtravel environment.
Loveholidays: Club Sei Lanzarote
The page captured on 21 January 2020 places Club Sei Lanzarote in Playa Blanca and offers it as a holiday product. It does not disclose the hotel contract or prove completed bookings.
Sun Park = Lava Verde for the supplier
The supplier recognised the property once given the address and confirmed a pilot manufactured and installed months earlier. Contract, order, invoice, unit and access authority remain missing.
2021: CAM says 54 apartments
CAM’s procedural position does not describe ownership of the entire hotel: it identifies 54 apartments within a complex also containing LPB and third-party units.
Club Sei was postponed
October 2020 trade reporting says FTI suspended implementation because of COVID-19. This page does not claim Club Sei Lanzarote ultimately opened.
Visual exhibits · archived sources
From Meeting Point presentation to consumer-facing retail offers.
These captures recovered from the email and Drive archive show Club Sei Lanzarote first in a publication within the Meeting Point perimeter and then in consumer-facing sales interfaces. Each source image is published with its date and a specific evidential boundary.
Club Sei Lanzarote in the group brochure
Page 111 identifies “Club Sei Lanzarote”, Playa Blanca, all-inclusive and 315 rooms. The publication panel below names Meeting Point International.
Boundary: this proves a public brand/group presentation; it does not identify the contracting legal person, registered inventory or authority over each unit.
German booking route
The visible URL and “Club Sei Lanzarote” listing show hotel and flight + hotel search controls, with identifier 3023 in the route.
Boundary: this demonstrates a public commercial interface, not a completed booking, stay, payment or commission.
Asset address and consumer price
The German listing names Club Sei Lanzarote, shows C/ Janubio 3, Playa Blanca, and invites users to view offers with a visible EUR 155 per-person price.
Boundary: the visible price is a shop-window offer, not proof of actual availability, a hotel contract or receipt of revenue.
UK retail offer with price and booking call-to-action
The visible Loveholidays page offers “Club Sei Lanzarote” with “Hotel only From £137 per night”, “Price & Availability” and “Secure Booking”.
Boundary: this proves consumer exposure with a price; it does not prove opening, an accepted booking, a guest, payment or revenue.
Sun Park · Lava Verde · Club Sei, side by side
The capture compares Meeting Point’s Club Sei page, Acosta Matos’s “Hotel Lava Verde” page — naming CAM and 279 rooms — and an investor sheet naming Sun Park.
Boundary: the visual and naming convergence supports a request for contracts and unit maps; by itself it does not prove legal identity, whole-site ownership, authority or operation.
Unitary storyline · forward and reverse
Sun Park → Lava Verde → Club Sei → MYND Yaiza: one asset history, different legal capacities.
The same location must be tested as a connected sequence without collapsing owner, access controller, developer, operator, finance vehicle, distributor and retailer into one actor. The later MYND operation is the reverse-engineering start point: trace each right, work, room, contract and revenue stream backwards to the original 262-finca hotel and the exact LPB, Matkator, Community, CEXP and third-party perimeter.
Control before title
Original Sun Park architecture → 7 June 2018 material-control allegation → 2019 Lava Verde and Club Sei presentations → 2019–2020 pilots and retail interfaces → 2022 LPB adjudication → Hotel New Trend / Canarian Hospitality / MYND Yaiza operation.
Rule: a later deed does not retrospectively establish authority for earlier access, works, inventory or marketing.
Operation back to each finca
MYND Yaiza → operator and contracting entity → project company and title → authorised works → physical access → finance/support → original owner and exploitation architecture.
Finite chain: finca → authority → room → inventory → booking → payment → account → beneficiary.
262 · 279 · 315 · 54
Reconcile the horizontal division, CAM’s 279-room project, Meeting Point’s 315-room brochure and CAM’s later 54-apartment judicial position. Divergent figures create a production question; they are not, alone, proof of falsity or wrongdoing.

Procedural status is not a merits finding
Registration, referral, inhibition, preservation or review must be recorded precisely. Portfolio Requests 81/82 and Fiscalía acknowledgements do not, by themselves, prove a reopened investigation, verified facts, Board-wide circulation, CNMV coordination or liability.
FTI Touristik · creditors · recovery
The proceeding remains open and the expected ordinary-creditor quota is very low.
The portal continued to list FTI Touristik GmbH as an open insolvency as at 15 April 2026, under Rechtsanwalt und Insolvenzverwalter Axel W. Bierbach. The 27 May 2025 update reported almost EUR 980 million of filed claims, more than 73,000 creditors, several further years of review and realisation, payment only at the end, and an expected quota described as “very low”.
| Layer | Controlled state | Boundary |
|---|---|---|
| DRSF | about 172,000 claims paid and EUR 245m | Industry-funded scheme; the federal backstop does not itself prove a public draw |
| WSF | EUR 603m support, EUR 93m repaid and early estimated exposure of EUR 510m | Not a final net public loss |
| SEPI/FASEE | EUR 31m for the Meeting Point operation | No proof of a Sun Park flow, omission or final loss |
| BLUESEA/MPS | CNMC C/1549/25 verifies control authorisation | Not the homologation, closing, assets, price or liabilities |
Criminal-first and recovery-first
The mandatory sequence is: actor/capacity → act or omission → duty/authority → knowledge/intent → exact right → correct estate → causal impairment → loss → standing/jurisdiction/limitation → remedy. Travel Weekly supports an announced wholesale route through Youtravel; 1-2-FLY, Ab-in-den-Urlaub and Loveholidays support contemporaneous public interfaces. They do not prove inventory, an accepted booking, payment, commission, opening or revenue. The COVID-19 postponement is mandatory contrary evidence.
The discrepancy requiring records
279 rooms in the project presentation. 54 apartments in CAM’s judicial position.
The figures are not necessarily like-for-like until each document’s definitions are known. That is exactly why a finca-to-unit-to-room map and the project’s title basis are required.
“Owner”: CAM · 279 rooms
The Lava Verde page presents an integrated hotel project at Janubio 3. It does not explain which properties make up the 279 rooms or what third-party rights are included.
CAM: 54 apartments
CAM told Commercial Court 1 that it owned 54 apartments and acknowledged LPB and third-party units coexisted within the complex.
What did “owner” mean?
Room inventory, Land Registry records, authorisations, owner agreements, operating contracts and the material supplied to designers, operators, distributors and investors are required.
Access converted into project execution
The pilot confirms physical work before formal acquisition of the LPB assets.
The question is not simply who designed a room. It is who could access, measure, commission, install, show and plan renovation of a hotel whose title remained fragmented and whose LPB assets remained in insolvency.
Exact unit
In which apartment or space was each pilot installed, and who held registered title at that date?
Access
Who supplied keys, codes or authority to suppliers and visitors after the 2018 change in control?
Commission and payment
Which legal person signed the order and paid for manufacture, installation, travel, renders and design?
Scale
What authority supported moving from one pilot to plans that, according to a contemporaneous note, contemplated hundreds of apartments and dozens of commercial units?
Public brand · contract not yet located
Club Sei publicly connects the project to Meeting Point/FTI. It does not yet identify the Spanish contracting entity.
Public sources support that Club Sei Lanzarote formed part of the Meeting Point Hotels/FTI plan. They do not establish, without the contract, that Meeting Point Spain S.L.U. was necessarily CAM’s counterparty for Sun Park.
Related person record: Joan Cruz Nuez — Meeting Point/LABRANDA chronology and separate HKI capture references. The sources on this page do not establish his direct role in selecting or contracting Club Sei Lanzarote.
Brand and channel
Meeting Point Hotels/FTI announced Club Sei Lanzarote. Travel Weekly reported that UK sales could be made through Youtravel, also within FTI Group.
Management, sales and distribution
A contemporaneous private communication held in source custody alleges that CAM negotiated with Meeting Point concerning management, sales and distribution of the hotel. This page publishes the existence and classification of the allegation, not the private correspondence or protected identity.
The entity and contract
Meeting Point Spain, Meeting Point International, Meeting Point Hotels, Youtravel or another group entity: the answer must come from contracts, correspondence, CRM, inventory, invoices and accounts.
Three debtors · 357/2024
A preservation and disclosure node, not a shortcut to a judicial accusation.
Auto 97/2025 identifies Meeting Point Hotelmanagement (Canaries), Meeting Point Spain and Meeting Point Investment as joint applicants, with a 23 July 2024 filing, 31 July deemed communication, 23 January 2025 Auren request and 18 February appointment. Relevance increases if any debtor was custodian, counterparty, distributor or recipient of Sun Park/Club Sei records. That does not prove concealment or a judicial network.
Notice and preservation
The controlled archive contains 2024 communications into the FTI/Meeting Point compliance/insolvency perimeter seeking verification and preservation of the Sun Park/Club Sei relationship. On 15 January 2026, three further preservation requests were registered with the Las Palmas Provincial Prosecutor under REGAGE26e00003492334, REGAGE26e00003609135 and REGAGE26e00003629560. Registration is not an investigation or outcome.
Debtor schedules + Auren
The requested record includes the initial communication, debt/litigation/contingency schedules, Auren’s acceptance and mandate, data requests and an index of its working file.
One signed order; one earlier act still open
Auto 97/2025 confirms Guillermo Fernández García signed the Auren appointment. The signed 24 October act and allocation trail remain necessary to explain the earlier register attribution to Magistrate-Judge Alberto López Villarrubia in the then Commercial Court No. 3; the signed original and allocation or substitution remain outstanding, and no impropriety is inferred.

What this dossier does not present as proven.
Meeting Point Spain as exact counterparty
A brand/group connection does not substitute for a contract with a specific legal person.
Club Sei opening or revenue
An online offering does not establish that the property opened under the brand, hosted guests or generated revenue.
Concealment in 357/2024
Without the debtor and Auren records, deliberate omission of contracts, claims or contingencies cannot be asserted.
Judicial knowledge
The register’s judge field does not prove which documents either judge personally reviewed.
Retrospective validation
Later formal acquisition does not by itself resolve the authority that existed when access, design or marketing occurred earlier.
Criminality from continuity
A commercial or corporate sequence requires individual attribution of knowledge, act, omission and benefit.
