Protect LPB, its causes of action and recoverable value; keep Matkator and third-party extra-insolvency rights separate where the evidence requires it.
RECOVERY FIRST · ACCOUNTABILITY IN SERVICE OF RECOVERY
Project Sun Rock coordinates a portfolio of legally separate rights and recovery routes. One common history may affect several companies, operating structures, counterparties and other rights-holders without making them one claimant or placing every matter before one court.
Restitution where possible. Compensation where not. Each claim for its true owner, with its own authority, law, forum, causation and quantum.
The multi-claimant and multi-jurisdiction architecture is active. Identification, standing, authority, limitation and valuation for each third party remain subject to individual review. No aggregate third-party damages figure is published.
WHAT MUST BE PROVED → CORRECTED → RESTORED → ACCOUNTED FOR → COMPENSATED, AND FOR WHOM?
The work concerning the Insolvency Administrator, the Court, the LAJ/court office, private actors, regulators and public administrations is not a set of autonomous punitive ends. These are different nodes in one patrimonial reconstruction: what belonged to whom, what happened, through which mechanism, what consequence continues, which forum is competent and what remedy remains available.
Protect LPB, its causes of action and recoverable value; keep Matkator and third-party extra-insolvency rights separate where the evidence requires it.
Recover property, title, possession, access, control, corporate rights and other interests for the correct holder where a lawful route exists.
Test continuing judicial, documentary, notarial, Registry, administrative and economic consequences of historic acts.
Reconstruct credit, interest, transactions, income, fruits, exploitation, costs and any surplus or displaced value.
Quantify only causally provable loss: assets, fruits, income, investment value, financing effects and recoverable costs.
Duty/power → verified knowledge → act/omission → implementation → consequence → remedy.
Keep judicial remedy, civil/insolvency liability, discipline, inspection and criminal routes separate. None is presumed from another.
“Sun Rock Group” describes a historical, economic and strategic reality built around the hotel, its operation, funding, commercialisation and recovery. It is not one legal person. Each entity or rights-holder retains its own assets, contracts, liabilities, causes of action, limitation periods, forum and recoveries.
Aweswell pursues its own direct rights as parent, creditor, funder and investor where applicable. LPB retains its estate claims and Matkator its extra-insolvency rights. Group ownership does not automatically move a loss from one company to another.
Their existence, capacity, representation, current control, direct injury and standing must be verified separately before a claim is attributed to or pursued for them.
Their rights remain with the person who suffered the loss unless a mandate, assignment, subrogation or another valid basis exists. Commercial proximity or common evidence does not make their claim Aweswell's property.
Investigation, sanction, correction, confiscation or recovery of public money belongs to the competent body. Those functions are not Aweswell's private damages claims.
A party may have stopped communicating, lacked funding, changed management, lacked the complete evidence or considered litigation uneconomic. “Abandoned claim” will not be used without evidence of a release, settlement, discontinuance, final disposition or another equivalent legal effect.
Does the entity still exist? Who directs, liquidates or administers it?
Was there a claim, settlement, release, assignment, discontinuance, insurance or subrogation?
Which period applies, was it interrupted, and does the rights-holder now wish to participate?
Each proceeding has its own parties, object, standard and remedies. Coordination prevents contradiction and double recovery; it does not turn all routes into one cause.
Damages, debt, restitution, declarations, interim relief and contractual remedies.
Governance, directors, shareholders, transfers, conflicts and structural modifications.
Estate, claims, liquidation, award, surplus, accounts and insolvency causes of action.
Reports, evidence, investigation, victim participation and civil recovery where the law permits. Public prosecution remains controlled by the competent authority.
Market integrity, investor information, regulated conduct, correction, sanction or referral.
Public acts, licences, tourism, tax, funds, transparency and individualised harm where the legal requirements are met.
Duties of lawyers, insolvency office-holders and other professionals before their competent bodies.
Preservation, recognition and recovery against assets or defendants lawfully reachable in the relevant jurisdiction.
No third party or amount enters the consolidated recovery dashboard until the following controls are completed—or expressly marked open:
Can the full bridge be reproduced from recognised credit through interest, the EUR 400,000/locales component, bidding, dación, cancellations, payments, costs and surplus?
What was actually before the court, what was decided, what remained outside scope, what consequence followed, and what route can correct a continuing effect?
Request → decision → certified content → finality → service → delivery → external use → current effect.
Estate, assets, value, income, payments, causes of action, conclusion and restoration.
Property, title, possession, access, exploitation and fruits not automatically absorbed into LPB's estate.
Investor/shareholder value, capital, financing, costs, contracts, direct losses and remedies crossing borders, without conflating them with LPB's estate.
Adverse outcome ≠ misconduct · judicial error ≠ prevarication · testimony issued ≠ improper use · chronology ≠ causation · missing document in our corpus ≠ non-existence · group label ≠ common legal identity, common intent or common claim ownership · commercial proximity ≠ representation · inactivity ≠ abandonment.
Por Derecho invites any affected person or institution to provide primary material that confirms, corrects or contradicts this reconstruction. The next phase is not another general trawl: it is a targeted claimant-by-claimant review of authority, law, forum, limitation, injury and quantum.
This dossier connects to the chronology, documents or rights considered in Aweswell v CaixaBank. The banking claim, credit chain and each actor’s conduct retain their separate scope. Read both litigation positions, then return to this dossier; no common liability is inferred.
