MEDIA · ADVANCED VERIFICATION → LAURA/CAM RESPONSE → MEETING POINT CONTRADICTION → MONDAY JUDICIAL MATERIAL → PUBLICATION STOPS

Project Sun Rock accuses the Acosta Matos perimeter of deliberately going after the elEconomista story until it was stopped.

This is not an accusation against Javier Romera or elEconomista. The documentary sequence shows an investigation in advanced verification; intervention from the Laura/CAM side; a request to wait until Monday for judicial material; incompatible accounts about whether Meeting Point had commercialised the hotel; and, on Monday 20 January 2025, receipt of a materially adverse but already-appealed Judgment 163/2023 concerning LPB, after which Romera communicated: “with this we cannot publish it.” Project Sun Rock alleges that the CAM/Acosta Matos response channel used or procured that judgment as an interested countermeasure to kill the story. Intent is alleged; it has not been judicially established.

SCOPE OF THE ALLEGATION · ACOSTA MATOS, NOT THE NEWSROOM

What we state, what we infer, and what remains open

DIRECT RECORD

The story was under active verification

Romera was reviewing and editing the proposed note, applying his “bien atado” verification standard, confirmed that he had been asked to wait until Monday for judicial orders, and on Monday directly linked receipt of the document to the communicated decision not to publish.

PROJECT SUN ROCK ALLEGATION

An effort to stop publication

Project Sun Rock accuses the CAM/Acosta Matos response channel, with Laura Patricia Acosta Matos as the identified intervention point, of deliberately acting to stop the story, using or procuring an adverse LPB judgment so that it would operate as if it answered a much broader Sun Park investigation.

OPEN EVIDENCE

Who procured, framed and sent it

It remains open who located or procured the judgment, who decided to characterise it as an “order” about “Sun Park”, who physically transmitted it and from what account, and whether any lawyer, adviser, representative or other intermediary assisted. We do not identify collaborators as fact without primary evidence.

No allegation against the newspaper: we do not accuse Javier Romera or elEconomista of collusion, censorship, bad faith or any offence. One hypothesis consistent with the record is that the newsroom itself may have received an incomplete or misleading characterisation of an adverse judicial document from an interested response channel.

WHY PROJECT SUN ROCK CALLS THIS A STORY-KILL SEQUENCE

Five documentary steps; one allegation about intent

1 · 16 JANelEconomista is actively verifying and editing the story.
2 · 16–17 JANLaura/CAM-side intervention and a request to wait until Monday for judicial material.
3 · 17 JANIncompatible accounts emerge: Meeting Point “never commercialised”; Laura/CAM says it did.
4 · 20 JANJudgment 163/2023 concerning LPB arrives, described as an “order” about “Sun Park”.
5 · 20 JANRomera communicates: “with this we cannot publish it.”

Our allegation: the Acosta Matos perimeter did not merely exercise a neutral right of reply; Project Sun Rock says it deployed a response aimed at preventing publication and that the sought-after result occurred. The chronology and effect are documented; intent remains an allegation that must be proved actor by actor.

THE CONTRADICTION THE JUDGMENT DID NOT RESOLVE

Meeting Point: the response process itself exposed a materially self-damaging contradiction

POSITION ATTRIBUTED TO MEETING POINT

“Never commercialised”

A contemporaneous 17 January record sent to Romera records the Meeting Point side as maintaining that it had never commercialised the hotel. The attribution still requires authentication against the interlocutor's native record.

POSITION ATTRIBUTED TO LAURA/CAM

There was commercialisation

The same record states that Laura/CAM maintained that Meeting Point had commercialised the hotel at some stage. We likewise do not treat that attributed statement as an authenticated admission without the native message or audio.

INDEPENDENT COMMERCIAL EVIDENCE · 2020

Club Sei Lanzarote · Calle Janubio 3

Meeting Point Hotels' corporate brochure includes Club Sei among its brands and describes Club Sei Lanzarote as a 315-room hotel in Playa Blanca. sonnenklar.TV offers it on 27/01/2020 at Calle Janubio 3, the same address preserved for Sun Park.

Why this matters: the independent record materially corroborates the substance of the Laura/CAM-side version in the limited but central sense of public presentation and distribution of the hotel product. The response process therefore appears to have acknowledged a core fact that the proposed story sought to investigate at the same time as the other commercial side was denying it. Project Sun Rock presents this as a materially self-damaging contradiction, not as a judicial or authenticated confession.

This does not prove which Spanish company signed a contract, which units were included, who authorised inventory, whether reservations were consummated, who invoiced or received money, or whether the commercialisation was lawful. But it does make it untenable to treat “never commercialised” as a simple answer unless the corporate brochure, Club Sei Lanzarote and the public offer at Sun Park's address are explained.

Judgment 163/2023 did not undo this contradiction. It was an insolvency-classification judgment concerning LPB. It did not decide whether Meeting Point/FTI commercialised Club Sei Lanzarote, under what authority, over which units or with what economic flows. Project Sun Rock alleges that the Monday document displaced that unresolved question without answering it and immediately became the communicated reason not to publish.

Five corrections that prevent the judgment being used as a total answer

1 · JUDGMENT, NOT ORDER

The label matters

The attachment was named AUTO CONCURSO CULPOSO.pdf, but the judicial document is Judgment 163/2023.

2 · LPB, NOT “SUN PARK”

The debtor is not the whole hotel

The operative part classifies the insolvency of Luchy Playa Blanca, S.L., not the whole of Sun Park or every owner.

3 · APPEALS ALREADY FILED

The procedural picture was incomplete

Appeals had been filed since October/November 2023 and appellate personation existed before January 2025; the judgment itself links disqualification to finality.

4 · LIMITED OBJECT

It did not decide whole-hotel title

It does not adjudicate every property unit or determine by itself the extraconcursal rights of Matkator or other owners.

5 · IT DID NOT ANSWER THE PITCH

It did not decide the proposed story

It does not decide Meeting Point/FTI, Club Sei, RIC/RICPE, funding/incentives, commercial authority or the extraconcursal perimeter.

We do not minimise the culpable classification. It is a materially adverse first-instance judgment. That is exactly why it must be described precisely and not expanded beyond what it decided.

PROPOSED STORY → JUDICIAL SCOPE → DOCUMENTED EFFECT

The judgment was relevant adverse background; it did not decide most of the investigation.

Story being verifiedWhat Judgment 163/2023 actually decidedDocumented use and consequence
Meeting Point/FTI and Club Sei; mixed ownership; control and commercial authority; RIC/RICPE; regional incentives; the FEDER component; later operation.LPB's culpable classification and specified first-instance consequences. It was materially adverse and under appeal; it did not adjudicate the whole hotel or those external layers. The file arrived characterised as an “order” about “Sun Park”. Romera then communicated that “with this we cannot publish it.”

Boundary: the table proves a scope mismatch and the communicated editorial consequence. It does not by itself prove who supplied the characterisation, newsroom bad faith or any person's criminal intent.

The documentary sequence

2020 · independent commercial evidence. Meeting Point Hotels presents Club Sei as a portfolio brand; Club Sei Lanzarote appears as a 315-room Playa Blanca hotel; sonnenklar.TV offers it at Calle Janubio 3, the same address as Sun Park.
3 January 2025 · Lars Creutzmann / Meeting Point. A request seeks confirmation, disclosure and preservation of contracts, inventory, bookings, distribution, invoices, payments and instructions.
16 January 2025 · press note to Javier Romera. The proposed investigation includes commercialisation, control, CAM, Meeting Point/FTI, RIC/RICPE and public/European finance and incentives.
17 January 2025 · incompatible accounts. Meeting Point is attributed with “never commercialised”; Laura/CAM with saying it did.
16–17 January · wait until Monday. The contemporaneous record attributes the request for time to Laura/CAM; Romera directly confirms: “Solo me han pedido esperar al lunes para pasarnos unos autos judiciales.”
20 January · judgment arrives and publication stops. Romera characterises the received document as an “auto” concerning “Sun Park” and says that it declared the concurso “culposo”; he then communicates that “with this we cannot publish it.” That wording is preserved as Romera’s contemporaneous characterisation, not as a legally precise description: the document was a judgment concerning LPB and Concurso 36/2012, not a declaration that the whole hotel or every owner was insolvent, and the judgment was under appeal. The message does not identify the physical transmitter; it proves receipt, characterisation and the editorial consequence communicated.

DP 913/2025 · MADRID INVESTIGATING COURT NO. 44

The criminal theory narrowed; the journalistic question was not decided.

The March 2025 complaint prepared through Sixto Abogados alleged that Laura personally transmitted the judicial material and intended to prevent publication; it proposed Javier Romera as a witness. Those were party allegations, not judicial findings. The recovered exhibits included Romera's 20 January email, a Public Insolvency Register extract identifying LUCHY PLAYA BLANCA, S.L., and the complete Judgment 163/2023.

The 5 May 2025 Madrid archive order said the filed material did not establish that Laura was the physical sender; held that CAM had legitimate access to the judgment as a party/creditor; corrected that it was a “Sentencia –y no el Auto–”; and observed that a hypothetical transmission could be “interesada” without constituting the secrecy offence alleged.

Controlled status: reform and then appeal were pursued in May/June 2025, and Fiscalía opposed the appeal. No later Provincial Court decision has been located. This page therefore does not describe the 5 May archive as a final appellate merits determination. That criminal threshold decision also did not decide whether the judgment was accurately contextualised to the newsroom, whether its appeal status was explained or whether it answered the wider story.

THE ORIGINAL STORY + A SECOND STORY

How the first investigation was stopped is now itself part of the public-interest story

Story 1 · What was happening around Sun Park?

Club Sei / Meeting Point / FTI; mixed ownership and extraconcursal units; CAM control and title; RIC/RICPE; professional custodians; RIC, regional incentives and FEDER/public funding.

Story 2 · How was the investigation stopped?

Who procured and framed the judgment, what was said about finality and scope, why the Meeting Point/Laura-CAM contradiction was not followed through, and what native message entered the newsroom before “with this we cannot publish it.”

20 August 2026: Project Sun Rock has asked elEconomista to reopen the file, preserve the native inbound message and revisit the story against the expanded documentary map. The same invitation is open to any independent newsroom willing to investigate and give all affected parties a right of reply.

Who procured, framed and physically transmitted the judgment?

The physical transmitter remains unverified; response provenance should no longer be treated as a neutral mystery. The strongest documentary inference is that the judgment was supplied or procured within the CAM/Acosta Matos response channel initiated by Laura. It remains open whether LPAM transmitted it personally or whether a lawyer, adviser, CAM representative or another intermediary sent it.

What we do not do: we do not name the Insolvency Administrator, Lars Creutzmann, Axel Bierbach or another specific person as transmitter without the native inbound message, headers, metadata or equivalent primary proof.

NO ALLEGATION AGAINST THE NEWSROOM

elEconomista can help close the evidence gap; it is not the target of this allegation

There is no evidence that Javier Romera knew the description supplied to him was legally overbroad or acted in bad faith. The finite verification question is: what exactly entered the newsroom from the CAM/Acosta Matos response side, through whom, and with what description of the judgment's scope and appellate status?

  • Was it checked that the document was a judgment, not an order?
  • Was it checked that the insolvency debtor was LPB, not “Sun Park” as a whole?
  • Were the appeals already filed and the reference to finality checked?
  • Was “never commercialised” tested against the Meeting Point Hotels corporate brochure and Club Sei Lanzarote at Calle Janubio 3?
  • Was it examined whether the judgment actually answered Meeting Point, commercialisation, RIC/RICPE, funding/incentive and extraconcursal-property questions?

Ten finite documentary questions

  1. Who physically transmitted AUTO CONCURSO CULPOSO.pdf to elEconomista, from what account and with what text?
  2. Who located/procured Judgment 163/2023 and decided to frame it as an “order” about “Sun Park”?
  3. Did any transmitter act through the CAM/Acosta Matos response channel, for another person/entity, or on their own initiative?
  4. Was the newspaper told the judgment was final? Was it told about the appeals?
  5. Was it explained that the operative part concerned LPB's insolvency and not the entirety of Sun Park?
  6. Can the native record of the incompatible Meeting Point and Laura/CAM accounts be authenticated?
  7. How do Meeting Point/FTI explain the 2020 brochure, Club Sei Lanzarote, Calle Janubio 3, and what contracts, inventory, bookings, commissions, invoices and payments existed?
  8. What verification was made of the relationship —or absence of relationship— between the judgment and the RIC/RICPE, funding/incentive and extraconcursal-rights questions?
  9. Are the original inbound message, headers, attachments, voice notes and call records preserved?
  10. Does elEconomista wish to correct, complete or reopen the investigation?
