David Espejo / eXW: four signed reports, two identified annexes and a pre-hearing version issue

The bilingual public dossier has been synchronised with the repository reconstruction and relevant primary emails. The update distinguishes creation, signature, custody, transmission, annexing, filing and judicial use.

April 2019

Four signed finals were delivered. The located LPB opposition identifies two Espejo annexes: documents 3 and 5.

24 July 2023

An access barrier and a copy discrepancy were documented before the hearing. No defect or alteration of the medium is established.

Judicial use

The judgment used documents 3 and 5 on identified subissues; that use is not wholesale adoption of the reports.

What remains open

Outstanding matters include matching the exact versions reviewed before evidence, recovering and hashing the original audiovisual files, obtaining a certified court copy or index, locating the final LPB appeal, and completing the version/custody/filing matrix.

Evidential boundary. The update does not claim that the court medium was corrupt, defective or incomplete; that the recording was manipulated; that all four reports were four annexes; or that the two non-annexed items were never used elsewhere.
