Sun Park was economically integrated, but it was never one legal person, one title, one operator, one debt or one insolvency estate. The task is to prove each bridge between them.

Attributed criminal theory; not a judicial finding. Gil Marer and Aweswell allege one continuing economic-criminal enterprise, advanced through successive adoption and divided functions. The theory does not itself prove a statutory criminal organisation or group under Criminal Code Articles 570 bis or 570 ter, an original pact, any person’s participation or guilt. Each actor and each offence require separate proof of their historical elements, conduct, capacity or duty, knowledge, intent where required, causal contribution and contrary material. This is only a factual allegation of connection: it does not characterise the conduct as a continuing or permanent offence or alter completion, any participation window or limitation period for any specific offence.

Notice, credit assignment, authority and material control require their own documentary chain; a creditor position was not automatically whole-hotel control.

04 · Title and benefit

2019–now

Validation, valuation, adjudication, deed, investment, works and current operation require property-by-property and account-by-account reconciliation.

Perimeter rule

What the record does—and does not—place in Concurso 36/2012.

Luchy Playa Blanca, S.L.U. (LPB) was the debtor in the proceeding. That fact does not automatically place the whole complex, CEXP, the Owners’ Community, Matkator, Aweswell, third-party units, hotel income or operating rights inside the estate.

Four distinct planes

LPB: debtor and estate only. Owners’ Community: common-property governance. CEXP: operating/exploitation layer. Other owners and entities: independently evidenced rights and losses.

  • No later title decides every earlier authority question.
  • No judicial act automatically establishes private-party intent or liability.
  • No communication or institutional receipt proves the truth of its contents.
  • No allegation is a finding: every actor requires evidence of capacity, act, knowledge, causation and benefit.

Costa Papagayo

A defined documentary bridge—not a conclusion.

ETJ 370/2013 identifies a procedural route involving a Costa Papagayo community entity, a Sun Park Community perimeter and LPB. That does not itself determine debtor substitution, substantive liability, valid authority, disclosure or an agreement.

The verification sequence is finite: claimed capacity → authority source → contact or filing → document/information → decision or use → disclosure → in-concurso and extra-concurso effect → benefit/loss → contrary explanation.
