The allegation in its fullest form.
Gil alleges that the private actors involved in the 2011 takeover or reconfiguration of the Community organ later continued to exercise or accumulate practical capacities that, in his view, were functionally comparable to de facto or shadow administration of LPB-related assets, rights and decisions. He alleges this occurred without formal appointment as administrators of the insolvent estate and without sufficiently independent defence of the estate against that perimeter.
Gil uses the expression “estafa concursal” as an umbrella description of the alleged sequence. The repository does not treat that phrase as an autonomous offence or an established legal conclusion. It decomposes the theory into possible fraud, procedural fraud, disloyal administration, insolvency offences, documentary falsity or other offence families only where their specific elements can be proved.
Position concerning the insolvency administrator. Gil alleges that Francisco de Borja Rodríguez-Batllori Laffitte materially enabled continuation of the private-actor perimeter through acts and omissions, silence, inaction and failures to investigate or defend. Gil simultaneously keeps alternative knowledge states open: the administrator may initially have been deceived; later failure to inquire may, in Gil's characterisation, have become reckless; or future evidence may establish actual knowledge or deliberate facilitation.
