The current RPL 3304/R33 material was sent within the existing NNR4-1025C2F66 thread, tied to the historic San Telmo / RICPE / Sun Park source perimeter.
RSM SPAIN · ETHICS & INDEPENDENCE
NNR4-1025C2F66
An opportunity to demonstrate how an independent professional review works: preserve, define, test and explain.
Internal review confirmed · current update sent
Editorial boundary. This page does not allege wrongdoing by RSM Spain. It records an open case, verifiable correspondence and governance questions that remain without a documented answer. The underlying allegations are not presented as RSM findings or adjudicated facts.
CURRENT INSTITUTIONAL UPDATE · 21–22 SEPTEMBER 2026
R33 context delivered within the existing NNR4 thread; the finite review remains open.
The canonical company name was confirmed as Aweswell Limited; legal-register literal AWESWELL LIMITED, company 07716847. The correction is provenance, not a change to the allegations.
A bounded mailbox review through 22 September located no substantive response to this update. RSM's stated September window has not yet expired. Silence is not admission, refusal or proof of review.
Finite action: preserve the NNR4 record and relevant legacy San Telmo materials; define entity, client-introduction, KYC, conflict, access, communications, billing/referral and information-separation scope; identify the independent decision owner and issue a reasoned outcome.
The institutional question
Will RSM independently reconstruct, preserve, test and explain the professional and organisational perimeter placed before its Committee?
The test of a sound review is not whether RSM agrees with the reporter. It is whether the record can show what was examined, what was excluded and why, what sources were preserved, how independence was managed and what reasoned outcome was reached.
What RSM has already done properly
Institutional credit where due. Francisco J. Remiro Hernández, Head of Ethics & Independence, engaged directly; expressly guaranteed confidentiality and discretion; directed the matter into the formal ethics channel; the case was identified as NNR4-1025C2F66; RSM later stated that the Committee was continuing to analyse the documentation and that the additional material supplied on 5 June was being considered; it also communicated a concrete expected window for conclusions.
Recognising those steps does not prejudge the result. It raises the standard for the next stage: a traceable conclusion that addresses the perimeter actually raised.
Verifiable chronology with RSM
A compliance communication is sent to RSM Spain, including its Ethics & Independence lead and DPO, asking for confidential and independent handling of issues touching the historic San Telmo professional environment later integrated into RSM.
RSM acknowledges receipt, guarantees confidentiality and discretion, and asks that the communication be lodged through its ethics channel. The reporter subsequently confirms formal registration of case NNR4-1025C2F66.
A Compliance COCKPIT notification confirms that the case manager sent a new message. The exact portal message is not reproduced because it has not been recovered for this public record.
Additional material, including DIP 80/2026 context, is supplied and the review is asked not to reduce the issue to one individual where the wider professional and organisational environment may be relevant.
Francisco J. Remiro thanks the reporter for the additional information, explains that the volume of material requires analysis and confirms that the Ethics & Deontology Committee is still reviewing it. He states that RSM expects to be able to obtain conclusions in September 2026.
The reporter asks for clarification on document preservation, scope, independence/ring-fencing, continuing effects and cooperation with lawful requests from competent authorities.
Without seeking an early merits conclusion, the reporter asks two limited questions: which professional entity would be the correct interlocutor if a future professional-responsibility issue were established within the historic environment under review, and whether RSM will continue preserving potentially relevant material and cooperate with lawful, properly framed requests from competent bodies. The email expressly states that no response is requested during the holiday period and that RSM is not being asked to endorse the reporter's allegations.
Status at 18 August 2026: this page does not treat RSM as overdue. The window RSM itself indicated — September 2026 — has not yet expired. No later RSM response to the 18 August communication has been located; as of this date that absence is not treated as a refusal or substantive silence because the email itself did not request a response during the holiday period.
Six questions the outcome should be able to answer
1. Preservation
Have relevant San Telmo/RSM legacy documents, correspondence, case files, conflict records and other materials needed to reconstruct matters within RSM's legitimate perimeter been preserved?
2. Scope
Is the review limited to one person's formal status, or does it examine professional, organisational and information relationships where materially relevant?
3. Independence
Is the review structurally separated from people or offices that may have had a connection to the matters being examined?
4. Continuing effects
Does the review consider only historic conduct, or also representations, document custody or consequences that may have continued after integration?
5. External cooperation
Will RSM preserve and provide relevant material in response to any lawful, properly framed request by a competent body — including, within their respective remits, ICALPA/DIP 80/2026, judicial or prosecution bodies connected with DP 1901/2026 and, if its status changes, DP 1956/2026, regulators such as CNMV, or competent public/EU-funds control functions?
6. Professional-responsibility perimeter
If a professional-responsibility issue were ever established in relation to conduct within the historic professional environment under review, does RSM regard it as solely personal to the professional, within an RSM/legacy San Telmo entity, or belonging to another identifiable professional entity?
What is — and is not — being asked. RSM is not being asked to support the reporter's allegations or adopt the position of ICALPA, prosecutors, a court, CNMV or another body. The narrower question is: what is the correct professional perimeter, will evidence be preserved, and will the relevant entity cooperate with legitimate requests?
What a useful institutional decision could look like
The transparency rule: a conclusion may agree or disagree with the reporter. What should be avoided is replacing a traceable decision with silence or an unexplained boundary of competence.
How to read this file
Each material addition should state what it proves, what it does not prove and what document could change the assessment. A complaint, internal review or professional relationship does not by itself establish liability.
Right of reply and correction
RSM's position belongs on this page.
RSM Spain may identify factual errors, provide relevant documents, explain the organisational or legal perimeter applied and state its position. Any material, verifiable correction received will be recorded with equivalent prominence and the chronology will preserve the change history.
Follow the record
