DIP 79/2026 · DOCUMENT → PROFESSIONAL USE → EFFECT

Three professional acts. Six attachments sent. No presumption.

DIP 79 examines how CAM, Community and RICPE materials were verified, qualified, presented, maintained or corrected by CAM's lawyer. The analysis does not attribute authorship of third-party certificates to the professional and does not turn forceful advocacy into a breach or offence.

Institutional act of 20 August 2026. An email was sent to the four ICALPA addresses used, carrying four primary court documents, two Spanish contextual graphics, the direct video link at 08:08 and the complete source. Gmail records message 1a01f0b82a4dd6aa as SENT.

1. The exact professional question

SOURCE AUTHOR → CAM AND CLIENT INSTRUCTIONS → VERIFICATION AND QUALIFICATION → PROCEDURAL USE BY THE LAWYER → INFERENCE SOUGHT FROM THE COURT → DECISION OR EFFECT → LATER CORRECTION, IF REQUIRED.

Not asserted

Automatic authorship of every alleged falsehood

Francisco Mario Matos Matas and Enrique Guerra Suárez signed their respective certificates. Any responsibility of the lawyer requires individual proof of knowledge, verification, use, warnings, inference and correction.

What is requested

Fidelity between source and representation

Whether allegedly false, inaccurate, selective, derivative or potentially misleading documents were presented with objective appearance; which limitations were disclosed; and whether the use exceeded what the source actually established.

2. The three focal acts from 2021

February 2021

CAM opposition concerning works, access and the “reality of the facts”

The package commonly archived under 15 February has text and signature records extending to 16–17 February. It asserted, among other matters, that 2018 works were confined to CAM's 54 units and that other measures concerned security and Community resolutions.

9 February 2021

Community certificate

Selected resolutions were used to support access control, absence of operation, technical measures and absence of non-security works. The issue is what complete minutes, authority, title, works and contradictions were checked.

21 July 2021

CAM filing concerning RICPE

The filing sought to restrict further Aweswell material and presented Enrique Guerra's certificate as illustrative of the “reality of the facts”. The requested inference must be compared with the literal text, public source and contrary material.

20 July 2021

RICPE certificate and its qualifications

The document acknowledged 54 CAM properties, LPB assets, 18 third-party properties, information supplied by CAM, absence of acquisition, LOI and full due diligence, and a preliminary project capable of failing.

3. Effects capable of extending beyond Insolvency 36/2012

Evidence

Inspection and expert evidence

The material entered the adversarial setting in which the physical condition, works and damage were not fixed through the requested expert process. Sole causation is not alleged.

Possession

Access, custody and exclusion

The authority projected by the certificate could affect treatment of access by owners, technicians, operators, experts and potential participants.

Transformation

Works, demolition and reversibility

The description of the works affected property-by-property identification, damage measurement, restitution, preservation and third-party rights.

Value

Valuation, bidders and liquidation

The physical condition and asserted legitimacy could become premises for valuation, risk, comparison of offers, award and a funded alternative exit.

Title

LPB, CAM, Matkator and third parties

The RICPE certificate confirmed fragmented ownership. No unitary hotel narrative could itself transfer assets outside LPB.

Capital and operation

RICPE, financing, HNT and MYND

A judicially presented account might circulate in due diligence, financing, supervision, advice and operation. It did not bind those third parties or prove their reliance; the documentary chain requires verification.

4. Separation from DIP 80

DIP 79 concerns professional presentation of CAM's position. DIP 80 concerns independent verification and action by the Insolvency Administrator from the estate side. A source may cross both files, but each professional retains separate duty, knowledge, hearing and decision.

3 active checkpoints

Second pair of eyes · act by act

The question is not whether a global narrative feels persuasive. It is what each source proves, what the professional could reasonably know at the time, which contrary explanation exists, and what human decision follows.

Mandatory separation: sharing methodology does not mean sharing evidence. No DIP 80 material enters here without an express human relevance and provenance decision.

5. Next status

No ICALPA acknowledgment, incorporation certificate, professional hearing or later decision has yet been located. Electronic-registry presentation of the reinforced email remains pending and must stay separate from Gmail transmission evidence.
