PROVINCIAL PUBLIC PROSECUTOR'S OFFICE OF SANTA CRUZ DE TENERIFE · 21 AUG 2026

Administrative File 95/2026: procedural closure and a documented difference of scope.

This record preserves the submitted email, the received notification, the controlled transcription of the Decree and its complete English translation. It separates what the Public Prosecutor decided, what the submission actually requested and what remains without a documentary answer.

Control rule: the Decree closed Administrative File 95/2026 on a procedural and investigative-competence rationale. It did not expressly find that the supplied documents were false, irrelevant, exculpatory or insufficient.

1 · PROCEDURAL RESULT

What was opened

An administrative/governance file, registered as File 95/2026, to process the 21 August communication.

What was closed

The administrative file itself. The Decree did not reopen Preliminary Proceedings 748/2026.

Stated reason

The Office regarded the matter as already judicialised in DP 748/2026 and said that it could not open new prosecutorial investigation proceedings or order the requested steps outside the judicial file, even though that file was archived.

Exact effect: this is an adverse routing decision. It is not an individual merits determination concerning each document or requested investigative step.

2 · DOCUMENTED DIFFERENCE OF SCOPE

The communication was not limited to seeking reconsideration within DP 748/2026.

The Decree summarises the submission principally as a request to review the Public Prosecution Service's position of 8 June. That purpose appeared in the email, but it did not exhaust its content.

Request documented in the emailExpress treatment in the Decree
Preservation and possible association with earlier January 2026 communications to the Tenerife Prosecutor's Office. No confirmation of association, transfer or availability in DP 748/2026.
Separation from other economic or fiscal files transferred to Las Palmas. No individual answer concerning cross-file classification or preservation.
Finite checks in Cambiario 1048/2019 and ETJ 163/2020: cause, debtor, asset selection, auction award and possible transferee.Grouped within the stated inability to order investigative steps outside DP 748/2026, without an individual decision on each.
A bounded local Tenerife source, expressly presented as requiring verification and not as an accusation. No specific determination.
A documented reason if each proposed step was regarded as irrelevant or inadmissible. No individual decision matrix.
Preservation against irreversible property consequences. No separate response.

Controlled conclusion: the Decree's summary is materially narrower than the email. This supports a respectful scope-and-traceability objection; it does not by itself prove bad faith or legal invalidity.

3 · WHAT THE DECREE DOES NOT DECIDE

No documentary merits finding

It does not declare the supplied documents false, irrelevant or insufficient.

No answer to the finite questions

It does not reconstruct the debt/debtor, asset selection, knowledge, recovery alternatives, auction award, transferee or beneficiary.

No proof of judicial incorporation

It does not confirm that the email and two annexes entered DP 748/2026 or were examined by the court.

4 · THE WIDER TENERIFE PROSECUTOR PERIMETER

The Decree itself refers to DIP 7/2026, DIP 12/2026 and DIP 20/2026. Recovered primary documents from DIP 20/2026 establish a separate file concerning a reported RIC hotel-investment offer, possible false data or misleading advertising and possible falsification or Public Treasury offences, transferred to the Provincial Public Prosecutor's Office of Las Palmas.

Limit: the exact contents of DIP 7/2026 and DIP 12/2026 remain pending primary-source recovery. No unverified subject is attributed to those files.

5 · OPEN QUESTIONS

  1. Obtain the judicial decision of 16 July 2026 cited by the Decree.
  2. Confirm whether the 21 August communication and annexes were incorporated into, transferred to or made available in DP 748/2026.
  3. Obtain the native decisions and exact scope of DIP 7/2026 and DIP 12/2026.
  4. Identify the individual treatment, in the competent forum, of the finite investigative and property-preservation requests.

No inference from non-location: failure to locate a source does not establish that it does not exist.

6 · CONTROLLED DOCUMENTS

The native PDFs and PNGs remain preserved in Gmail and private Drive. They are not published here pending a separate privacy, confidentiality, necessity and proportionality decision.

7 · CONTROLLED PUBLIC FORMULATION

The objection is not that the Public Prosecutor “rejected the evidence.” It is that the Decree applied a route focused exclusively on DP 748/2026 to a communication that also requested preservation, association with earlier prosecutorial records, separation of files and finite checks distinct from reconsideration of the 8 June report.

The outstanding institutional question is documentary: what was preserved, in which file, before which body and by what decision each request was—or must be—resolved.
