## What the Auto establishes

The act records, among other things:

1. DP 332/2014 was registered in the court on 31 January 2014.
2. It says a 13 June 2014 resolution opened the proceeding following a complaint concerning alleged insolvencia punible / alzamiento de bienes.
3. It records a Ministerio Fiscal report dated 25 May 2016 asking for a complex-instruction declaration and an 18-month extension.
4. It records that the complainant's representation adhered to the Fiscal request in a 24 May 2016 writing.
5. The court granted an exceptional 12-month extension instead.
6. The page-one procedural header visually identifies Gil Marer and Patricia Isabel Domínguez Montelongo as `Denunciado`; Borja Rodríguez-Batllori Laffitte and ROQUE PRIETO SL appear as `Denunciante`. The header also contains Manuela María Dolores Cabrera De La Cruz and José Ramos Saavedra. Exact capacities beyond the visually aligned labels must not be inferred from parser order alone.

## What it does not establish

The Auto does not by itself establish:

- truth of the underlying accusations;
- who attended the April 2015 statements;
- that Fiscalía or the Administrador Concursal were absent from those statements;
- the identity/capacity of the lawyer Patricia later remembered as the lawyer for the Molina side;
- corrupt coordination, conspiracy, criminal complicity, disloyal administration, breach of duty, non-neutrality or intentional instrumentalisation.

Those propositions require their own primary or corroborating sources.

## Linked source chain

- DI 273/2013 — Fiscalía Provincial de Las Palmas — 27 Dec 2013 querella.
- DP 332/2014 — Juzgado de Instrucción nº 3 Arrecife.
- 13 Apr 2015 contemporaneous email: Patricia described the next-day statements as arising from the AC complaint; Juan Tomás Parrilla answered that Gil/Patricia were accused personally.
- 29 Apr 2015 contemporaneous Cuatrecasas report: Pablo Villaseca reported that the judge was displeased that Fiscalía had sent the matter and did not attend the statements.
- 2018 retrospective email: Patricia recalled that neither Fiscalía nor the AC attended and only the lawyer for the Molina side appeared. This remains party recollection pending the primary personación/statement minutes.
- 20 Nov 2018 Cuatrecasas procedural reconstruction: records a 24 Feb 2015 personación order and Gil/Patricia statements on 14 Apr 2015.

## High-priority production targets

- primary 24 Feb 2015 personación order;
- both 14 Apr 2015 statement records / attendance sheets;
- lawyer and procurador identities/capacities for the personated private side;
- any direct official record of Fiscalía or AC attendance/non-attendance;
- complete certified DP 332/2014 docket and final signed disposition.

Until those are recovered, the attendance/representation event is controlled as:

`HIGH-PRIORITY LINKAGE EVENT — PARTY RECOLLECTION + CONTEMPORANEOUS COUNSEL CORROBORATION; PRIMARY DECLARATION/PERSONACIÓN MINUTES STILL REQUIRED.`

## 24 February 2015 personación — primary record recovered

A one-page court-copy providencia closes the earlier pronoun-only personation gap.

- act date: **24 February 2015**
- court: Juzgado de Instrucción nº 3 de Arrecife · DP 332/2014
- judge: **Rafael Lis Estévez**
- SHA-256: `c916d1768dfcd60670010ad7d98ed62741c14d9e99351bb120057854eac4e743`
- private accusation admitted through **José Ramos Saavedra** for **Roque Prieto S.L.**, literal source form **AMENEN S.L.**, and **Inversiones Salinetas S.L.**
- defence admitted through **Manuela Cabrera** for Gil Marer and Patricia Isabel Domínguez Montelongo
- statements scheduled for **14 April 2015 at 10:30**; an English interpreter was ordered

**PROVED:** personation/admission, represented parties, defence representation and scheduling.
**NOT PROVED:** who physically attended on 14 April; interpreter attendance; Fiscalía/AC attendance; or the identity/capacity of the lawyer Patricia later recalled as appearing for the Molina side.

The April-attendance event remains separately controlled as:

`HIGH-PRIORITY LINKAGE EVENT — PARTY RECOLLECTION + CONTEMPORANEOUS COUNSEL CORROBORATION; PRIMARY DECLARATION MINUTES STILL REQUIRED.`

The controlled **30-PDF / 42-page** counsel-selected archive (not a certified complete docket) is inventoried at `evidence/fiscalia/dp-332-2014/recovered-court-copy-inventory-20260919.json` with per-object hashes/review levels. It also proves a 2-Jul-2017 inhibition order followed by an express 25-Sep-2017 refusal by the receiving court; completed accumulation cannot be inferred from the July order alone.

### Updated finite production targets

1. Both 14-Apr-2015 declarations, signatures/attendance/interpreter/audiovisual record.
2. 15-Apr-2015 AC-testimony request and referenced 8-May-2015 Fiscalía report.
3. Complete personation applications/powers, September-2017 apud-acta and exact lawyer appointments.
4. Underlying Fiscalía competence report and final competence-dispute/accumulation resolution.
5. Intervening complexity/extension orders and actual October-2020 AC testimony/recording.
6. Signed final DP332 disposition, notice, appeals and finality.
