434/26 → 493/26 → 193/2026
The appeal against 434/26 was filed on 6 March as RE-001971/26. The portal generated 493/26, but the document was substantively an appeal and CCACM later opened 193/2026.

The institutional request concerns possible instrumentalisation of professional relationships and fees across AWESWELL / Sun Park. Armando Betancor Álamo, his team and Joaquín Ruiz de Infante Abella are not complaint targets here. Traceable examination of individual acts and omissions, including recent events, is requested with contrary evidence and each professional’s response.
CURRENT STATUS · 30 SEPTEMBER 2026
ICAM 1487/26 → RE-007622/26 / 1566/26. CCACM also stated that it still did not have the antecedents for the appeal against 1487/26. The 6 July record proves portal filing through ICAM and a correction/forwarding request; the 29 September traceability communications show that the gap remained open. Effective CCACM receipt will not be published as verified until supported by a receipt, order, reference or equivalent confirmation.
The underlying professional-conduct issue and the administrative transmission issue are distinct: a forwarding gap does not prove the alleged infringement, but it does require full traceability if the appeal route is to exist in practice.
UNITARY REDIGEST · 25 AUGUST 2026
This record gives ICAM and CCACM a proportionate route to distinguish individual conduct, partner authorisation or supervision, and professional-firm controls, without presuming misconduct by Cuatrecasas or converting a professional-conduct appeal into civil, criminal or enforcement litigation.
Operating rule: ICAM ≠ CCACM ≠ ICALPA ≠ ICATF. The evidence and chronology are unitary; competence and files remain separate.
The appeal against 434/26 was filed on 6 March as RE-001971/26. The portal generated 493/26, but the document was substantively an appeal and CCACM later opened 193/2026.
Appeal RE-007622/26 was filed on 6 July and the portal generated 1566/26. The 493 precedent makes technical intake plausible; forwarding and a CCACM number still require proof.
ICAM 434/26 described the relationship as 2018–2020; ICAM 1487/26 later said it ended “more than seven years” earlier. The tension requires clarification, not an inference of bad faith.
Firm-wide misconduct has not been proved. The examinable issue is whether later steps taken under the firm's name to recover the credit it claims involved new choices and what client, conflict, secrecy, approval and preservation controls applied.
CCACM formally opened 193/2026, served the interested parties and received later material. On 26 June it said a submission would be joined to the file but recalled Article 118.1 of Law 39/2015: there is no indefinite reply chain, and facts or documents that could have been produced earlier may be left out.
Consequence: this page is a decision aid, not a new filing. Any future submission should answer an institutional request or identify a genuinely supervening, dated, essential fact that was not previously available.
CCACM may uphold in whole or part, dismiss or reject as inadmissible. If it identifies a formal defect and should not decide the merits, it may order retroaction to the point of the defect.
| Item | Demonstrated knowledge | Boundary |
|---|---|---|
| 434/26 and archive | They form part of the transferred file and opened appeal. | The archive rested on limitation; it did not decide the merits. |
| Íñigo de Luisa and Juan Antonio Ruiz submissions | They argue the core was the 2019 note/cambiario and later steps were automatic. | This is the respondents' position, not a CCACM finding. |
| Identified 2024–2026 steps | 70% adjudication, reservation of assignment to a third party, opposition to suspension/expert review and later reiterations. | Existence is not misconduct; the issue is automatic consequence versus new professional choice. |
| 21 August substantive supplement | CCACM replied “RECIBIDO” on 25 August at 11:57:23 UTC. | Receipt is not admissibility, agreement or evaluation. |
| Two visual indexes | CCACM separately replied “RECIBIDO” at 11:57:27 UTC. | They do not replace primary sources or prove responsibility by association. |
| Defence | Current strength | Neutral test |
|---|---|---|
| The note and cambiario were instantaneous 2019 acts. | Strong against a standalone charge based only on 2019. | Separate persistent effects from later acts with their own date, author and content. |
| The 23 June 2025 letter was legitimate defence. | Plausible. | Use it as position traceability, not an automatic charge. |
| Later enforcement was automatic. | Factually contestable given requests, opposition, reiteration and assignment reservation. | Identify what the title required and what involved a new choice. |
| Gil, as Matkator's administrator, knew of the litigation. | Relevant to general knowledge. | It does not itself prove notice, consent to the particular note use, or correct client/payer/debtor attribution. |
| A cordial December 2021 message contradicts repudiation. | Contextual. | Distinguish cordiality, knowledge of litigation and knowledge of the disputed professional basis. |
| No information use or connected assignee has been proved. | Currently strong. | Preserve as absence of proof and permit exculpatory explanation; do not reverse the burden. |
| ETJ acts belong territorially in Tenerife. | Strong for court acts carried out there. | Separate territorial action from professional-firm decisions or registering-Bar controls. |
Íñigo de Luisa: prior professional relationship/knowledge, the preserved 6 March 2026 LinkedIn message and CCACM submissions. The message records the sender's own statements; it does not prove the Madrid Bar outcome, deletion, dissemination, professional misconduct or firm-wide responsibility. Do not attribute ETJ filings without proof of instruction, authorisation or ratification.
Juan Antonio Ruiz: 23 June 2025 letter and submissions. Do not attribute LinkedIn or ETJ acts without evidence.
Teresa Morenés: electronic signature on reviewed ETJ filings. Signature proves action, not the upstream decision chain.
The complaint arose from a substantial billed professional relationship, and earlier correspondence sometimes spoke in the firm's voice and invoked internal rules. That makes capacity and professional context answerable; it does not turn every personal sentence into firm advice or prove ETJ instruction.
A same-day preservation communication to a firm channel makes receipt, preservation, escalation, conflict, access and risk handling finite questions. Sending is not proof of receipt, investigation, ratification, silence or admission.
The message becomes an expression of the firm only upon proof of instruction, authorisation, adoption, ratification, use or directly imputable governance failure. Partner status and context alone are insufficient.
Controlled classification: documented individual statement in a Cuatrecasas professional-engagement context; potentially relevant to firm knowledge and governance, but not yet proved to be an authorised, adopted or ratified Cuatrecasas corporate statement. Its connection to La Laguna is a discovery and governance bridge—not proof of procedural fraud or remate-recipient identity. Open the complete ETJ–remate–hotel–complaints analysis →
Decide on the existing record; assess whether the limitation archive rested on a sufficiently delimited object; and, if a formal defect exists, partly uphold and order retroaction for preliminary information. No need to decide debt, ETJ merits, damages or crime.
ICAM states that a complaint may be archived, sent to preliminary information or lead to a disciplinary file. The Statute permits preliminary information and gives the registering Bar competence over professional firms. The check can be limited to the eight questions.
If it received 1487/26, it can delimit court acts carried out in its territory and the individual conduct of those signing or directing them, without automatically assuming Madrid or professional-firm modules.
Territorial competence should allocate the examination rather than evaporate it. A reasoned decision can assign each module, preserve dates and explain exclusions.
Cuatrecasas publicly describes a Code of Ethics and Professional Conduct applying to partners, lawyers and staff, subscription every three months, information-security policies, compliance structures and an Ethics Communication Channel. That does not prove how controls worked here; it supports a neutral question:
How was the firm's published governance architecture applied to this matter? The answer may exonerate, narrow or confirm the need for further examination.
As a non-binding comparison, the English regulator requires firms to maintain governance, systems, controls and records demonstrating compliance, with manager accountability for those systems. It is not Spanish law; it is only a model for questions and traceability.
The examination should close or narrow if records show that Matkator was correctly the debtor; the note basis and authority were clear; no material secrecy risk existed; sufficient conflict analysis, effective barriers and an independent team were in place; later steps were ordinary consequences of the title; adjudication and any assignment were properly authorised without a connected third party; and no former-client information was used to gain improper advantage.
An examination capable of exonerating is more institutional than a communication designed only to confirm an allegation.
| Question | Status | Next proof |
|---|---|---|
| Is 193/2026 decided? | No final resolution located; two separate 25 August acknowledgements are recorded. | Later procedural order or final decision. |
| Did the second appeal reach CCACM? | RE-007622/26 filed and 1566/26 generated; forwarding not certified. | ICAM outgoing certificate and any CCACM number. |
| Did Tenerife receive 1487/26? | Referral order established; territorial receipt not located. | Acknowledgement or local number. |
| When should anything further be filed? | An open-ended reply chain must be avoided. | Only on institutional request or a genuinely supervening essential fact, explaining why it was unavailable earlier. |
