# E.G. 745/2026 — DP 1901 supervening-event successor patch — 18 September 2026

**State:** DRAFT / NOT FILED
**Purpose:** integrate the 14 September DP 1901 order and the newly evidenced 29 July Fiscal archive request into the 12 September E.G. 745 reposición package without rewriting the source history.

## A. Insert after the opening scope paragraph

### HECHO SOBREVINIENTE — DP 1901/2026

## B. Ground One — replace conditional formulation

## C. Ground Three — judicialisation correspondence

Add:

The 14 September order makes the identity question more acute rather than resolving it. The June/July source closure now permits a more precise statement:

- the 18 June stamped daily-reference-24 cover is a separate judge/judicial-conduct complaint intended for the TSJC Civil/Criminal route;
- the 25 June stamped daily-reference-21 cover is a new autonomous five-private-actor complaint;
- the separate 25 June 13-page supplement expressly belongs to daily reference 24;
- contemporaneous 25 June correspondence reported daily reference 24 still at Decanato; this remains a party report, not an official reparto certificate;
- on 9 July ATLANTE officially displayed DP 1901/Plaza 6 and DP 1956/Plaza 1 with Gil Marer as denunciante, without identifying defendants/subject;
- a separate Decanato-stamped 9 July cover proves that private-actor amplification/documentary material was physically tendered under DP 1901/Plaza 6;
- contemporaneous 12 July counsel correspondence reports that Plaza 6 was being approached regarding “la denuncia contra CAM y la CP” identified as 1901/2026;
- the signed 12 July providencia nevertheless linked that same DP/NIG/IUP to DIP 2/2026;
- the 14 September Auto later treats DP 1901 as alleged judicial prevaricación.

This materially proves a procedural-identity collision but still does not certify its direction. Inspección should obtain the initiating document, official reparto/index, scan/ingestion metadata, document-to-NIG association history and every joinder/reassignment/segregation event before treating “judicialisation” as a complete answer for distinct factual modules.

## D. Ground Six — independence / circularity

Add:

The 29 July report is a later prosecutorial act that can now be individually located. Any responsibility remains actor-specific. Inspection should identify who authored it, what that Fiscal received, what object he/she understood DP 1901 to have, what contrary sources were available, what reasoning supported dismissal, and whether any superior review or instruction occurred. A lawful prosecutorial explanation must be preserved and tested.

## E. New evidential references

- **D36** — Auto DP 1901/2026 dated 14 September 2026; current source: received copy/image; native/certified court file still to be obtained.
- **D37** — legal notification/receipt metadata for D36; OPEN.
- **D38** — signed Ministerio Fiscal report dated 29 July 2026; OPEN / EXISTENCE-DATE-REQUESTED-OUTCOME ESTABLISHED BY D36, CONTENT/AUTHOR/CORPUS NOT YET PRODUCED.
- **D39** — certified DP 1901 docket/index + initiating document + Control 21 / Control 24 reparto trace; OPEN.
- **D40** — corpus digitalizado DIP 2/2026: denuncia 13 enero, ampliación 8 febrero, Decreto 6 marzo, oficio 9 marzo, actualización 11 marzo y REGAGE26e00026303869; fuentes controladas individualmente.
Control: `evidence/judicial/dp-1901-2026/PROCEDURAL_IDENTITY_SOURCE_CLOSURE_18SEP2026.md`.

## F. Additional relief

Request expressly:

1. complete D38;
2. author/signatory and functional assignment;
3. corpus made available and transmission index;
4. any review/visado/instruction;
5. certified DP 1901 docket;
6. initiating document and reparto;
7. reparto/destination records for daily references 21 and 24, including the 18-Jun–12-Jul scan/ingestion and document-to-NIG association history;
8. every joinder, reassignment, accumulation or segregation act;
9. the 29 July report's treatment of the DIP 2/2026 appeal-history correction;
10. preservation of relevant ATLANTE/registry/email routing traces;
11. complete certified DIP 2/2026 file and separate 11 February opening decree;
12. evidence of receipt, incorporation, handler/access and substantive treatment of REGAGE26e00026303869;
13. certification of exactly which DIP 2 materials, including any correction, were transmitted or made available in DP 1901 before the 29 July Fiscal report;
14. certified confirmation of whether the 9-Jul private-actor amplification was electronically incorporated, what parent complaint it was associated with, and whether it formed part of the corpus supplied to the Fiscal.

## G. Attribution boundary

Gil Marer and Aweswell Limited maintain their attributed adverse posture toward Ministerio Fiscal/Fiscalía and allege a wider institutional-neutralisation/protection mechanism. The repository and filing should state this allegation directly while preserving that the 29 July dismissal request, without its underlying report and corpus, is not itself proof of capture, prevaricación, coordination or criminal guilt.

## 19 September clarification — factual continuity only

Read the 19-September presenter's-clarification addendum in `archive/DP1901_EG745_FISCAL_REPORT_ROUTING_COLLISION_CONTROL_18SEP2026.md` and the `presenter_clarification_20260919` field in the existing three-track control. Preserve Gil's firsthand paper-custody account, his categorical private-actor-first position, the uncertainty in the date of his AC-opening confirmation, and the separate missing official electronic chronology. Include Ref22/DP1956 in the comparative production scope without alleging that it was the correct destination for Ref24. Keep the 14-Sep Auto's contrary origin characterisation visible. This source update is not filing, service, counsel adoption or a deadline determination.

## H. 19 September successor — competence + Fiscal Superior escalation

### H.1 No presumption of regularity

For the successor filing, do not start from a factual presumption that the DP1901 Fiscal act, Plaza6 treatment, Provincial Fiscalía conduct, Community Fiscalía conduct or internal routing were neutral, lawful, independent, in good faith or free from influence. Those are matters to be established from actor-specific records.

Likewise, do not convert suspicion into adjudicated criminal guilt. The test is:

**ACT → AUTHOR → OFFICE → ASSIGNMENT → CORPUS → DUTY/COMPETENCE → KNOWLEDGE → CONTRADICTION → NOTICE → POST-NOTICE CONDUCT → REASONING → LAWFUL ALTERNATIVE → EFFECT → BENEFICIARY → EXCULPATORY EVIDENCE → CULPABILITY INFERENCE.**

### H.2 Prior institutional competence position

DIP2/2026 is now a central prior institutional competence source, not a background reference. Its 6-Mar Decreto records the TSJC/aforamiento route for alleged in-office criminal conduct by the Concurso judge and states that the competent Fiscalía is the Fiscalía corresponding to the tribunal of aforamiento.

The E.G.745 successor should therefore require an explanation of the later DP1901 sequence:
- Ref24 was a separate judge-related filing addressed to TSJC Sala Civil y Penal;
- Ref21 was a separate private-actor complaint;
- July sources operationally mapped DP1901 to the private-actor lane;
- 12-Jul Plaza6 linked DP1901 with DIP2;
- 29-Jul a Fiscal requested merits archive;
- 14-Sep Plaza6 treated DP1901 as alleged prevaricación and ordered sobreseimiento libre.

### H.3 Three-branch identification of the 29-Jul Fiscal

**Branch A — Fiscalía Provincial de Las Palmas:** require author, assignment, legal/functional basis, corpus, competence analysis, and any delegation/substitution/instruction.

**Branch B — Fiscalía de la Comunidad Autónoma de Canarias:** require author, assignment, corpus and explanation why the office that articulated the aforamiento rule in DIP2 later sought merits archive from Plaza6 without a produced competence bridge.

**Branch C — another Fiscal/Fiscalía:** require identity, office, assignment authority, statutory basis, corpus, reasoning, visado/instructions and relationship to DIP2.

Across all branches ask:

### H.4 Double prejudice

E.G.745 must expressly examine both possible harms:

1. **Ref24 / judge lane:** possible departure from the TSJC/aforamiento route and merits disposal without a produced competence bridge.
2. **Ref21 / private-actor lane:** possible absorption, shadowing, reclassification, fragmentation, segregation without accessible record, or ambiguous exposure to the sobreseimiento libre.

Do not allow the answer “DP1901 was judicialised” to substitute for certified identification of the initiating document, object, parties and current destination of Ref21.

### H.5 Immediate Fiscal Superior communication

A separate urgent notice is now a coordinated track:

`drafts/fiscalia/2026-09-19_FISCAL_SUPERIOR_DP1901_URGENT_NOTICE_DRAFT.md`

Current Fiscal Superior is source-verified as **Jaime Serrano-Jover González** (Real Decreto 428/2026, 27 May 2026).

The EOMF controls cited for the escalation are:
- art.13.2 — ordinary inspection of Fiscalías in the territorial area;
- art.22.4 — representation and headship of Ministerio Fiscal throughout the Autonomous Community;
- art.22.7 — hierarchical subordination of Provincial Fiscal chiefs to the Fiscal Superior.

The notice is **DRAFT / NOT FILED** unless an official receipt proves otherwise.

### H.6 FGE/Inspección incorporation cover

Use:
`drafts/fiscalia/2026-09-19_EG745_FISCAL_SUPERIOR_INCORPORATION_COVER_DRAFT.md`

It should request association/incorporation into E.G.745 as a supervening event but state expressly that it is not the E.G.745 merits response itself.

### H.7 Additional production/preservation

Add requests for:
15. identity and office of the 29-Jul Fiscal;
16. assignment/reparto and assigning authority;
17. any delegation, substitution, avocación, visado or superior instruction;
18. explicit competence analysis, if any;
19. complete object/party metadata history of DP1901;
20. certified current destination/status of Ref21;
21. preservation of any inter-office Fiscalía transmission linking DIP2, Provincial Fiscalía and DP1901;
22. preservation of relevant institutional email headers/attachments and system access/routing metadata where lawfully retained;
23. confirmation whether the 11-Mar DIP2 correction was available to the 29-Jul Fiscal;
24. a non-circular independent review of the act, rather than sole reliance on the same decision chain under examination.

## E. ADDENDUM 20 SEP 2026 — IDENTIFICACIÓN INSTITUCIONALMENTE DETERMINABLE Y NO FRAGMENTACIÓN

**Estado:** DRAFT / NOT FILED.

- art. 164.1.b permite diligencias informativas cuando pudieran existir indicios pero no consten suficientemente la identidad u otros elementos necesarios;
- art. 167 limita esas diligencias a lo imprescindible para comprobar verosimilitud, concretar el posible carácter disciplinario y **determinar la identidad** del presunto autor o autores, pudiendo reclamarse documentos y practicarse diligencias pertinentes;
- art. 165 permite archivo motivado, expediente gubernativo o **remisión al órgano competente** según naturaleza y objeto;
- art.
