# Sun Park Montelanza / Molina / historical Community perimeter

**Control date:** 19 August 2026
**Status:** source-led reconstruction; factions must not be collapsed into one undifferentiated “Molina” group

## 2008 root-cause hierarchy — Gil Marer's attributed position and source limits

Gil Marer's controlling position of 22 August 2026 is that the **originating private root-cause layer** was the combination of omissions and acts of an actor-specific seller/minority perimeter associated, at different dates and in different capacities, with **Montelanza, S.L. and named Molina-linked owners/entities**: the allegedly incomplete or frustrated 2008 asset/exploitation restructuring, later non-adherence to the common exploitation structure and the subsequent exploitation/Community conflict.

This is an **ATTRIBUTED CAUSAL POSITION:GIL**, not a finding that every Montelanza or Molina-linked person acted together, breached the same obligation or caused the whole later loss. Gil supplied the present clarification in text while identifying himself. That is a basis for conversational text attribution, not biometric voice authentication; any audio used to prove the speaker requires its own provenance and authentication.

The current record materially supports, but does not complete, that hierarchy:

1. the 2008 transaction was publicly presented as a transfer of Sun Park property and operation, while the located record points to asset-by-asset transfers and separately formed CEXP rather than a proved sale of Montelanza, S.L. itself to Multimatrix;
2. the 29-Apr-2008 CEXP meeting recorded 74.90% approval and 10.01% opposition/reservation, and the 26-May instrument transferred defined exploitation to CEXP; the unit-level accession schedule remains missing;
3. a 27-Apr-2009 Campanario email contemporaneously described a defined Molina-linked group as not interested in adhering to CEXP and proposing an alternative one-year rental arrangement; that proves a pre-existing split, not unlawful breach;
4. the 2-Feb-2011 record places Álvaro Campanario inside the Community governance/litigation architecture for much of the later JV 1260 claimant perimeter; and
5. the 22-Jun-2011 ACTA records LPB's substantial represented coefficient outside the vote-entitled list, while historic debt/cost attribution, recovery, CEXP maintenance, Pamanil and governance measures were addressed.

The legally and forensically safe hierarchy is therefore:

`2008 STRUCTURAL / SELLER-COMPLETION QUESTION`
→ `OWNER-BY-OWNER CEXP ACCESSION / NON-ADHERENCE`
→ `2011 DEBT / VOTE / AUTHORITY MECHANISM`
→ `LATE-2011 / EARLY-2012 OPERATOR AND POSSESSION LITIGATION`
→ `EMERGENCY MONTERECCO/PINK RESPONSE`
→ `BANKIA EXECUTION / SCHEDULED AUCTION AS IMMEDIATE FILING TRIGGER`.

Each arrow remains a proposition to prove. Do not state as established fact an exact `c.23% breach`, a common dishonest intention, that the minority alone caused LPB's insolvency, or that the 2008 seller/exploitation dispute displaced the distinct contribution of the Bankia financing/enforcement package, professional advice, operating decisions or market conditions.

### Mandatory adverse evidence

- CEXP participation was recorded as voluntary/open and some later claimant-side entities opposed or reserved; no source yet proves CEXP title over every later claimant unit.
- AP 89/2014 recognised the individual title/possessory position of the seven-claimant, 18-unit perimeter and reversed the first-instance Monterecco result; 88.96% CEXP participation did not itself authorise those units.
- LPB's challenges to the 2011 Community acts have adverse procedural history that must remain visible.
- The 1-Feb-2012 CEXP–Monterecco notice and Monterecco/Pink's real historical operation/administrative position contradict any assertion that no transfer instrument or factual operation existed.
- Bankia's mortgage enforcement and scheduled auction, not the seller/minority thesis alone, are the presently documented immediate timing trigger for the defensive 2012 filing.

## 22 June 2011 — primary representation map

|---|---|
| Trebor Hillary Cristine | 603 |
| Mariano Palacios | 511 |

| Muruga, S.L. | 504 |
| Inversiones Salinetas, S.L. | 512, 513, 514, 902, 903, 904, 905, 562, 563, 564, locals 5 and 6 |

### Represented by Asunción Aizpurúa Sánchez

| Owner/entity | Unit(s) |
|---|---|
| Francisco Molina | 503, 908 |
| Acciones Canarias, S.A. | 907, 553 |
| Miguel Molina | 911 |

### 2011 governance facts

- The controlled source records AAS as elected/acting President by 2 Feb 2011; Gil disputes the legitimacy of that office and every act-specific authority proposition remains open.
- The controlled source records FMMM in Community Administrator functions by 22 Jun 2011; Gil disputes the legitimacy of that appointment/mandate and each act remains separately auditable.
- Montelanza was already an owner/entity in the Community record.
- The source shows multiple separate owners and representatives. Do not treat all Molina-named people as one person, company or faction.

## 10 April 2014 — notarial Community record

- Antonio Cogolludo Rojas represented Cristina Molina Petit.
- Juan Carlos Prieto Puente represented AAS / Roque Prieto, S.L.
- Antonio Peñate represented J.S.P. and Montelanza.
- Manuel Molina Climent attended as an owner.
- Ray Simon Thompson attended.
- LPB attended through Gil Marer.
- The meeting record separately identifies Community, owner and representative roles.

## 19 November 2015 — representation map

The surviving act records, among other participants:

- AAS represented Francisco Molina Molina, Miguel Molina Betancor and Carlos Caimi Vicente.
- Antonio Cogolludo Rojas represented Cristina Molina Petit.
- Octavio Marrero Molina represented Acciones Canarias and Muruga, S.L.
- Emilio Molina represented Amenem / Ten Golf.

## Montelanza historical control

The 28 August 2014 record states a historical exploitation chain involving Sol Lanzarote, Montelanza and the later Community of Exploitation. It also refers to records from Montelanza's exploitation management and to Anastasio Molina. These are source-authored historical statements requiring the underlying contracts/accounts for complete verification.

The present public naming of Garrigues and request that it provide witness evidence should be used to recover what the firm was told about this historical chain, which actor/unit obligations it reviewed and what it understood about CEXP, non-adherence and the 2011 authority dispute. Garrigues testimony cannot substitute for the seller→finca→commitment→completion map or turn Gil's root-cause position into an adjudicated fact.

## Molina faction discipline

Use the following structure in all future work:

`person → entity/units → representative → lawyer → meeting/proceeding → date → sourced position`

Never use:

- `the Molina family` as a substitute for named parties;
- `Molina dissidents` without listing who, when and against which resolution/party;
- a family relationship as proof of shared legal strategy;
- one person's representation as proof of authority for another.

## Open reconstruction questions

1. Are Francisco Molina and Francisco Luis Molina Molina the same person?
2. Are Miguel Molina and Miguel Molina Betancor the same person?
3. Is Concepción Molina Marrero the same person as María Concepción Molina in the 2018 list?
4. Which exact units/entities formed each Molina-aligned bloc at each meeting?
5. Which powers were used by AAS, Antonio, Octavio, Emilio and other representatives?
6. Which lawyers acted for each named person/entity in P.O. 562/2014, P.O. 213/2015 and the 26 Apr 2016 challenge?
7. What is the exact corporate history of Montelanza, J.S.P./José Sánchez Peñate, Acciones Canarias and Ten Golf/Tengolf?
8. Which seller/entity committed to convey each finca or exploitation right in 2008, what completed, what did not, and what contractual remedy followed?
9. What did Garrigues receive, review and advise about that actor-specific chain before and after the 1/6-February-2012 instruments?
