# Gil / Pamanil / AEAT / Pink — critical unitary reanalysis

**Date:** 22 August 2026
**Status:** CANONICAL CONTRADICTION AND CLARIFICATION CONTROL
**Scope:** Gil's Declaration 009, the reserved declarant's Declaration 005, 2008 CEXP sources, JV 1260/2011/AP 89/2014, the 2017 handover record, Auto 804/2018, AEAT source material and PO 496/2026.

## Result in one paragraph

Gil's narrower case is materially stronger than the absolute formulations it replaces. The located record supports investigating whether Pamanil's claimed integrated-maintenance role lacked actual performance; whether Community administration, debt, certificates, security and litigation were used for an ulterior purpose; whether AP 89/2014 and Auto 804/2018 collapsed entity, key, access, possession and authority distinctions; and whether AEAT overread Acosta Matos statements and circumstantial provider/payment evidence. It does **not** yet prove that every Pamanil act was criminal, that all owners unanimously conferred CEXP authority, that the Pink contract is judicially null in its entirety, that Pink never possessed or delivered any physical key, that AEAT relied exclusively on two informants, that the unnamed male was José Daniel Acosta Matos, or that the AC/judges acted criminally.

## Main contradictions and required clarification

| ID | Gil / reserved-declarant proposition | Current evidence result | Required clarification or proof |
|---|---|---|---|
| GPC-01 | Pamanil “did nothing”. | **Contradicted literally.** Communications, notices, Community administration, certificates, litigation, security/access activity and some Community-side payments/services existed. No located source proves Pamanil itself provided the claimed integrated hotel workforce, supplies and maintenance. | Use: “No located proof of Pamanil's integrated-maintenance performance; Gil alleges each proved act was criminally instrumental.” Obtain complete Pamanil file. |
| GPC-02 | Every Pamanil act was fraud/economic crime. | **Controlling allegation, not proved universal fact.** A real administrative act can still be criminally instrumental, but existence alone proves neither guilt nor innocence. | For every act: human actor, capacity/principal, objective falsity, knowledge, intent, reliance, effect, benefit and innocent alternative. Identify the offence and jurisdiction separately. |
| GPC-03 | All participating owners / all owners act through the Owners' Community to confer the exploitation mandate on CEXP. | **Controlling authority-chain position; unanimity not shown.** Gil now defines the asserted chain as `owners → Owners' Community acting lawfully → CEXP`. The 29-Apr-2008 source records 84.988% present/represented, 74.90% in favour and 10.01% opposed/reserved. | Treat “all owners” as the universe entitled to participate through the organ, not documented unanimous assent. Prove the exact organ, call, quorum, majority, affected rights, fincas, proxies and binding threshold. Do not merge the Owners' Community with CEXP. |
| GPC-04 | The Owners' Community was the only legally possible organ through which an operator could be appointed. | **Legal proposition requires refinement.** Ley 7/1995 art. 39 requires prior enabling title from the owners and expressly recognises direct owner operation including an Owners' Community; it does not, by its text alone, establish the exact unanimity/organ route Gil asserts. | Ground the route in the 1987 statutes, 2008 resolution/CEXP statutes, horizontal-property rules and unit-specific title—not in art. 39 alone. |
| GPC-05 | The 6-Feb-2012 LPB–Monterecco contract was wholly void *ab initio*. | **Serious but unadjudicated party position.** Supporting theories include lack of authority over CEXP/third-party/common rights, imperative tourism rules, impossible or unlawful whole-hotel object/cause and indivisibility. | Obtain independent opinion on Civil Code arts. 6.3, 6.4, 1255, 1257, 1259, 1261 and Ley 7/1995 arts. 38–42; prove why LPB's own-unit rights cannot survive separately. |
| GPC-06 | Total nullity necessarily follows from breach of unity of exploitation. | **Not established.** Art. 42 specifies administrative consequences; Civil Code art. 6.3 preserves a different statutory effect. LPB could prima facie contract over its own rights; the contract contains a severability clause; operation and later judgments are adverse evidence. | Explain why the essential cause was indivisible and why administrative noncompliance, partial ineffectiveness, severance, restitution or apparent authority are inadequate alternatives. |
| GPC-07 | Pink never had “the keys” or delivered any keys. | **Directly contradicted if read literally** by the facially signed 22-May-2017 Pink→LPB instrument. | Gil must address authenticity, signatures, inventory, physical exchange, purpose and scope. Sustainable interim position: no CEXP maintenance/master set and no lawful whole-hotel transfer authority. |
| GPC-08 | The May-2012 and May-2017 events are one key narrative. | **False conflation.** May 2012 involved CEXP maintenance copies in JV 1260/2011; May 2017 involved a separate facial Pink→LPB access-key instrument. | Maintain separate evidence tables and never use one event as automatic proof of the other. |
| GPC-09 | AP 89/2014 proves Pink had hotel-wide authority. | **Overreading.** It adversely inferred Monterecco possession/operation for 18 claimant units and reversed the first-instance absolution; it did not adjudicate universal whole-hotel authority. | Recover the complete certified appellate evidence package and the missing signed receipt/notarial record. CR-066 now corrects the former AP 16/2014 duplicate/misidentification. |
| GPC-10 | Auto 804/2018 or the 2017 handover proves lawful Community/CAM whole-hotel title. | **Overreading.** Auto 804 affirmed provisional criminal archive using AC authority/testimony and the 2017 narrative; it was not a civil/tourism/title judgment and contains date/capacity compression. | Preserve the adverse procedural outcome; test exact access instructions, third-party units, locks, authority and later use separately. |
| GPC-11 | AC/judge reliance on the Pink contract or handover was necessarily bad-faith/criminal. | **Not proved.** The contract, actual operation, 2015 judgment, LPB filings, signed 2017 act, Gil emails and the reserved declarant's 2018 account gave facial reliance grounds. The AC later used the handover in the 2019 calificación report. | Prove actor-specific knowledge of material falsity, intent, decisive reliance, causal error and benefit/harm. Invalidity or judicial error alone is insufficient. |
| GPC-12 | AEAT was “100%” based on two false Acosta Matos witnesses. | **Contradicted by the official file.** Inspection began in Dec-2020; AEAT also used invoices, electricity, laundry, Matkator payments, registrations, missing returns/books, the reserved declarant's statements/non-response and indirect estimation. | Use: “Acosta statements were material corroborative narrative evidence expressly adopted despite admitted date inaccuracies; not the origin or sole evidence.” Test each statement against each assessment step. |
| GPC-13 | Laura Patricia Acosta Matos and José Daniel Acosta Matos are both positively identified AEAT sources. | **Only partly supported.** The diligence names Laura Acosta Matos. The male is unnamed. `Laura Patricia` comes from collateral identity evidence; José Daniel is Gil's leading hypothesis. | Obtain the unredacted diligence, officer notes, call/contact metadata, corporate channel records and witness identification. |
| GPC-14 | The Audiencia Nacional has accepted or rejected the Pink tax merits. | **False.** PO 496/2026 is pending; Auto 426/2026 refused interim suspension only. | Reconcile the express AEAT inadmissibility of 29-Sep-2025 with the AN's presumed-silence posture and verify whether the claim was expanded to the express act. |
| GPC-15 | The reserved declarant's account can be adopted as one joint final truth statement. | **Unsafe.** Her direct observations remain material, but the 2011 chronology, Pamanil succession, Community/CEXP duties, Pink perimeter, keys, contract amounts, set-off, document custody and AEAT provenance require correction. | Read Declarations 005–010 together; Gil adopts only what he confirms. Preserve the native dictation privately and seek proposition-by-proposition ratification. |

## Source-controlled event separation

### May 2012 / AP 89/2014

- Original JV 1260/2011 claim: CEXP, 18 claimant units.
- 23-Feb-2012: claimants expanded against Monterecco.
- Sentencia 122/2012: eviction against CEXP after qualified submission; Monterecco absolved for insufficient proof.
- May-2012 correspondence: obligation and copies attributed to CEXP maintenance.
- 28-May-2012: physical deliverer unresolved; contemporaneous email says Gil had left and a guard would deliver.
- AP 89/2014: reversed Monterecco's first-instance result through an adverse possession/operation inference limited to the 18 units and historical record.

### May 2017 / Auto 804/2018

- April/May-2017 filings distinguish cessation of new commercialisation, existing stays, supplies and preservation.
- 22-May-2017: facially signed Pink→LPB access-key/possession instrument.
- Auto 804/2018: affirmed provisional criminal archive, relied on AC testimony/authority and the 2017 narrative, and was adverse to CEXP's asserted possession.
- 11-Feb-2019 AC calificación report: direct downstream use of the 22-May premise.
- Sentencia 163/2023: direct adverse Pink/rent result and €3,032,010.34 consequence, appealed; causation from the handover alone is not proved, and the judgment rejected a separate uncorroborated connivance branch.

### AEAT / Audiencia Nacional

- 29-Jul-2020 inspection-plan inclusion; 2-Dec-2020 inspection commencement.
- 7-Oct-2021 first act with provisional result €0.
- 22-Mar/6-Apr-2022 site visit/diligence containing Acosta Matos statements.
- 14-Sep-2022 assessment: €106,647.96.
- 3-Mar-2023 sanction: €117,803.64.
- 2023–2024 subsidiary-liability route against the reserved declarant; personal amounts and identifiers remain outside the public control note.
- 29-Sep-2025 AEAT express inadmissibility; contested electronic service.
- PO 496/2026; 6-Jul-2026 interim suspension refused; merits open.

## Immediate questions for Gil

1. What exact physical keys were covered by the 22-May-2017 document, who supplied them, and why did you sign or appear to sign receipt and possession if Pink had none?
2. Do you challenge that document's authenticity/signatures, its wording, or only its legal capacity and scope?
3. Gil has clarified that “all owners” identifies the universe entitled to act through the Owners' Community, while the operative proposition is a valid collective resolution conferring the mandate on CEXP. Which exact organ, rule and threshold made that resolution binding on each participating/affected right despite the recorded 10.01% opposition/reservation?
4. Which exact organ approved the 1-Feb-2012 CEXP→Monterecco notice? If none, do you say Pink could have acted only as CEXP's service agent and never as independent explotadora?
5. Which clauses make the 6-Feb contract indivisible, notwithstanding LPB's own units and clause 15 on partial nullity?
6. For each Pamanil act already located, who was the human actor, principal, alleged false representation, intended offence, recipient, reliance, benefit and loss?
7. Which Acosta statement is false word for word, what primary record disproves it, where did AEAT adopt it, and what assessment amount would disappear without it?
8. What primary evidence identifies the unnamed male as José Daniel Acosta Matos?
9. Has Pink formally expanded PO 496/2026 to challenge AEAT's 29-Sep-2025 express inadmissibility after it surfaced in July 2026?
10. Which precise AC/judge act is alleged criminal, what knowledge source predates it, and what non-criminal explanation does the evidence exclude?
