# Cuatrecasas whole claim / professional perimeter — 27 September 2026

Canonical workspace: **^PD-CAN-BAR-PERIMETER-20260921-01**. Consejo reference: **RE-000329**. This is an additive, public-safe source reconciliation, not a new complaint or finding. Native correspondence, financial instruments, private locators, counsel advice and working legal strategy remain in controlled private custody.

Later GitLab whole-claim, WIP and invoice/payment controls, bilingual readers, viewer/validators and directly linked graphs are reconciled into paths absent from the observed GitHub base. This does not claim whole-repository parity. The cross-host manifest records source hashes and the bounded scope. Historical August controls remain available; these later amount/state corrections govern the reconciled subject.

## Strong institutional proposition / proposición institucional

**Responsabilidad separada no significa realidad separada.** Gil Marer and AWESWELL LIMITED allege a continuing pattern in which private actors use economic incentives, fee dependencies and procedural pressure to compromise protective mandates, isolate the affected investor and consolidate control of income-producing assets. Alleged civil, criminal and deontological breaches require actor-specific investigation. A documented episode is not automatically proof of improper incentive, common purpose, knowledge, intention or causation. The present complaint does not target Armando Betancor Álamo, his team or Joaquín Ruiz de Infante Abella; their work and records provide mandate/custody context.

## Source and contrary-evidence matrix

| Control / source | Bounded result | Contrary record / open proof |
|---|---|---|
| `CUA-WIP-SRC-001` · native 3-Jul-2019 firm table | 22 invoice faces €327,608.32; six unpaid €136,830.72; WIP €61,404.95 + €31,020 + forward estimate €60,000 | Face total includes settled items. Estimates are not earned debt. Original/reissue counts once; a €1,000 retainer changes the schedule comparison. |
| `CUA-WIP-SRC-002` · native 15-Jun-2020 Collections | €161,738.75 performed/unbilled separately from €136,830.72 unpaid bills; approximate €400,000 wording | Underlying ledger, tax basis and reconciliation missing. Do not assume blanket 21% VAT; native invoices include reverse-charge treatment. This €400,000 is not the insolvency transaction's identically rounded amount. |
| Invoice 1810219093 / WIP controls | Accrued €97,492.50 less invoiced €30,000 = €67,492.50; later 2018 WIP €61,404.95 | €6,087.55 gap requires ledger. Difference does not prove fabrication. |
| Native 18-Feb-2022 firm demand / whole-claim register | Two claimed principals €189,830.72 and €182,517.72; firm rounded grouped principal/interest/cost demand €441,463 | Do not add WIP/invoices/notes again. First principal reconstruction includes two proformas totalling €53,000; underlying proformas and complete first-claim docket remain required. |
| `CAMB-1048-2019-ORIGINAL-COURT-FILE-RECOVERED-2025-04-09` / two newly retrieved 83-page variants | Claim p.4 describes AWESWELL/LPB work and Matkator payment instruments; p.9 seeks both 8.584 and 8.588; pp.11–12 show four note faces dated 21-Nov-2018, all NO A LA ORDEN | Complete originals/backs, signing authority, cause, allocations and transfer remain open. Notes precede the July-2019 WIP schedule. Two current copy hashes differ from the legacy hash; no byte-identity claim. |
| Native Nov-2018 note correspondence; documented 2014–2020 work; withdrawal record | Firm contemporaneously described notes for pending invoices/incurred work; substantive rescue, finance, insolvency and litigation work occurred; unpaid fees were a stated withdrawal reason | Necessary contrary evidence to an assertion that work never occurred or the entire obligation was invented. Does not close every allocation or authority question. |
| 10-Feb and 3-Sep-2026 Cuatrecasas ETJ filings | Requests for adjudication and faculty to cede remate, extending an active 2024–2026 sequence | Request ≠ completed adjudication/cession/whole-credit transfer; no proved recipient or Acosta Matos destination. €77,840 credit / €104,677.72 remaining-principal scenario ≠ verified posting. |
| `PD-CIR-JTP-2020-01`; AC report dated 21-Jul-2021 p.4 | Knowledge/source concern → client warning → substitution → written approval requested → rejection → later AC-reported €26,750 July-2020 payment | JTP argued the procedural position had changed and estate-expense payment was permissible. Invoice, title, authorisation, ledger, debit/credit and later client approval remain open; no complete upstream bank chain. |
| PwC native Dec-2014 billing correspondence, 2016 mandate/work/instruction records; 19-Sep repository rescan | Client-requested billing-entity change was accepted; later Sun Park protective work and knowledge of client criminal-route instructions are documented | Do not generalise one fee arrangement across separate engagements. PwC also explained the civil challenge it was preparing. Client criminal characterisation is not PwC's independent criminal finding. |
| RICPE first-quarter-2021 report p.11; existing PwC entity/relationship controls | PwC tax due diligence for CAMSA's Merlín project is publicly recorded; separate dated RICPE audit/governance relationships remain documented | Merlín is another project. Exact team/entity, client, fee, payer, conflict controls and information use must be established. No retrospective institutional knowledge or proven loyalty-switch inference. |
| San Telmo full 30-Nov-2021 interview, 08:08–08:12; 2020 webinar and 2022 contemporaneous controls | Eduardo Sánchez acknowledged the firm's client-investor introductions into the RICPE investment connected to Sun Park, while the AC operated within the San Telmo professional perimeter | Preserve the specific investor bridge. Coordination with the AC, information transmission, exact subscriptions, commissions and conflict breaches are distinct open questions. |
| RSM official integration announcement; native 23-Sep-2026 Ethics & Independence reply | Integration and present review of additional August/September documents, with reconsideration of analysis, are verified | Integration names Javier Rodríguez-Batllori Laffitte, the brother identified in the controlled 2018 investigation report, rather than the AC Francisco de Borja himself. Their specific corporate connection is separately documented below. No automatic historical-liability transfer or finding of wrongdoing. Channel traceability was requested; substantive outcome remains pending. |
| San Telmo 2018 investigation report p.28 (private original); BORME 11-Sep-2018 entries 371214–371215; BORME 10-Jul-2024 entry 308341 | Report identifies Javier as the AC’s brother and says they worked in the same firm. Official registry separately records Francisco Javier’s professional-partner appointment, the AC’s 2018 administrator cessation, and the AC’s transfer of 500 shares to Francisco Javier / professional-partner revocation registered 3-Jul-2024 | The report is not a civil-registry certificate. Administrator cessation is not shareholder departure. Third brother not established. No automatic inference of shared files, knowledge, coordination, misconduct or AC employment by RSM. |
| Grant Thornton 29-Dec-2020 proposed engagement; existing controls | Proposed AWESWELL LIMITED forensic mandate, confidentiality and independence context | Execution of forensic work not established; later professional links do not prove misconduct. |

## Family / corporate correction — 27 September 2026

The name used in the official corporate record is **Francisco Javier Rodríguez-Batllori Laffitte**; RSM uses **Javier Rodríguez-Batllori Laffitte**. The client’s “Xavier” reference is resolved to that person. The controlled 2018 investigation report explicitly identifies him as Francisco de Borja’s brother and records their same-firm work on **page 28**. This corrects an interim conversational page-29 locator. No third brother at San Telmo is established. The three partners named in RSM’s integration announcement are not three Rodríguez-Batllori brothers.

The BORME originals were retrieved and hashed: 2018 PDF `509361f5a42537b6611209a95a2788d4ff91cec1583ab5b21ba141cb7e6d8b9f`; 2024 PDF `f066b0eb45fbff434c9510fcb876f53b4546e7ed8d8d5013ef9c2a1d549fda3e`. This partly closes existing `ST-GAP-02` for the named entries. The complete historical member/power/deed chain and transaction effective dates remain open. The private investigation report is retained in authorised private custody; no unrelated family detail is reproduced.

## Adversarial challenge and preservation

Lawful debt collection, actual unpaid work, client-approved billing changes, separate engagements, effective information barriers and no connected recipient are material alternatives to test. Conversely, those possibilities do not answer documented source warnings, rejected authorisations, same-asset investor introductions or continuing enforcement. Require the underlying record rather than presuming either misconduct or exoneration.

The AC-family link is `AC-CLM-011`; professional incidents remain in `PD-SP-COUNSEL-INCIDENT-REGISTRY-001`, including `PD-CIR-CUATRECASAS-2018-01` and `PD-CIR-JTP-2020-01`. Existing whole-claim/WIP gap IDs are retained. No new universal allegation register is created.

The two approved Spanish PNGs are untouched, with SHA-256 `6b3dfac14865f8bd9cdaf6eda6b610ff67175a96761f9d5ab7a0819b935643bf` and `f50790d29a0dc55521e03693b9023d55241212bbb4fd78977187dbe8bf544add`. No evidence PDF or email package is changed or sent by this repository update. The current wider workspace remains reconstructable from its canonical controls and private native sources; this bounded reconciliation does not certify that every historical artifact or backup has been recovered.

Reopen on any original instrument, first-claim docket, itemised WIP, ledger credit, assignment/beneficiary record, conflict/mandate file, professional response, institutional decision or later court act. Reconcile backward to the originating work/authority and forward to every affected claim, page and procedural use.
