# Concurso 36/2012 — decision-continuity audit, 2014–2026

- **Control ID:** `PD-C36-DECISION-CONTINUITY-20260828-01`
- **Control date:** 28 August 2026
- **Canonical data:** `assets/data/concurso36-decision-continuity-2014-2026-v1.json`
- **Public routes:** `es/concurso-36-2012-autos-resoluciones/#continuidad-2014-2026` and `en/insolvency-36-2012-orders-decisions/#continuity-2014-2026`

## Result

The repository now has one public-safe continuity projection joining the previously fragmented historical, transaction, classification and 2024–2026 specialist records. It begins in 2014, preserves separate proceedings and same-date instruments, and does not expose private provider or file locators.

The controlled result is **51 audit rows**:

- **28 core primary decision copies** in the 2018–2026 Concurso chain;
- **4 earlier in-case primary anchors**: the 20 January 2017 definitive-text order, 22 March 2017 composition-stage order, 5 May 2017 remuneration order and 19 December 2017 liquidation-opening order;
- **2 connected/contextual primary decisions** kept outside the core count: Judgment 89/2014 in the separate JV 1260/2011 / AP 89/2014 civil lane and Judgment 4/2026 in ORD 641/2024;
- **2 selected court-office act copies controlled**, with their production families incomplete; and
- **15 unresolved or partial family rows**.

The status remains:

> **PARTIAL — CERTIFIED DENOMINATOR AND DECISION FAMILIES STILL OPEN**

No certified chronological docket or equivalent official denominator has been obtained. A located decision copy closes only the decision-copy node, not the preceding filings, service, appeal, finality or implementation/accounting nodes. The audit is a judicial-decision/Providencia spine with two selected court-office acts; it is not a complete census of LAJ acts or filings.

## Corrections made by this audit

### AP 89/2014 is located but is not an in-docket Concurso decision

Judgment 89/2014 is already controlled and publicly transcribed in the separate JV 1260/2011 / AP 89/2014 civil lane. It is relevant context but must not be counted as an Auto or internal decision of Concurso 36/2012. The bare references `204/14`, `677/14`, `2418/14` and `5599/2015` remain unassigned until a certified court, class and parent-child relationship are produced.

### A primary-text copy of the 5 May 2017 remuneration order is located

The existing 2016–2021 court-file inventory contains `C36-JUD-2017-05-05-AC-REMUNERATION` as a located primary order fixing definitive Insolvency Administration remuneration for the common phase. The gap is now narrower: reconcile the two historical IDs used for that act, revalidate custody, and complete its request, hearing, service, extensions, invoices, payments and finality. It remains absent from the frozen 127-record catalogue and is surfaced through this additive projection rather than silently changing the frozen release.

### Four 2017 anchors are restored to continuity

The audit surfaces `C36-E002`, `C36-JUD-2017-03-22-OPEN-CONVENIO`, `C36-JUD-2017-05-05-AC-REMUNERATION` and `C36-E003`. The two long-form historical IDs are cross-walked to the earlier binary-register aliases. The controlled copies do not close their underlying applications, service, accounting or downstream implementation families. The frozen 127-record catalogue is not silently rewritten.

### Same-date decisions remain separate

The continuity projection maintains distinct rows for:

- the two Autos of 16 April 2018;
- the two Autos of 24 October 2019;
- the two Autos of 12 May 2020;
- the two Autos of 24 February 2021;
- the two Autos of 6 May 2021;
- the two Autos of 15 October 2021;
- the two Autos of 26 January 2022; and
- the two Autos of 12 September 2025.

The 13 January 2022 reference remains unconfirmed and cannot replace either primary 26 January order. The Provincial Court decision text controls 23 July 2019 for Auto 78/2019 even where a source filename uses 29 July.

Current repository control dates the creditor-substitution order to **15 February 2018**. Its 8 February body/recital layer and 9/14 February signature layers remain pending direct primary reinspection. The audit records one `C36-E007` act and does not infer a distinct 8 February decision. It also restores controlled decisions `C36-E009`, `C36-E030`, `C36-E035`, `C36-E039`, `C36-E040`, `C36-E042` and `C36-SPECIALIST-R26`, all present in canonical sources but omitted from the earlier visible chain.

| 15 Jul 2026 | `C36-SPECIALIST-R30` | Auto 223/2026 controlled | Merits decision, service and finality |

Judgment 163/2023 remains a materially adverse first-instance decision under appeal. Auto 1377/2025 and Judgment 4/2026 dismiss on standing rather than deciding the unexamined substantive grounds. Auto 223/2026 combines appeals; it does not decide their merits.

## Open family groups

1. **Certified denominator:** complete chronological court/LAJ index for every section and incident from 1 January 2014 through conclusion.
2. **2014–2016 originals:** the 29 April 2014 court-office act, the identified 2015 acts, the 1 April 2016 judgment and the definitive-text chain require signed originals and family-level certification.
3. **Unassigned references:** `204/14`, `677/14`, `2418/14` and `5599/2015` require exact court, class, object and parent-child relationship.
4. **Reported judicial acts:** obtain signed originals and families for `C36-E004`, `C36-E031`, `C36-E034`, `C36-E045`, `C36-E056`, `C36-E060`, `C36-E062` and `C36-E063`.
5. **8/15 February 2018 date layers:** directly reinspect the `C36-E007` source. Maintain 15 February as the repository control date while the 8 February body/recital and 9/14 February signature layers remain open. Infer no second act.
6. **25/27 October 2021:** the exact 25 October Diligencia is verified/partial and the signed 27 October Diligencia is controlled. Obtain filing 7336/2021, requests 7416/7417, issued testimonies, underlying report 7425/2021, annexes, service, challenges and later decisions.
7. **13 January 2022 candidate:** locate a signed original or correct the derivative date; preserve the two 26 January primary orders.
8. **2022–2023 appellate/nullity family:** keep the four reported acts of 9 March, 16 June, 20 June and 13 July 2022 separate; complete complaints 375/2022 and 379/2022; obtain the official Constitutional Court decision in appeal 2811/2023.
9. **Current merits/finality:** obtain RPL 2523/2025, combined RPL 3304/2025 and 3319/2025, and RPL 421/2026 merits decisions, service and finality.
10. **Final stage:** obtain final accounts, transfer, objections, approval or refusal, finality certificate and formal conclusion order.

The 2014–2016 discovery rows and the year-only 2022 complaints row are declared aggregation exceptions. They use the earliest known real date, or an explicit year-only sort key, until each act can be authenticated and split safely.

## Insolvency Administration report continuity

The report-series assessment is also partial. The controlled corpus identifies five report texts: the 20 December 2018 fourth liquidation report; the 21 July and 25 October 2021 Article 424 classification reports; the 25 January 2022 quarterly report; and the 25 April 2022 post-Protocol 457 quarterly report. These sources prove what the Administration reported; they do not independently prove every underlying payment, bank movement, Registry act or judicial adoption.

Two additional reports are proved only at the receipt level: report 7425/2021 through the signed 27 October 2021 Diligencia, and report 5367/2022 through the 27 July 2022 court-office record. Their underlying report texts remain unlocated. The complete run of later quarterly reports, final report, final accounts/rendición and annexes also remains open.

Closing the “all AC reports” gap requires a certified report index from liquidation opening through conclusion, each report and annex, filing/transfer records, challenges and rulings, and a reconciled estate ledger with bank statements and final accounts. Until that denominator exists, the accurate status is **partial series**, not “all reports obtained.”

## Required family model

For every resolution, record each node separately:

`request/filing → filing receipt → opposition/response → decision → service → clarification/reconsideration → appeal → appellate decision → finality → implementation/accounting`

No decision may be described as final without the required record. No missing document may be described as nonexistent without an official certification that addresses the relevant denominator.

## Public/private boundary

This control contains public-safe stable IDs, source class and coverage status only. Private email message IDs, Drive IDs, exact private filenames, message bodies, participants, verification data, signatures and unredacted source copies remain outside public Git. The current repository contains legacy locator debt in older files; this release neither repeats nor treats that debt as precedent.

## Court production request

This request is a prepared production specification only. It does not authorise an email, filing, portal submission or authority contact.

Judgment 89/2014 is intentionally excluded from the Concurso request because it belongs to the separate JV 1260/2011 / AP 89/2014 civil lane. A Concurso request may ask only whether and how it was incorporated or cited in Concurso 36/2012.
