# CALIFICACIÓN / DI 248 CONTRADICTION LEDGER

**Concurso Ordinario 36/2012 · Luchy Playa Blanca, S.L.U. · 16 August 2026**

## Purpose

This ledger controls the public treatment of the culpable-insolvency classification, its direct documentary connection to **DI 248/2018**, the allegations advanced by the insolvency administration and Ministerio Fiscal, the findings in **Sentencia 163/2023**, the pending appellate challenge, and the later January-2025 elEconomista episode.

It is designed to support strong public allegations without converting allegation, contradiction or inference into an adjudicated finding of deliberate dishonesty.

## Evidential labels

- `DOCUMENTED` — established by a located primary document.
- `JUDGMENT FINDING` — proposition expressly adopted or rejected by Sentencia 163/2023; not treated as final while appeal remains unresolved.
- `APPEAL ALLEGATION` — ground advanced on appeal; not an appellate finding.
- `EVIDENCE-BASED ALLEGATION` — a public allegation grounded in identified documents but not adjudicated as misconduct.
- `EVIDENCE-BASED INFERENCE` — a reasoned inference from chronology, role and documents; not direct proof of subjective intent.
- `OPEN` — requires further primary evidence.

## Actors must remain distinct

1. **Francisco de Borja Rodríguez-Batllori Laffitte** — Administrador Concursal (AC).
2. **Ricardo de Mosteyrín Sampalo** — Fiscal who signed the Ministerio Fiscal classification opinion dated **12 March 2019**.
3. **Alberto López Villarrubia** — Magistrado-Juez who signed **Sentencia 163/2023, 28 September 2023**.
4. **Elena Herrera Rodríguez** — Fiscal who signed the **DI 248/2018 archive decree, 7 May 2019**.

Do not state or imply that Ricardo de Mosteyrín personally decided DI 248/2018. The relevant bridge is institutional: the later DI 248 decree expressly relied on the Ministerio Fiscal's already-adopted classification position.

# 1. DI 248/2018 IS A DIRECT BRIDGE, NOT BACKGROUND CONTEXT

## 12 September 2018 — originating complaint and role reversal

`DOCUMENTED / chronology controlled`

Gil Marer and Aweswell Limited became complainants against the AC and Construcciones Acosta Matos in DI 248/2018 while the earlier AC-originated criminal lane against Gil/Patricia remained active. The originating complaint is dated 12 September 2018. This matters because the same actors occupied reversed procedural roles at the same time.

The AC's separate 17 October 2018 request for testimonies is a later event within the file. It must not be used as the date of the originating complaint.

## January 2019 — expansion of DI 248

Primary document: DI 248/2018 expansion dated 14-Jan-2019; public-safe custody reference `MF-DI248-SRC-EXP-01` (exact private filename and Drive locator withheld).

The expansion:

- identifies Gil Marer and Aweswell as complainants;
- names Francisco de Borja Rodríguez-Batllori and Construcciones Acosta Matos as complained-of parties;
- alleges unauthorised transfer/control and asset-realisation conduct;
- asks Fiscalía to investigate the AC and to take statements from **José Daniel Acosta Matos and Laura Acosta Matos**;
- asks for documentary production concerning the CAM acquisition/commission and November-2018 sale instruments; and
- expressly states that the debtor/complainants had taken measures to obtain conclusion of the insolvency under **former Article 176 LC and had obtained the financing said to be necessary for that exit**.

That last proposition is especially important to the later accusation of obstruction/non-collaboration: by January 2019, within the material classification period, the prosecution file itself contained a contemporaneous assertion that Gil/Aweswell were trying to finance and achieve LPB's exit from insolvency.

## 12 March 2019 — Ministerio Fiscal classification opinion

Primary document: Ministerio Fiscal calificación opinion dated 12-Mar-2019; public-safe custody reference `MF-DI248-SRC-CAL-01` (exact private filename and Drive locator withheld).

`DOCUMENTED`

Ricardo de Mosteyrín Sampalo signed a two-page opinion asking that LPB's insolvency be classified as culpable and seeking severe consequences against Gil Marer and Uri Omid, with Patricia Domínguez and Pink Canary Services treated as accomplices.

The opinion advances, among other grounds, alleged accounting irregularities, concealment/asset-removal, late filing and failure to collaborate with the insolvency administration. It asks for a 15-year disqualification, loss of rights as creditors, damages and deficit liability.

### Facial internal contradiction in the Fiscal text

The opinion literally includes as a ground:

> “situación de insolvencia agravada por dolo o culpa del administrador concursal”

but then identifies Gil Marer and Uri Omid — social administrators — as the persons responsible. Whether this is a drafting mistake or something with wider significance is not established. **The contradiction is objective and should be reproduced rather than silently corrected.**

## 7 May 2019 — DI 248 archive expressly invokes the classification against the complainant

Primary document: DI 248/2018 archive decree dated 7-May-2019; public-safe custody reference `MF-DI248-SRC-ARCH-01` (exact private filename and Drive locator withheld).

`DOCUMENTED`

The archive decree, signed by Fiscal **Elena Herrera Rodríguez**, states that the ATLANTE system showed the sixth/classification section had been opened and that **“este Ministerio”** had already reported the insolvency as culpable and the former administrator — now complainant — as responsible, including for alleged failure to collaborate with the insolvency administrator.

This is the direct documentary connection:

`COMPLAINT AGAINST AC/CAM → MF CLASSIFICATION POSITION AGAINST COMPLAINANT → SAME MINISTERIO FISCAL INVOKES THAT POSITION WHEN ARCHIVING THE COMPLAINT AGAINST AC/CAM`

The decree also frames much of the complained-of conduct as matters subject to Mercantile Court supervision and existing judicial resolutions.

### Controlled public conclusion

It is fair to publish that **the Ministerio Fiscal used its own adverse classification position about Gil as part of the reasoning in the decision on Gil/Aweswell's complaint against the AC/CAM perimeter**.

It is also fair to allege that this creates a serious question of **institutional circularity, anchoring and asymmetric credibility allocation**: allegations originating in the insolvency lane helped form an adverse prosecutorial frame, and that frame was then used against the complainant when he asked Fiscalía to investigate the insolvency administrator and CAM.

Do **not** publish as established fact that Ricardo de Mosteyrín and Elena Herrera coordinated personally, that the archive was corrupt, or that either knowingly acted for CAM. Those propositions require separate evidence.

# 2. WHAT THE 2023 JUDGMENT ITSELF REJECTED OR NARROWED

Primary judgment: Sentencia 163/2023 dated 28-Sep-2023; public-safe custody reference `MF-CAL-SRC-JUDGMENT-01` (exact private filename and Drive locator withheld).

Control correction: despite the filename used in the January-2025 newsroom chain, the document is **Sentencia 163/2023 of 28 September 2023**, not an Auto. It concerns the classification of **LPB's** insolvency, not the whole mixed-ownership Sun Park complex. Appeals were filed.

| Proposition advanced in the classification lane | What Sentencia 163/2023 says | Controlled status |
|---|---|---|
| Broad failure to pursue third-party/CEXP credits generated or aggravated insolvency | The Court rejects culpability under the general clause on this branch, noting the difficulty of recovery and lack of sufficient causal justification in the AC report | `JUDGMENT REJECTION` |
| AC position that the €737,338.85 entry meant LPB effectively owed itself | The Court accepts the contrary expert explanation that it represented a valid LPB credit | `JUDGMENT REJECTION / CORRECTION` |
| Concealment / alzamiento / related connivance constructions | The Court rejects material parts and states at one point that alleged connivance lacked evidential corroboration | `JUDGMENT REJECTION` |
| Gil failed to seek insolvency in time | The Court expressly states that the filing delay was **not attributable to Gil**: after assuming office in January 2012 he used the Article 5 bis route and later filed the insolvency petition within the relevant sequence | `JUDGMENT REJECTION AS TO GIL` |
| Global failure to collaborate / failure to provide accounting material | The Court expressly records that LPB delivered the accounting documentation it had; it narrows the accepted non-collaboration finding to supporting material for specified CEXP credits | `JUDGMENT NARROWING` |
| AC/MF request for insolvency-deficit liability | Rejected because the AC and Ministerio Fiscal asked for it without supplying the necessary justification; the Court says it could not substitute its own reasoning without compromising defence rights | `JUDGMENT REJECTION` |

**Public consequence:** it is inaccurate to present the AC/Fiscal accusation package as if it were wholly validated by Sentencia 163/2023. The judgment is materially adverse, but it itself rejects or narrows important allegations.

# 3. THE REMAINING ADVERSE FINDINGS — AND THE SPECIFIC CONTRADICTIONS ON APPEAL

Primary Gil appeal located; public-safe custody reference `MF-CAL-SRC-APPEAL-GIL-01` (exact private filename and Drive locator withheld).

The appeal remains a party pleading unless and until the Audiencia Provincial determines it.

## A. Rent / Pink Canary operation

`JUDGMENT FINDING`

The Court does not accept that entering the 6 February 2012 operating/lease arrangement was itself necessarily wrongful merely because the rent was lower than mortgage servicing. It nevertheless finds culpable aggravation in the later failure to collect rent and awards damages.

`APPEAL ALLEGATION / objective reasoning issue`

The judgment discounts the Pink expert analysis in part because it did not include operating income and then reasons that income may be presumed to have exceeded costs because otherwise nobody would have operated for years without profit. The appeal attacks that as a finding resting on presumption rather than a proved income calculation.

## B. Accounting

`JUDGMENT FINDING`

The Court finds a substantial accounting breach because it considered the Libro Diario absent/inadequate, notwithstanding balances and annual accounts supplied.

`APPEAL ALLEGATION / documented narrowing`

The judgment itself records delivery of annual accounts/balances and that the AC had received PDF diary/balance material for earlier periods. The dispute is therefore not accurately described as “no accounting was supplied”; it is about whether what existed and was delivered satisfied the statutory accounting duty.

## C. Non-collaboration / CEXP supporting documents

`JUDGMENT FINDING`

The Court accepts non-collaboration only as to supporting documentation for specified CEXP credits.

`OBJECTIVE INTERNAL TENSION + APPEAL ALLEGATION`

The judgment says it is unknown whether the underlying recovery actions would have succeeded, yet concludes that the missing support aggravated insolvency because some sums might have entered the estate. Earlier in the same judgment, uncertainty/difficulty surrounding substantially the same CEXP recovery branch is part of the reason the Court rejects causal culpability under the general clause.

This is an internal reasoning tension that may fairly be displayed. Whether it legally invalidates the finding is for the appellate court.

## D. Procedural fairness at the July 2023 hearing

`DOCUMENTED IN JUDGMENT + APPEAL ALLEGATION`

The judgment's antecedents record the 25 July 2023 hearing with attendance by the AC, Ministerio Fiscal and representation of LPB. Gil's appeal alleges that he, Patricia and Pink were left without their own legal representation after counsel's withdrawal was communicated to the court only two days before the hearing, that suspension was requested and the hearing nevertheless continued, producing indefensión.

The complete notice/service/hearing record remains required before attributing intentional procedural exclusion to the Judge or court office.

---

# 4. STRONGEST DEFENSIBLE ALLEGATIONS BY ACTOR

## A. Francisco de Borja Rodríguez-Batllori — AC

### Strong allegation

`EVIDENCE-BASED ALLEGATION`

The AC advanced a broad culpability narrative against Gil that, on several material propositions, **did not survive the Court's own testing**. The judgment rejected or narrowed important branches: general CEXP-credit causation, the €737,338.85 self-debt construction, material concealment/connivance theories, late filing as against Gil, the broad version of non-collaboration, and deficit liability as pleaded.

The January-2019 DI 248 expansion simultaneously records the opposite practical narrative: Gil/Aweswell were seeking investigation of the AC/CAM perimeter and asserting a financed route to conclude the insolvency under former Article 176 LC.

### Knowledge allegation

Where primary transmissions prove that the AC personally held documents showing accounting delivery, rescue/exit financing, requests for assistance, title/perimeter concerns or challenges to liquidation acts, **Por Derecho may allege that a later categorical portrayal of Gil as simply obstructive or non-collaborative was materially selective and, for those specific propositions, made despite contrary information available to the AC**.

Do not globalise this into “the AC knowingly lied about everything” until the full AC report/annexes and recipient-by-recipient notice record are complete.

### Motive hypothesis

`EVIDENCE-BASED INFERENCE`

A plausible non-exclusive motive is **defence of the AC's own administration and the liquidation/disposition path already being pursued**, including acts challenged by Gil/Aweswell and involving CAM. Establishing a corrupt, retaliatory or privately coordinated motive requires additional direct evidence.

## B. Ricardo de Mosteyrín Sampalo — Fiscal, 12 March 2019

### Strong allegation

`EVIDENCE-BASED ALLEGATION`

The two-page Fiscal opinion adopted a severe accusation package and requested extreme consequences without the individualized analytical depth that appears proportionate to those consequences on the face of the document. Several propositions later failed or were narrowed in the judgment, and the deficit request was expressly rejected for lack of justification from both the AC and Ministerio Fiscal.

The opinion also contains the facial contradiction referring to insolvency aggravated by the intent/fault of the **“administrador concursal”** while naming Gil/Uri as responsible.

### Institutional circularity

`DOCUMENTED + EVIDENCE-BASED ALLEGATION`

Less than two months later, a different prosecutor, Elena Herrera Rodríguez, expressly invoked **the Ministerio Fiscal's own adverse classification position** when archiving DI 248, the complaint in which Gil/Aweswell were asking Fiscalía to investigate the AC/CAM perimeter. Por Derecho may characterize this as a documented **circular reinforcement of an inherited adverse frame**, while carefully separating Ricardo's authorship of the classification opinion from Elena's authorship of the DI 248 archive decree.

### Motive hypothesis

`EVIDENCE-BASED INFERENCE`

The strongest supportable explanation at present is **institutional anchoring / consistency with an existing AC-and-court frame**, not proven personal hostility, corruption or coordination with CAM.

## C. Alberto López Villarrubia — Judge, Sentencia 163/2023

### Strong allegation

`EVIDENCE-BASED ALLEGATION / APPELLATE DISPUTE`

The judgment contains material internal tensions in the findings that remain adverse to Gil: it relies on a presumption concerning operating profitability; it accepts non-collaboration causation while acknowledging uncertainty over whether the relevant recovery actions would have succeeded; and that causal reasoning sits uneasily beside the judgment's earlier rejection of general CEXP-credit culpability because recovery was difficult/uncertain.

At the same time, the judgment itself disproves any fair public suggestion that the Judge accepted the AC/Fiscal case wholesale: he rejected important accusation branches and expressly held that late filing was not imputable to Gil.

### Knowing-falsehood threshold

It is **not yet controlled to publish as an established fact that the Judge knowingly lied**. A knowing-disregard allegation becomes substantially stronger only proposition by proposition where the certified docket/hearing record proves the precise contrary material was actually before the Judge and was incompatible with the finding made. Presence somewhere in a file is not automatically proof of personal judicial knowledge or adoption.

### Motive hypothesis

`EVIDENCE-BASED INFERENCE`

A legitimate hypothesis to investigate is **institutional path dependence**: preserving coherence with an existing liquidation/classification trajectory and earlier judicial acts. This is not proof of bias, prevaricación, retaliation or an agreement with the AC/CAM perimeter.

---

# 5. RESCUE / PRESERVATION COUNTER-CHRONOLOGY

This chronology must be shown beside any allegation that Gil merely obstructed the insolvency administration.

| Period | Dated preservation / rescue conduct | Evidential significance |
|---|---|---|
| Feb 2012 | Viability plan already records direct-to-market channels including Summers Villages, Sun Park Living and a proposed tour-operator lane | Pre-insolvency / early rescue and revenue planning, not a later invented narrative |
| Apr–Jun 2012 | Article 5 bis route followed by voluntary insolvency filing after Gil's January appointment | Sentencia 163/2023 itself says the delay in filing was not imputable to Gil |
| 2012–2016 | Continued hotel-operation / maintenance expenditure and production of company accounting material; disputes with minority/Community actors repeatedly identified | Tests simplistic proposition of abandonment/non-cooperation; exact income/cost consequences remain disputed |
| 2014 onward | Annual accounts and balances supplied within the insolvency relationship; later judgment records accounting documentation delivered, while disputing statutory sufficiency | Distinguish “documents delivered” from “Court found accounting legally sufficient” |
| 2017–2018 | Challenges to access/control, liquidation/perimeter and CAM-related conduct; 26 June 2018 suspension becomes a formal judicial checkpoint | Shows active attempts to preserve disputed assets/rights rather than passivity |
| Jan 2019 | DI 248 expansion expressly states measures were being taken to conclude the insolvency under former Art. 176 LC and that necessary financing had been obtained | Directly material to the contemporary rescue/non-collaboration narrative |
| Apr–Jun 2019 | Formal opposition to the culpable-classification case | Direct exercise of defence within the classification period |
| 2020–2022 | Repeated filings/warnings concerning debt calculation, interest, value, title/perimeter, bidding and realization; complete evidence-before-court matrix remains under reconstruction | Preservation and value-protection track; do not claim every filing was legally correct or accepted |
| Oct–Nov 2023 | Appeals filed against Sentencia 163/2023 | Judgment was challenged before the January-2025 newsroom episode |
| 2025–2026 | Evidence preservation, institutional/regulatory notifications, recovery/restitution work and public traceability through Por Derecho | Continuation of recovery rather than acquiescence; each external claim remains evidence-classified |

# 6. JANUARY 2025 — ELECONOMISTA AND EXTRA-PROCEDURAL USE

Controlled newsroom chronology and correction register establish:

- the newsroom was examining issues materially wider than the LPB classification: Meeting Point/FTI commercialisation, property/authority, RIC/RICPE, investment and public-funding/incentive questions;
- the 16–20 January chronology strongly supports that Sentencia 163/2023 was **supplied or procured through the CAM/Acosta Matos response channel initiated by Laura Patricia Acosta Matos**;
- the exact physical sender/account remains unverified;
- the file was labelled `AUTO CONCURSO CULPOSO.pdf`, although it was a **Sentencia**, not an Auto;
- it was a first-instance LPB classification judgment subject to appeals already filed, not a final judgment determining ownership/authority over the whole mixed-ownership hotel or the later RIC/Meeting Point/public-funding tracks.

### Controlled public allegation

It is now supportable to allege an **extra-procedural instrumentalisation / scope mismatch** in the January-2025 episode: a materially adverse but non-final LPB classification judgment was supplied through the CAM/Acosta Matos response channel and then functioned in the newsroom exchange as a reason the broader investigation could not proceed, even though the judgment did not adjudicate many of the investigation's central property, commercialisation, financing or public-funding questions.

The stronger allegation concerns **function and effect**, which are documented. Do not state as established that LPAM personally transmitted the file, that she knowingly misdescribed its finality, or that she unlawfully compelled elEconomista not to publish unless native transmission/instruction evidence proves those propositions.

# 7. PUBLIC WORDING CONTROL — “LIED” / “KNOWINGLY FALSE”

The user's position is that the AC, Fiscal and Judge lied about what he did and did not do. Por Derecho may state that position clearly, but the site should distinguish the speaker's allegation from an adjudicated fact.

Preferred strong formulation:

> **Gil Marer alleges that material accusations made about his conduct were false and, where the relevant actor demonstrably held the contrary documents or had themselves participated in the contrary event, knowingly false. This page does not ask the reader to accept that conclusion on assertion. It places each accusation beside the contemporaneous document, the later judicial rejection or narrowing, the appeal ground and the actor-specific knowledge record.**

Then show the evidence.

This is stronger than a blanket statement because it identifies which propositions are objectively contradicted, which actor had what contrary information, which adverse findings remain live on appeal, and which element of subjective intent is still to be proved.

---

# 8. OPEN EVIDENCE REQUIRED BEFORE FURTHER UPGRADES

1. Complete original AC classification report and every annex.
2. Certified complete DI 248/2018 expediente and actual diligencias carried out before archive.
3. Complete 25 April 2019 Fiscalía rent expert report, visually reviewed.
4. Certified 25 July 2023 hearing record, notices, counsel-withdrawal communication and suspension request/disposition.
5. Certified Audiencia Provincial appeal docket/current status and eventual decision.
6. Actor-specific receipt/knowledge matrix proving exactly which contrary documents were personally/institutionally before AC, Fiscal and Judge for each disputed proposition.
7. Native January-2025 inbound message/header identifying the physical transmitter of Sentencia 163/2023 to Javier Romera.

## Control rule

**Contradiction can be documented. Knowledge can sometimes be documented. Deliberate falsehood requires both the false proposition and evidence that the speaker knew the contrary fact at the relevant time. Motive remains an inference unless direct evidence proves it.**
