# Javier Acosta Matos, the four-sibling image and 4-February-2022 Community-role control

**Control date:** 28 August 2026
**Control ID:** `PD-SP-JAM-20260828-01`
**Status:** `CARET_CONFIRMED FOR THE SIX-OBJECT COMBINED SCOPE / IMAGE POSITIONS ATTRIBUTED / CONDUCT AND CAPACITY OPEN`
**Read with:** `PD-SP-POST7J-20260828-01`, `SP-ACTA-2022-02-04`, CR-119/CR-120/CR-121/CR-122, ME-099 and Declaration 018

## 1. Caret legend and finite result

`^` confirms only that the displayed person or organisation has been resolved to the stated immutable CAEPR record and cleared of a material identity collision for this context. It does **not** establish meeting power, title, vote, knowledge, intention, coordination, participation, benefit, wrongdoing or liability.

| Object in scope | CAEPR ID | Result |
|---|---|---|
| José Daniel Acosta Matos^ | `PD-SP-P-0011` | `CARET_CONFIRMED` |
| Laura Patricia Acosta Matos^ | `PD-SP-P-0012` | `CARET_CONFIRMED` |
| Javier Acosta Matos^ | `PD-SP-P-0093` | `CARET_CONFIRMED` |
| Gerardo Zacarías Acosta Matos^ | `PD-SP-P-0094` | `CARET_CONFIRMED` |
| Construcciones Acos-Matos, S.L.^ | `PD-SP-O-0074` | `CARET_CONFIRMED` |
| Comunidad de Propietarios Sun Park^ | `PD-SP-O-0005` | `CARET_CONFIRMED` |

**Combined scope:** the four siblings Gil identifies in the published image, plus Javier's represented company and the Owners' Community used in the 4-February-2022 analysis.
**Denominator:** 6 unique eligible objects — four people and two organisations.
**Confirmed and correctly marked:** 6.
**Coverage:** `6 / 6 = 100%`.
**Exceptions:** none for identity; the capacity and conduct questions below remain outside caret meaning.
**Non-applicable:** “captured Community”, “Acosta Matos perimeter”, the meeting, ACTA, alleged plan and alleged criminality are concepts/events/propositions, not caret-eligible objects.

Two overlapping finite subscopes remain visible rather than being arithmetically conflated:

- **4-February meeting triad:** Javier / represented company / Community = `3 / 3`.
- **Published-image sibling set:** José Daniel / Laura Patricia / Javier / Gerardo Zacarías = `4 / 4`.

Because Javier belongs to both subscopes, the combined denominator is six, not seven. This is an identity-control count only.

**ALL IS^ — VERIFIED FOR THIS SIX-OBJECT COMBINED SCOPE ONLY.** This is not a page-wide or repository-wide `all is^` result.

## 2. Identity resolution and collision control

The full name and corporate setting are supported by compatible official and case-record attributes:

1. **BORME-A-2009-32-35, entry 84648** identifies `ACOSTA MATOS JAVIER` as director and delegated director of **Construcciones Acos-Matos Sociedad Limitada**, Registry sheet `GC 17613`.
2. **BORME-A-2020-157-35, entry 269436** records him among the directors appointed to **Construcciones Acosta Matos, S.A. (CAM)**.
3. **BORME-A-2021-156-35, entry 383950** records him among the directors appointed to **Canarian Hospitality, S.L.**
4. **SP-ACTA-2022-02-04, source page 2** names `Don Javier Acosta Matos en representación de Construcciones Acos-Matos, S.L.` at the Owners' Community meeting.
5. The cited BORME materials independently place José Daniel, Laura Patricia, Javier and Gerardo Zacarías Acosta Matos in the relevant corporate-governance perimeter. They do not identify any face or pixel in the website image.

- <https://www.boe.es/diario_borme/txt.php?id=BORME-A-2021-156-35>

The identity is therefore sufficiently resolved. **Construcciones Acos-Matos, S.L.^ is a distinct legal person** and must not be normalised into CAM, S.A. or the unresolved `Construcciones Acosta Matos, S.L.` reference merely because the names and people overlap.

The immutable-ID collision is also resolved: `PD-SP-P-0092` remains assigned to **Juan José Vera Díaz^**; Javier is `PD-SP-P-0093`; and Gerardo Zacarías is `PD-SP-P-0094`. Gerardo Zacarías must not be conflated with his father, **Gerardo Nicanor Acosta Armas^** (`PD-SP-P-0013`). No facts move between those records.

## 2A. Family-generation and corporate-transition chronology

The following chronology is controlled alongside the identity records so that a cessation, resignation, reappointment, governance restructure or company extinction is not flattened into one undifferentiated "exit" date.

| Person | Company / perimeter | Date | Controlled event type | Controlled meaning |
|---|---|---:|---|---|
| Gerardo Nicanor Acosta Armas^ | Construcciones Acos-Matos / CAM predecessor governance | 5 Feb 2009 | `GOVERNANCE_RESTRUCTURE` | Ceased as sole administrator when governance moved to a board; remained within governance as president. This was not a substantive exit. |
| José Daniel Acosta Matos^ | Construcciones Acos-Matos / CAM predecessor governance | 5 Feb 2009 | `BOARD_ENTRY` | Entered the board as vice-president. |
| Laura Patricia Acosta Matos^ | Construcciones Acos-Matos / CAM predecessor governance | 5 Feb 2009 | `BOARD_ENTRY` | Entered the board as secretary. |
| Javier Acosta Matos^ | Construcciones Acos-Matos / CAM predecessor governance | 5 Feb 2009 | `BOARD_ENTRY` | Entered the board and was appointed delegated director. |
| Gerardo Zacarías Acosta Matos^ | Construcciones Acos-Matos / CAM predecessor governance | 5 Feb 2009 | `BOARD_ENTRY` | Entered the board. |
| Gerardo Nicanor Acosta Armas^ | Construcciones Acosta Matos, S.A. | 7 Aug 2020 | `TRUE_GOVERNANCE_EXIT` | Ceased as director and president and was not reappointed in the same registered act. This is the strongest official generational handover anchor located to date. |
| José Daniel Acosta Matos^ | Construcciones Acosta Matos, S.A. | 7 Aug 2020 | `FORMAL_CESSATION_WITH_IMMEDIATE_REAPPOINTMENT` | Formal cessation was followed by immediate reappointment as director and elevation to president. Not a substantive exit. |
| Laura Patricia Acosta Matos^ | Construcciones Acosta Matos, S.A. | 7 Aug 2020 | `FORMAL_CESSATION_WITH_IMMEDIATE_REAPPOINTMENT` | Formal cessation was followed by immediate reappointment as director, secretary and delegated director. Not a substantive exit. |
| Javier Acosta Matos^ | Construcciones Acosta Matos, S.A. | 7 Aug 2020 | `FORMAL_CESSATION_WITH_IMMEDIATE_REAPPOINTMENT` | Formal cessation was followed by immediate reappointment as director. Not a substantive exit. |
| Gerardo Zacarías Acosta Matos^ | Construcciones Acosta Matos, S.A. | 7 Aug 2020 | `FORMAL_CESSATION_WITH_IMMEDIATE_REAPPOINTMENT` | Formal cessation was followed by immediate reappointment as director and appointment as vice-president. Not a substantive exit. |
| Laura Patricia Acosta Matos^ | Canarian Hospitality, S.L. | 5 Aug 2021 | `GOVERNANCE_RESTRUCTURE` | Ceased as sole administrator but continued in governance through appointment to the board as director and secretary. Not a substantive departure from the company. |
| José Daniel / Laura Patricia / Javier / Gerardo Zacarías Acosta Matos^ | Construcciones Acosta Matos, S.A. | 2 Feb 2024 | `COMPANY_EXTINCTION` | The S.A. legal person was dissolved/extinguished through demerger/escisión. This ends offices in that legal person by extinction and must not be described as four individual resignations. |
| Gerardo Nicanor Acosta Armas^ | family / founder generation | March 2024 | `DEATH_PUBLICLY_REPORTED` | Canary media reported his death during the weekend of 9–10 March 2024, with publication on 10 March 2024. The exact civil-registry date of death remains unverified and must not be stated more precisely without a primary or equivalent reliable source. |
| José Daniel Acosta Matos^ | Grupo Acosta Matos | by Feb 2023, media reporting presidency since 2012 | `SUCCESSION_CONTEXT` | Public business-media coverage identifies José Daniel as president before his father's death, so the presidency transition materially predates March 2024. This is context, not a substitute for act-specific company-registry records. |

### Event-type rule

Use these controlled categories in future actor and timeline work:

- `TRUE_GOVERNANCE_EXIT` — person actually leaves the governing body and is not contemporaneously reappointed.
- `FORMAL_CESSATION_WITH_IMMEDIATE_REAPPOINTMENT` — registry mechanics change the appointment but continuity remains.
- `GOVERNANCE_RESTRUCTURE` — office changes while the person remains in company governance.
- `COMPANY_EXTINCTION` — the legal person ceases; do not rewrite this as an individual resignation.
- `DEATH_PUBLICLY_REPORTED` — public reporting establishes death, but exact civil date remains controlled separately unless independently verified.

### Source-status controls

- BORME entries control company-office events and should outrank media shorthand on resignation/removal dates.
- The March 2024 death date is presently source-bounded to public media reporting; exact date remains open pending obituary, civil-registry or equivalent primary confirmation.
- The 7-Aug-2020 act is the principal verified generational-control transition in CAM governance located to date: Gerardo Nicanor leaves the board/presidency while José Daniel becomes president, Gerardo Zacarías vice-president, Laura Patricia secretary/delegated director, and Javier remains a director.
- Do not move knowledge, intent, responsibility or liability between generations merely from family relationship, succession chronology, board membership or office changes.
- **Death-status control:** death does not erase historical acts, communications, causation evidence, alleged patrimonial harm, benefit analysis, document-custody questions or the conduct of surviving actors. Spanish Penal Code article 130.1.1 extinguishes the deceased person's own criminal responsibility; separately, LECrim articles 115–116 preserve the civil action in the circumstances they regulate, including the article-115 route against heirs and successors-in-title. Do not say that criminal culpability passes to heirs or survives death, and do not say that death erases all patrimonial/restitutionary consequences.

## 2B. Patricia Domínguez first Acosta Matos office meeting — attributed testimony intake

Read [`Declaration 018`](./declarations/018_PATRICIA_DOMINGUEZ_ACOSTA_MATOS_FIRST_OFFICE_MEETING_ATTRIBUTED_RECOLLECTION_20260828.md) as the controlling intake record for this testimony.

Gil Marer attributes to **Patricia Domínguez** a recollection of her first meeting with **José Daniel Acosta Matos^** at the Acosta Matos office in Las Palmas. Gil states that Patricia attended accompanied by lawyer **Cristo Suárez Pimentel**. According to Patricia's recollection as relayed by Gil, José Daniel explained in substance that dissident owners who were friends of his father, **Gerardo Nicanor Acosta Armas^** (now deceased), had approached the father and asked the Acosta Matos side to become involved, take over or help reunify the hotel because they were strongly opposed to **Luchy Playa Blanca, S.L.U. (LPB)** and wanted LPB gone; Patricia recalls José Daniel explaining that, once LPB was gone, the hotel could be reunified and rebuilt/refurbished, and that this was why the Acosta Matos side became involved.

**Evidence status:** `ATTRIBUTED WITNESS RECOLLECTION / S1 / NOT YET PATRICIA-ADOPTED / NOT INDEPENDENTLY CORROBORATED`. This is not treated as a verbatim recording, authenticated admission, proof that the dissidents had the stated motive, proof of an unlawful agreement or proof of an offence. The word “hated” is preserved only as Patricia's recalled substance, not as a certified quotation. The exact meeting date remains open. Cristo Suárez Pimentel is a potential corroborating attendee; his presence and recollection remain to be independently confirmed.

If corroborated, the testimony is potentially significant to **origin, prior knowledge, objective and causal sequence**: it may help test whether later credit, access/control, Community, title, works, finance and operation decisions were independent commercial acts or implementations of an earlier stated objective concerning LPB's removal and hotel reunification. That inference remains falsifiable and must be tested against lawful creditor recovery, consensual acquisition, rescue/redevelopment and other innocent or independent commercial explanations.

The father's later death does not transfer or prove responsibility of any surviving family member. Conversely, it does not erase the historical inquiry into what he was allegedly asked, what communications existed, what consequences allegedly followed, or any properly available patrimonial/civil route.

## 3. The image: attributed positions, significance and ceiling

Gil Marer positively identifies the people in `assets/acosta-matos-family-hotel-plans.jpg`, from left to right, as:

1. **Javier Acosta Matos^** — the younger man at the far left;
2. **Laura Patricia Acosta Matos^** — standing;
3. **José Daniel Acosta Matos^** — second from the right; and
4. **Gerardo Zacarías Acosta Matos^** — the bearded man at the far right.

That positional identification is an **express Gil attribution**, not a facial-recognition conclusion and not something established by the caret. The image's controlled file fingerprint is SHA-256 `aad5ebaffddf8211be21468f5936b6b1a0066c631919a43a06e9886a9061cd37` (JPEG, 770 × 420). Its website source context supplies a publication ceiling no later than 10 February 2021 in an Acosta Matos hotel-renovation/RIC Equity context.

The image is significant because it supports a targeted inquiry into pre-meeting project knowledge, shared records and custodians across the four-sibling governance perimeter. If the original file, metadata, pictured plans, laptop materials or contemporaneous board packs reliably tie the scene to Sun Park before 4 February 2022, they could materially corroborate prior project knowledge and help identify who controlled the invitation, owner-list, financing, works and implementation records.

The image alone does **not** prove that the plans concern Sun Park, the date the photograph was taken, who created or read the documents, knowledge of the 4-February invitation, deliberate exclusion, agreement, a common criminal purpose or any offence. Its proper present function is source-direction and preservation, not guilt attribution.

## 4. Evidentiary significance — stronger than attendance, weaker than participation

The combined sources make Javier Acosta Matos^ a material evidence holder. They place the same identified person in dated corporate-governance positions within the CAM/Canarian Hospitality project perimeter before the ACTA and then place him at the meeting for another exact group company. This supports targeted investigation of:

- what project, ownership, insolvency, debt, works and finance information reached each board;
- what meeting pack, owner list, debt schedule, project, budget and notice records he received;
- his exact written power for Construcciones Acos-Matos, S.L.^;
- the units and coefficient represented, whether the company had voting rights and whether he actually voted on each item;
- any conflict, abstention, related-party interest or expected project benefit;
- what he knew about LPB, Matkator, their practical exclusion and the notice or non-notice route;
- his communications with José Daniel Acosta Matos, Laura Patricia Acosta Matos, CAM, Canarian Hospitality, Pamalexsha, the president, secretary-administrator, contractor and advisers; and
- what ACTA or implementation records he received, approved, corrected, transmitted or retained after the meeting.

It does **not** prove that he attended the 7-June-2018 event, authored the 2022 project, convened the meeting, controlled notice, knew anyone was unaware, voted, falsified a record or shared an unlawful purpose. Nor does Gerardo Zacarías's attributed presence in the earlier published image prove that he attended or acted at the 4-February meeting.

## 5. Witness or investigated person

On the current evidence, the proportionate procedural starting point is **material witness and document custodian**, with an express prohibition on using witness status to bypass the rights of a person against whom objective criminal indications emerge.

Reclassification as an investigated person requires a concrete bridge to his own conduct: for example, proof that he knowingly exercised a vote without authority, procured or used a materially false debt/notice/cost record, intentionally helped exclude an entitled owner, concealed the ACTA to prevent challenge, or used the resolutions to obtain a patrimonial act or benefit. Corporate office, surname, group proximity and attendance alone do not meet that threshold. The competent prosecutor or court determines procedural status and must provide the corresponding rights.

The same controlled starting point applies to Gerardo Zacarías for the image/corporate-record track: potential witness and custodian first, unless actor-specific evidence connects him to notice control, a false recital, concealment, implementation or benefit. The present ACTA does not record him as a 4-February attendee.

## 6. Preservation and first examination package

Before any accusatory classification, preserve and obtain:

1. his ACTA representation document and every company/Community power in force on 4 February 2022;
2. complete meeting notice, service, attendee, vote and ACTA-distribution records;
3. CAM, Canarian Hospitality and Acos-Matos board packs/minutes concerning Sun Park from 2019–2022;
4. emails, messages, calendars and document metadata tied to the project, owner list, debt, works budget, RICPE/RIC, incentive and FEDER applications;
5. conflict, abstention, related-party, contractor, payment and beneficiary records;
6. the original published-image file and all derivatives, EXIF/XMP/IPTC metadata, publication records, photographer/editor testimony, the laptop files, pictured plans, document versions and linked board or project packs;
7. the first-office-meeting corroboration package specified in Declaration 018, including Patricia's independent review, meeting-date evidence, Cristo Suárez Pimentel's independent account subject to privilege/professional-duty controls, and contemporaneous Acosta Matos/dissident records; and
8. contrary material showing lack of receipt, non-participation, lawful reliance, abstention, independent professional advice or an independent commercial origin for the later project.

## 7. Controlling conclusion

Javier Acosta Matos^ is evidentially identified and must not be omitted from the 2022 actor matrix. Gerardo Zacarías Acosta Matos^ is now separately controlled as the sibling Gil identifies at the far right of the published image and must not be conflated with Gerardo Nicanor Acosta Armas^. The four-sibling image, corporate records, ACTA and newly preserved Patricia-attributed first-meeting recollection justify focused knowledge, custody, mandate, vote, conflict, origin and implementation examination. They do not justify presenting any person as part of proved “criminality of a captured Community”. Declaration 018 is presently attributed intake evidence, not a proved admission. The controlled formulation remains that **Gil Marer and Aweswell allege instrumentalisation or capture of Comunidad de Propietarios Sun Park^; each person's possible contribution remains a falsifiable, actor-specific investigative question.**
