# Reverse-engineered criminal analysis — AC removal and fees thread

**Control date:** 26 August 2026

**Scope:** repository, website and thread synthesis for the Insolvency Administrator removal application, remuneration/civil-liability action, Judge/LAJ decisions, appeals and linked but separate criminal/disciplinary routes.

## Thesis

The strongest defensible thesis of this thread is **not** that the civil/insolvency dismissals prove wrongdoing, validate the Administrator's conduct or establish judicial complicity. The record instead creates a dense, dated **notice–response–decision–appeal chain** from which actor-specific criminal questions can be tested without importing collective guilt:

> entrusted power or duty → verified information/knowledge → act or omission within practical capacity → patrimonial consequence → possible corresponding benefit → evidence of intent, or an innocent/defensible explanation.

The two first-instance merits gates were never crossed. The removal application and the fee action were dismissed for lack of active standing. Therefore, the seven substantive removal blocks and the legality/quantum of the challenged remuneration remain allegations and disputed questions unless a later competent decision determines them.

## Reverse-engineered chain

| Layer | Removal route | Fee route | Criminal meaning |
|---|---|---|---|
| Initiating position | R01: 58-page application with seven substantive blocks | F01: 21-page claim pleading EUR 110,956.97 | Detailed notice and attributed allegations; not proof |
| Contrary position | R03 Administrator opposition | F05 insurer and F06 Administrator defences | Alternative legal/factual explanations must be tested, not suppressed |
| LAJ processing | R02/R04 and appellate formation/transfer acts | F02–F04, F07/F09/F14/F17/F18 | Proves procedural handling only; receipt or processing is not merits acceptance |
| First judicial outcome | R05 standing dismissal | F13 standing dismissal and costs | Adverse procedural outcomes; substantive allegations not adjudicated |
| Additional contrary judicial observation | R09 says no indications appeared for ex-officio removal on the then-record | — | Material contrary evidence; not a ground-by-ground merits trial |
| Appeals | RPL 3304/2025 and 3319/2025, combined by R30 | RPL 421/2026 | Processing located; current merits outcomes remain open |
| Separate routes | DP 1956/2026 and intake reference 22 concern the AC/Concurso hypothesis; DIP 80/2026 is disciplinary | Same evidence may be cited | Procedures and legal effects do not merge merely because evidence overlaps |
| Cross-evidence only | DP 1901/2026 concerns the private-actor/CAM lane | Access, title, instruction or benefit evidence may overlap | Cross-evidence must identify the finite bridge to AC knowledge/conduct |

## Key points

1. **Procedural dismissal is not substantive exoneration.** Neither first-instance decision adjudicated the full pleaded merits.
2. **Unadjudicated allegations are not established facts.** The initiating applications prove what was alleged and when, not that the allegations are true.
3. **R09 is real contrary evidence.** Its limited ex-officio “no indications” observation must remain visible even though it is not a full evidentiary adjudication of all seven grounds.
4. **The criminal route must be act-specific.** The useful questions concern the Administrator's own duties, knowledge, choices, practical capacity, patrimonial effects and possible benefits—not friendship, proximity or adverse outcomes alone.
5. **The fee total is precise but not verified.** EUR 110,956.97 is the exact sum of four pleaded components; the complete bank/accounting bridge is still missing.
6. **DP 1901/2026 was previously mislabelled.** It is the separate private-actor/CAM documentary/admission route, not the removal or fee case.
7. **DP 1956/2026 remains separate.** It is the AC/Concurso criminal route in the current register; it cannot be derived from handwritten intake reference 22 without reparto proof.
8. **DIP 80/2026 is disciplinary, not criminal proof.** It can document notice, professional standards and preservation issues but cannot establish criminal intent.
9. **The appeals are not closed by scheduling or accumulation.** Auto 223/2026 combined the removal rolls; it did not decide their merits. The fee appeal likewise lacks a located later signed merits act.
10. **The corpus is complete only within its stated specialist denominator.** Fifty redacted full-text records are preserved, but the complete official Concurso docket has not been certified.

## Controlling public formulation

Aweswell and LPB pursued removal and remuneration remedies against the Insolvency Administrator. The located first-instance decisions rejected those routes on active-standing grounds and did not adjudicate the substantive removal grounds or fee legality. The resulting corpus is probative of notice, positions, procedural treatment, contradiction and appellate pursuit. It supports finite, actor-specific investigation; it does not itself prove criminal intent, collusion, patrimonial harm, fee illegality or judicial wrongdoing.
